Dr. Leon Koziol interviewed by CBS 60 Minutes co-host Morley Safer in Leon’s law office in Utica, New York. Mr. Safer passed away today.
He was an icon of American media, a whistle blower extraordinaire, a reporter and anchor for CBS 60 Minutes. He passed away today after a phenomenal career that spanned decades. When he spoke everyone listened. You easily became glued to your television sets on Sunday nights when Morley was telling a story. He did it with conviction, class and professionalism, not with political motivation or self service.
And so it was when he interviewed Dr. Leon Koziol at his law office years ago on the subject of Indian land claims and illegal gaming compacts. When an Indian tribe sued innocent landowners for their business and homes in violation of ancient treaties, Leon was hired when few other lawyers were willing to risk their careers. Leon counter-sued on behalf of a citizens group challenging an illegal gaming contact which federal, state and local leaders claimed could not be won.
Well persistence paid off. Despite all the attacks from media, judges and high profile law firms over a period of years, Leon ultimately won for the landowners. A billion dollar casino compact was declared unconstitutional in New York Supreme Court. Years later the land claim was also struck down. One of Leon’s successful rulings can be found at Oneida Nation v County of Oneida, 132 F. Support. 2d 71 (NDNY 2000).
Now Leon Koziol is seeking to declare divorce and family laws which discriminate against fathers unconstitutional. He is also seeking recourse for court corruption and parental alienation. New York Supreme Court recently signed an order against a family judge, Daniel King, to answer Leon’s mandamus and declaratory action regarding a gag order on this website, Leon Koziol.com. The lawsuit features unprecedented retaliations involving Leon’s children for his testimony before the Moreland Commission on Public Corruption.
It was set for a public hearing on June 10, 2016. However, today, at the request of defense counsel it was rescheduled for June 22 at 1:30 pm at the Supreme Court in Utica, New York. TIME FOR A PARENTAL RIGHTS RALLY IN WASHINGTON: WILL YOU HELP ?
As our faithful followers know, we are a blog site dedicated to safeguarding parental rights even when our courts refuse to do their duty of enforcing them, see i.e.Troxel v Granville, 530 US 57 (2000)(parental right is the “oldest liberty interest protected by our Constitution”); Parham v J.R., 442 US 584 (1979)(parents presumed to act in their children’s best interests).
However we rely on much more than a 200 year old blueprint to defend ourselves from ever intrusive encroachments upon the privacy of family life. We at Leon Koziol.com go further to base our crusade on an inalienable human right to raise our offspring since the beginning of civilization itself.
Simply because two parents reside apart does not provide sufficient cause for family judges to scrutinize every aspect of a parent’s decision making authority, whether custodial or non-custodial. It does not offer fertile ground to incite needless custody wars that enrich lawyers at the expense of our children’s sustenance and college funds.
And now, just when we thought it was safe to come out, along comes a decision from New York’s high court which pretends to respect parental rights to eavesdrop on their children’s conversations but with the reservation that you do so at risk of incurring a criminal prosecution. Wow! Did this really happen?
Writing for a 4-3 majority, Judge Eugene Fahey ruled that a father’s recording of a threat to beat up a five year old boy was protected from criminal eavesdropping laws. But he added, if it was done in “bad faith,” a criminal conviction would be warranted. Seriously? Who’s going to make that judgment call on the spot? Eugene? Some lawyer?
By the time “good faith”parents get a judgment call from the state, numerous participants of a court process will weigh in until it reaches Eugene at this same court after a period of years. Will any of them take responsibility for a seriously injured child when a parent decides not to risk commitment to a prison cell next to the real criminals we are monitoring?
We know they will simply punt with an excuse that it’s “the law” even though they created this law along with another one known as absolute judicial immunity. That’s “the law” which protects them from liability unlike the rest of us when we violate the public trust. As our precedent seeking litigation has proven, they’re all protected, and now they’re protecting the criminals.
Who are these people that they can substitute their judgments for those truly concerned about our children on an hourly basis? How much more scrutiny can we withstand before we finally wake up to a reality that our families are controlled by New York lawyers and judges. This is 2016, we live in a dangerous world where our children are exposed to all sorts of predators.
