The UK is looking at Parental abduction. It sure would be nice the the US government would its responsibility to help American children from foreign courts a little more seriously
Supreme Court to consider duty to return children under Hague Convention from 23 May
Court to consider the correct approach to Article 13(b)
In the case of E (Children), the father is Norwegian and the mother is British. The two children were born in May 2004 and April 2007. The mother also has a daughter from a previous relationship, who is a party to proceedings. In September 2010, unbeknown to the father, the mother and the children left Norway to come to England. The father made a prompt application to the Central Authority in Norway for the children to be returned. The case will see Lord Hope of Craighead, Lord Walker of Gestingthorpe, Lady Hale of Richmond, Lord Kerr of Tonaghmore and Sir Nicholas Wilson consider the correct approach to the Article 13(b) exception to the duty to return under the 1980 Hague Convention on the Civil Aspects of International Child Abduction.
The full judgment will be published on Family Law Week as soon as it becomes available.