Take for example judges and lawyers. Attorney Steven Lever was convicted of using his employer’s law office computer to have sex with a thirteen year old girl. An attorney disciplinary judge recommended a six month law license suspension with favorable references for his return to employment.
Yes this really happened, look it up yourself at In re Lever, 869 NYS2d 523 (1st Dept. 2008). Attorney Lever served no time and his suspension was converted to three years despite public pressure and a dissenting opinion for disbarment. Leon is still suspended after six years without any criminal charge due to his public criticisms of these courts.
If you think it gets better with judges, one was removed from family court for admitting to sexual misconduct on his handicapped five year old niece. He was Leon’s custody judge, Bryan Hedges. Look him up too along with his chief judge, James Tormey, at Morin v Tormey, 626 F.3d 40 (2nd Cir. 2011)($600,000 liability against both for “political espionage”).
Against this backdrop, the three dissenters in today’s eavesdropping case, led by newly installed Leslie Stein, went off the deep end. They would have us all litigating such issues in divorce and family court. Translation: more cash for lawyers, less for our children. So that’s our report for today and a powerful warning to our sister 49 states: New York is coming for you, it’s called Hillary’s Village where the state owns your children.

None was specified or prosecuted while “anonymous” complaints on other subjects were;
• On January 9, 2008, Leon argued his first appeal challenging a lucrative system of custody classifications which forced parents to fight over their offspring. It was before a court which also appointed ethics committees. One member was his ex-spouse’s divorce lawyer. On the same day, an ethics prosecution was opened for the very first time against Leon after more than two decades of unblemished practice;
• On October 8, 2008, a divorce judge ruled that Leon’s support obligations under that challenged custody law were proper under Title IV-D (Child Support Standards Act). That meant that the judges and lawyers who disrupted the parents’ 2006 agreements did so for no good reason other than lucrative parental conflict. A violation was nonetheless filed to cause another basis for suspending Leon’s law license. Those details are also omitted here due to the gag order.
This is only a small sampling of Leon’s ordeal and punishments for protecting fellow parents (and others who cannot be mentioned here due to the gag order). None of it has ever been disproved or even denied, and this is not the first time Leon sacrificed himself for the people and their rights under the First Amendment.
As chief (corporation) counsel for an upstate New York city, he gave up his post and successfully sued a mayor in federal court for a gag order on public employees. You can look it up at Koziol v Hanna, 107 F. Supp.2d 170 (NDNY 2000)(supported by federal appeals court in Manhattan). On October 9, 2015, the same federal court issued an anti-filing order against Leon.
We continue to fight this battle on principle and for those who cannot be mentioned here. Leon is also fighting for parents, families and children everywhere. But he has been deprived his livelihood for more than six years while a local lawyer convicted of tax fraud on $2 million in client income was never denied his law license even while serving time in prison. Here is an excerpt from a brief that Leon filed recently with a federal appeals court in Manhattan. It helps explain why our children are being alienated and influenced to respect lawyers, strangers, social workers,even street thugs more than their own moms and dads, why violent crime, drug abuse, teen pregnancies and productivity declines can be traced to the seizures of traditional parental authority in these courts:
“While our federal government asserts itself around the globe to advance human rights, its military is returning to divorce and family courts which exploit children for profit. Public safety officers, such as our responders on 9-11, are being hauled into the same courts and subjected to discrimination on account of their gender or line of duty. Many are alienated from their children, committed to debtor prisons or oppressed as inferior parents to feed a trillion dollar industry.
It is a highly protected industry orchestrated under Title IV-D of the Social Security Act, 42 USC section 651 et. seq. States are rewarded by the number and size of “child support” orders manufactured by their courts. Superior and inferior custody classifications are essential to these money transfers and mandated by federal statute even when parents with near equal incomes and childrearing periods set up contrary agreements, see i.e. Bast v Rossoff, 91 NY2d 723 (1998).
Accordingly support judges have been rendered inherently biased against all those classified under the inferior “non-custodial” label with or without justification. Such classifications are arbitrary, stigmatizing and institutional in countless cases, requiring otherwise cooperative parents to compete over their children.
Their infringement of a fundamental right to parent one’s offspring is easily replaced by childrearing plans and orders which retain more family oriented labels such as mother, father and parent, see i.e. Webster v Ryan, 729 NYS2d 315 (Albany Fam. Ct. 2001) at fn. 1(veteran family judge declaring “custody” and “visitation” to be offensive terms in an antiquated system which brings out the worst in parents when children need their best).
However such less intrusive custody substitutes are foreclosed by the blanket classifications and marginalized by overburdened courts committed to the funding scheme. Over time, such injustices have reached constitutional dimension while ever elusive, utopian and overbroad child rearing standards displace parental discretion without compelling state interest contrary to a right declared by the Supreme Court to be the “oldest liberty interest” protected by our Constitution, Troxel v Granville, 530 US 57 (2000)(prolonged custody case can itself violate parental rights), Parham v JR, 442 US 548 (1979)(fit parents presumed to act in their children’s best interests).
A full range of constitutional rights is easily trampled under principles of equity, or the power seized by family judges to “father” our children, see often cited Finlay v Finlay, 240 NY 429 (1925)(“paternal jurisdiction” derived from feudal common law). In plain terms, the Constitution is being ignored because the custody scheme is lucrative for those who depend upon family controversy for their livelihood. It is being facilitated by judges charged with the highest duty of safeguarding such rights, Federalist Paper No. 78; Marbury v Madison, 5 US 137 (1803).
Support inequities triggered by this scheme (child support standards act) are typically countered with custody tactics to result in untold harm to our children, i.e. Pearce v Longo, 766 F.Supp.2d 367 (NDNY 2011)($2 million city liability for police investigator committing murder-suicide with ex-spouse after exiting support court leaving children without parents). In his highly researched study, Is There Really a Fatherhood Crisis, Professor Stephen Baskerville places the blame on government: “What many are led to believe is a social problem may in reality be an exercise of power by the state,” Independence Review, vol VIII, n 4, Spring 2004, at pp 485-486.
Unsuspecting litigants are also exploited by an expanding bureaucracy under Title IV-D to finance welfare costs created by unrelated and irresponsible parents. The ones properly devoted to their children therefore shoulder an unjust burden merely because they reside separately from their partners. These support judges engage in highly abused fictions such as “imputed income” to raise obligations beyond realistic capacities.
There is no express provision for shared parenting under the federal entitlement statute, and the regulatory scheme has replaced the child’s needs with “way of life” standards to elevate support even further. It has removed critical discretion from proper decision makers with outcomes that shock the conscience, see fn 3 and 4.
The “band plays on” in our nation’s family courts because civil rights attorneys and parental advocates such as petitioner are subjugated, vilified and punished for their exercise of reform efforts otherwise protected under the American Constitution. Meanwhile, gay, lesbian and trans-gender parents, soon to be victimized by this same lucrative system, have achieved far greater strides in equality with repeat court actions than fathers have over a century of discrimination.”

While criminal prosecutions continue against leaders of New York’s Legislature as a direct consequence of the Moreland Commission on Public Corruption, serious questions linger. For example, what came of all the shocking testimony and petitions lodged by the general public, limited as it was, on Constitution Day, 2013 at Pace University? What about the hundreds of speakers excluded from that hearing who were left outside protesting as a result? Why was the Commission prematurely disbanded, why were so many citizens misled into believing they could be heard and answered, and how much corruption remains rampant here in New York State due to the utterly impotent nature of that Commission?
It certainly cost our taxpayers substantial money to create this “dream team” of prosecutors and experts to root out corruption in state government. And while we certainly commend U.S. Attorney Preet Bharara for his follow-up investigations and prosecutions, a review of the public testimony raises far more concerns than the ones supporting a prosecution of two legislative leaders. As one of the few who were allowed to participate from the general public, I raised serious issues concerning documented retaliation for my public criticisms on that site and my complaints of judicial misconduct in diverse filings. The retaliation has only escalated dramatically since that hearing.

Therefore I am recommending the creation of a citizens Commission on Public Corruption headed by a “dream team” of good government advocates who can complete the work of the governor’s quickly dissolved “ad hoc” entity. Here are a number of observations from the Moreland proceedings which warrants such a public commission:
1) Ellen Oxman, of Women for Justice in New York Courts, provided compelling testimony of her abuse at the hands of a wealthy opponent with connections to the judges in her divorce and family proceedings. Where did her petition go, where is she today, and what came of the brazen level of injustice she carefully documented before the Moreland Commission?
2) Carl Lanzisera of Americans for Legal Reform and a co-member gave startling revelations regarding a 20 year history of court corruption including the similar impotent conclusion of the 2009 Senate hearings on judicial reform. The chair of that Senate Committee, John Sampson, was later indicted for official misconduct while in office. Among the recommendations made by this organization was the mandatory psychological testing of judges who take our children from us to bring them on par with other government officials.
3) Michael Kraveski, a regular citizen, provided a heart wrenching seven year ordeal in Kings County Family Court which has become all too commonplace in America today, one which led to an unarmed father shot to death in the back while fleeing a support warrant at a traffic stop in South Carolina less than two years later. He described himself as a victim of a “money extortion scheme” through impossible obligations, fraudulent tactical petitions and a “Star Chamber” court. He suffered a stroke in the end after losing his job and life savings.
4) Rich Velotti, an attorney for Act Now New York made an ominous prediction of sorts when he described how Assembly Leader Sheldon Silver, Senate Leader Dean Skelos and former leader Joe Bruno conspired to influence and limit the work of the Joint Commission on Public Ethics, an entity comprised of members selected by them and the governor to investigate misconduct in Albany. All three were prosecuted criminally by federal authorities, none by the state. Attorney Velotti labeled the JCPE “a joke” with a strong recommendation that the Moreland Commission, with its independent investigatory powers, be made permanent.
5) Marie Tooker, a single mother of three, described a criminal enterprise in our courts which left her homeless with $12 in her bank account.
6) A Fordham law professor commended the Commission as an example of good government, never imagining that it would be dissolved in six months for doing the very work it was charged to perform. She emphasized the need for permanent “structural” changes to replace the “prophylactic” approach to public corruption which remains in place.
7) Elena Sassower was so emotional over the lack of judicial accountability over many years that she refused to yield to her allotted time as a speaker, even under threats of removal.
8) Katherine Wilson, a victim of divorce court, began her testimony with a request that certain Commission members cease their texting during the general public segment of the hearing. She also asked that one or more members who had left for the lobby during that segment return to their seats so that she could have the benefit of a full Commission. Needless to say, she elicited a resounding applause for her bold introductions after emphasizing her experience with “guns in her face” while living in Ireland. It left her without any fear of this Commission. When asked to conclude her remarks, she defended her few minutes of space with the one hour spent by the Commission chair lauding the credentials of members which were already found in the table brochures. She cited shocking examples of domestic violence victims who preferred to return to their abusive home environments than face the “battering” they sustained in New York’s matrimonial courts. You simply have to listen to her full presentation as I cannot do it justice here.
9) Marguerita Walter gave yet another heart wrenching ordeal at the hands of a corrupt divorce system with a “de facto termination of (her) parental rights,” some $150,000 spent on “supervised visits” and the ultimate permanent alienation of her children. She described 12 years of cruel and retaliatory acts for her exercise of fundamental rights after giving birth to children abandoned at an early age by their father. She was a Cuban refugee as a child herself fleeing from a corrupt communist regime headed by dictator Fidel Castro only to find far worse oppression here.
10) Not to be out done, Mr. Gallison, a reporter for secondary news sources, Truth-out and Black Star News, provided the Commission and its audience with a shocking rendition of corruption involving the selection of Jonathan Lippman to the highest judicial post of Chief Justice at New York’s Court of Appeals. He gave testimony before the 2009 Senate Judiciary Committee hearings, provided complaints before the state Judicial Conduct Commission and furnished reports in response to Preet Bharara’s request for input following the disbanding of the Moreland Commission, all of which went un-answered.
What happened to these speakers and their presentations? Where are they today? More to the point, what can we, the people, do to get the answers? What can we do to obtain follow-up on all the corruption which could have been heard from all those good citizens left out in the audience or in the streets? Why is all this being swept under the carpet? If we do nothing, we guarantee more of the same or worse corruption in years to come, not a very good legacy for all the children and future generations harmed by the same corruption. It’s a trillion dollar “cottage industry” as one speaker plainly put it, and it shows no sign of correction.
Consequently I am asking our followers and advocates of good government everywhere to join my petition for a People’s (Moreland) Commission on Public Corruption. Kindly spread the word, make it viral as you are so good at doing, send me your credentials, suggestions and support, and let’s give this government something it never expected. We can conduct a preliminary conference call when enough interest is offered, followed by a meeting at Pace University, State Plaza in Albany or any other location for hearings. We can apply FOIA and subpoena powers where possible, and issue our own final report for media consumption and government deliberation. And, unlike the costly Commission, we can do the necessary follow-up ourselves in public, political and electoral processes. An organized protest is long overdue on this crucial subject.
Seeking Human Rights Protections for Aggrieved Fathers in Paris

Ever wonder why crimes and civil debts bear reverse punishments in our nation’s divorce and family courts? Supreme Court Justice Abe Fortas once described these forums as “Kangaroo Courts.” Poor Abe, he would roll over in his grave today if he knew what was happening to our families and children here.
But it’s true, support debtors, nearly 100% of them fathers, are being tossed in a cage every day by self righteous family judges while crimes committed by their accusers are going unpunished. Welcome to Kendra’s Chronicles IV, where we bring you a personal side to the corruption which is occurring in these courts across our country.
Parents are advised time and again by unscrupulous lawyers to fabricate or embellish upon facts in their petitions and testimony for tactical gains in needless court cases. It is lucrative for everyone but our families. A product of an archaic custody framework, such crimes are preferred over shared parenting laws to keep us fighting over our offspring. Who can blame some when the courts shove moms and dads into an arena reminiscent of a Roman Coliseum with a winner-take-all mentality?
At most, however, a perjuring mother will face a change in custody, and because this may harm the child more than anyone else, such crimes are highly ignored. To be sure, no judge or prosecutor wants to be known as the one who incarcerated a mom even though she caused an innocent dad to be denied access to his children or wrongfully convicted of contempt or abuse.
For fathers, it’s quite another matter. Judges are programmed to believe that a man is stronger, physically and emotionally, to sustain the pain and suffering caused by the loss of a child’s affection or human liberty while incarcerated for a money debt. When an aggrieved dad reacts to the prejudice, he is ordered into anger management. Put another way, our courts are forcing dads under penalty of losing their children to accept their unequal status in violation of rights protected by our Constitution.
Hence it is the male parent who must bear the brunt of injustices needed to keep this archaic, lucrative and unequal custody scheme in place. It also explains why discrimination is still tolerated, why fathers remain 85% of support obligors and why nearly 100% of jailed debtors are men, including those who learn too late that the subject children were not theirs. Indeed the phrase “dead beat dad” has yet to be condemned for what it is, a sexist slur.
If a dad rightfully demands fair treatment and accountability, it may beget discreet or even overt retaliation of the kind I sustained when shedding light on the corruption which occurs here. I lost ten months access to my little girls until false petitions were finally dismissed for lack of evidence in 2010. I never even had to put in a defense. But as far as the court was concerned, it was over, no damage done. Dad got his girls back.
Seriously? That’s it? I lost four major holidays, two birthdays and my eldest daughter’s First Holy Communion because of the crimes committed by a scorned ex- spouse, not to mention the precious interactions between a loving dad and two innocent girls. But fathers no longer matter in these courts especially after money became their priority.
Perjury had been rampant in the often deranged testimony of a mother named Kelly Hawse-Koziol. The judge could conclude that much on the contradictions and ill-preparation alone. These were extremely damaging accusations employed purely as custody tactics, yet not even a scolding or slap on the wrist came of it.
The logical consequence of this kind of break-down in the administration of justice is more of the same. It encouraged this woman to repeat her crimes again and again if for example my girls reported a fun outing with a girlfriend or some rumor which could get her more “child support” in retaliation. It was also a product of entitlement mentality prompted by liberals across the country.
Kelly Hawse-Koziol remains a tenured high school teacher at Frankfort-Schuyler School District in upstate New York. On numerous occasions while still married, I was called upon to proof-read her resumes in a desperate attempt to leave that district notwithstanding my routine defense of the community and school board. Our efforts got her interviews (and arguments) but no success.
Ten years later, this Masters degree teacher was filing court petitions so impaired with grammar defects that a judge was forced to insert five “sic” notations in a single paragraph to make it a part of his decision. Never mind what this teacher might be doing to the students or taxpayers of her school district, it was my job as a co-parent to make sure that no harm was done to my girls’ home studies
On one occasion, Ms. Hawse-Koziol asserted the startling fact that the Nile River flowed south, evidently because it looked that way on a map. For many of you this may seem inconsequential but when it came up during one of our many father-child trivia exchanges, I could have gotten myself in contempt of a court order especially the way I was being scrutinized as a free speaking American.
My girls are one grade apart in a nearby school district and very smart. You know I’ve got to tell you that, I’m a proud father. They loved to absorb knowledge from whatever source and would never let me stop with the many true-false or multiple choice exercises we practiced during road trips. In none of the family court proceedings over the past six years did such quality activity receive any mention.
It was one of many learning advantages which was ripped out from under them by a family judge more intent on suppressing the exercise of free speech than dignifying the role of a genuine father. He damaged these girls in more ways than one. But the inequities of family court generally and the misconduct of this judge in particular had other impacts.
During one of our trivia exchanges, I was subject, as most parents are in family court, to a restriction upon parent-child discourse involving litigation. It’s hard to know how to draw the line where a parent’s authority ends and the state takes over. It was harder still even as a veteran lawyer-parent when my judge, Dan King, found me to possess college degrees I never earned for purposes of imputing child support income.
Well the conflict found its way into our trivia games and limited weekend fathering activity. To make a long story short, I could not correct answers which my girls attributed to their mother. When they defended her on the degrees she possessed, I was hard pressed not to explain how a judge had misrepresented the facts on this subject. My preferred approach was simply to be a father even if it meant violating orders that made cackling hens more sensible .
A loving dad’s surprise gift to his little girls with memories to last an eternity.
Crucial Introduction:
A lucrative child control industry has emerged in America’s divorce and family courts, inflicting moral, educational and productivity declines among our cities, towns and villages. It has made us the most litigious nation in the world as we spend our valuable time and energies on court contests instead of more constructive pursuits.
It’s one thing when the fight concerns products or property but quite another when innocent children are exploited. As parents bound by laws of nature, we cannot remain idle in this escalating crisis while lawyers, bureaucrats and “experts” profit at our children’s expense. How many little ones will never see a good education or career in today’s competitive global market because their parents squandered life’s savings on endless court battles?
It’s not all our fault despite what many judges claim. They know privately that needless court battles are ended only because the money runs out. In the meantime, they could care less that our children or families suffer. Outdated custody doctrine is vigorously retained over shared parenting because unequal classifications beget controversy which, in turn, justifies state intervention. It is a crisis created by socialist-liberals who made the policy case long ago that government is better suited to raise our children.
Hillary Clinton made the same case against both moms and dads in her 90s era book, “It Takes a Village.” Her propaganda sounded good at the time because children were used as a pretext for big government, but it resulted in further erosion of parental authority, leaving minors free to set their own standards of behavior. Almost anything a parent does today to correct a child can be the subject of an agency inquiry, school report or custody impairment.
In plain terms, Hillary’s village works like this: get the people of a community gossiping about their neighbors’ private affairs. Convince them to report objectionable styles of parenting to authorities. Once under a court’s jurisdiction, these fit parents can be conformed to an elusive standard for lawyers to argue and profit over. It goes on all the time in divorce and family courts with “parent education” programs and court ordered evaluations.
This is our latest series regarding court corruption entitled “Kendra’s Chronicles.” Here we provide you with real life injuries caused by socialist policies injected into family litigation. Judges overwhelmed by their “super-parent” roles and overcrowded dockets issue orders based on scripted testimony or lawyer summaries having little regard for the human tragedies they produce. It can easily become a “turn ’em and burn ’em” enterprise.
In “King’s Chronicles” we showed you how a new family judge named Daniel King of Lowville, New York abused state power in retaliation for Dr. Leon Koziol’s public criticisms and reform testimony before the Moreland Commission on Public Corruption. His criticisms included King’s fabricated college degree, parenting conditions in violation of a higher court order and impositions which placed his critic (Koziol) under risk of contempt by ambush.
Ultimately two innocent children were denied access to a fit and loving father for a period of 456 days and counting. This human rights atrocity committed upon Dr. Koziol was orchestrated through absurd parenting conditions added with each public criticism until Leon was forced to abandon his role as a natural father. Here we give you some heart wrenching consequences of Dan King’s egotism in a court which might as well be located in Hillary Clinton’s village.
DADDY, I WANT TO GO THERE!

“Daddy, I want to go there!”
It was an uncontrolled scream from a five year old girl which I will never forget as long as I live. Only words, I’ll admit, but they were the world to me coming from my eldest daughter as I opened the front door to our home early one morning. There in the distance was an elaborate playground constructed specially for her and her sister as a father’s day surprise.
The year was 2007, a long time ago, but only if you measure it as a business person. I can recall every detail of Shelly’s facial expressions as she took in something bordering on paradise. Miraculously it had appeared overnight. That was enough for Debbie to exploit the moment, shoving past her older sister into the sunlit yard with a sound that ignited sparrows, robins and blue jays from all surrounding tree limbs. As if on cue, our nearby frog pond erupted with croaking and splash-outs.
Well it worked! All my efforts to make this event a memorable one paid off. You might call it perfect. But you should also know that it was anything but easy. I had to order the apparatus from Georgia and have the area excavated, rearranged and protected by two retaining walls. On one occasion, I rode my girls on a bobcat during a clearing process to give them a sense of participation in this project (with no idea of what was coming). I never disclosed this fact until just now, so don’t report me to their mom.
When the playground components arrived, my contractor went to work (as I did to my law office to pay for it all). After several days, the assembly phase turned into a real mess. The guys could not seem to put everything together properly. I was furious when learning of it outside the courthouse. But that’s where the rescue came in. I was representing an old college friend who I had just gotten out of a real mess of her own without any fee. She owned a ranch and knew a few things usually reserved to men.
Hearing my dilemma, she quickly offered to rectify the errors. With the help of her woman assistant, she completed paradise in time for father’s day. Favors have a way of coming back around. This client will be forever remembered for her rescue as will another very special woman who arrived one year later, about the time when a trampoline was added to the mix. Together we made this place a regular treat for my little girls. These are exciting stories reserved to a later episode in this series.
You might think that a private playground of this caliber meant that my girls would become spoiled. Quite the contrary, they enjoyed the public venues even more. I can still remember Shelly, she couldn’t have been but one or two, dutifully lugging her “Blues Clues” up the ladder with endless repetition before throwing the poor puppy down the slide with a glee that resonated across New Hartford Town Park. And Debbie, running off to the “wilderness” (trail system) which had me split in every direction.
At Lake George, our summer destination, I will never forget a playground near East Cove where the girls enjoyed themselves as much as they did boating and swimming. I don’t believe those outings were eclipsed until many years later when I took both up for their first para-sail adventure. And boy did I hear it from mom in a family court petition after that one! But she was a “custodial parent” by then which changed everything.
I like to think I was different than most dads at these public playgrounds. While they watched or tended to their barbeque grills, I was chasing my girls all across the slides, monkey bars and whatever else was there to exploit. They easily made lots of friends because the other children would simply join in the games I made up to everyone’s delight. Some of the parents knew I was a lawyer and probably figured that our activities were liability-proof, or more likely that I had regressed to my own childhood.
No matter. I didn’t really care. As a “non-custodial parent,” my time was sadistically limited by our courts, so I would be taking full advantage of such moments, knowing they would one day find their way into memories like this one. Although moms seemed to dominate these places, I actually think that playgrounds were constructed with dads in mind. Such fun places resonated deeply within my girls. That much I know.
In practical terms, these playgrounds are all gone now. The one at my home hasn’t been visited in more than a year. But in my mind I can still hear the laughter, the crying, the giggling, whispering, and happy faces, indeed all the things that made them so special in their day.
Yes, playgrounds were a means for overcoming that weekend warrior status accorded to fathers under “the law.” But above all else, they have reserved to another time and place the fact that my girls had a genuine father who loved them, then and now and for eternity.

Attorney Malik Shabazz, national president of Black Lawyers for Justice demands justice in Charleston
Administrator’s summary; if you’ve been following recent posts on this site, then you know that Leon has been in Charleston, South Carolina this past week advocating for fathers’ rights in connection with the Walter Scott murder. He has been working diligently to shift government and media focus from the race aspects of this horrendous incident to the family court abuses which triggered it.
To that end he has been distributing his report made public last month in Nashville entitled “We Are Fathers” to civil rights leaders and government representatives. His progress reports can be found here at Leon Koziol.com, a site devoted to family law reform. After vocalizing his concerns before national media, Leon was featured on Charleston television yesterday.
As we become educated to these draconian support collection practices, it is increasingly clear that Leon’s efforts are vital because good fathers are now being killed by law enforcement for delinquent family court debts. Here no crime was committed. Instead a black father was shot in the back by a North Charleston police officer who is now in jail without bail on murder charges.
This father had long experienced the discrimination and abuses which convinced him that Justice was better served on the streets than in these courts. He just never expected he could be murdered by a cop for failing to pay his bills. It’s a scary incident which could occur to any father in America today given the false criminal stigmas and sexist slurs being advanced by our own federal government as recently as 2012 in Justice Department news releases.
The Walter Scott incident, preserved on a video seen around the world, shows an unarmed father fleeing arrest on a support warrant at a traffic stop for a broken tail light. The cop fired eight shots from a distance at the fleeing debtor with five bullets entering his back, one in the heart.
The white officer is then shown casually walking over to his victim and cuffing him face down as he took his final breath. Again there was no crime committed but the family court warrant was now executed with no money or daddy for the children. Here is how Leon finally managed to shift focus in Charleston:
It wasn’t easy, in fact I was beginning to think it was a lost cause. Despite all my appearances, participation in media events and interactions with civil rights protesters and government officials all across Charleston, South Carolina this past week, once again no one was listening. I reiterated my statements concerning the killer in the Walter Scott case, emphasizing not the cop named Michael Slager but the silent and insidious accomplice known as family court.
In yet another news conference today at North Charleston City Hall, everyone was focused on race as a lawyer for protesters in Ferguson, Missouri announced a new wave of protests here. I had delivered my report to the local organizer of the event but the father issues remained without mention by anyone. So once again I asserted myself on the media side of the presentations before the keynote speaker.
In his riveting keynote address, Attorney Malik Shabazz, national president of Black Lawyers for Justice, described black men as the hunted ones, killed “like deer and dogs.” During subsequent media interviews, I raised the father discrimination aspects surrounding the Walter Scott murder which set this case apart from all other racially charged incidents across the country. I cited three status based factors which worked against this particular victim: he was black, a man and a father. I urged all in attendance to support my public appeal for a Justice Department investigation to prevent more of these incidents.
At the request of the event organizer, I was asked to hand deliver my report “We Are Fathers” to Attorney Shabazz at the podium. A resounding applause ensued when I did. The keynote speaker joined in the issues raised and went further. He agreed that the support warrant was a major concern and that he would study my report for answers and reform efforts.
Following this national media event, I was approached by African-American victims of court injustices. Of course I could not provide assistance due to the retributions experienced back in New York for my public predictions that materialized here. I was then asked to give a separate live interview on Charleston television. I will provide further details in a later post.
We’re making progress fellow parents, fathers and victims. Regrettably I feel like I’m doing it alone in Charleston but a profound statement had to be made here for all family court victims across America. We’ll continue to keep you informed.
