Independent Misconduct Commission being organized to counter official commission neglect of citizen complaints

If you are a regular follower of this site, you know that our Institute and fellow advocates of government accountability have remained unable to obtain the necessary investigations of judicial/lawyer misconduct and family law reform. It is a trillion dollar industry controlling our courts much like the tobacco, energy and drug companies control our elected officials.

But the time for surrender and depression is over, we get it now, the ones we entrusted to deliver “justice for all” have made it clear they could care less about our grievances. Just don’t acknowledge us, and the misconduct simply did not occur. But this neglect of our complaints will no longer be tolerated. A citizen occupied commission is being organized to act in place of the official ones dominated by lawyers and violators.

Dubbed the Independent Misconduct Commission, we are looking for conscientious citizens willing to serve on our board of directors. We are also looking for contributors, writers and researchers on a voluntary basis until sufficient donations and investments can be obtained. That means we need fundraisers as well. Meetings will be conducted by teleconference or Skype with assignments by electronic means and phone.

The idea here is to act as a substitute for the corrupted commissions and committees. We will monitor judicial commissions across the states and deliver counter-reports where required for a more appropriate penalty which we will share with that commission and media. For those complaints that are wrongfully neglected, we will issue our own “reprimands,” “public censures” and “removal recommendations.” Our ever expanding website (to be developed soon) will catalogue all our reports and shared over the internet.

The myth that widespread corruption in our courts is nonexistent may easily be debunked by citing major joint investigations such as Operation Greylord in Chicago. 17 judges, 48 lawyers, 10 deputy sheriffs, 8 policemen, 8 court officials and one elected official were indicted. Nearly all were convicted. The young lawyer secured by the FBI to gather evidence in that Operation was advised that he might never practice law as a result. I incurred that very punishment for my whistle blowing and reform activity, hence my resolve to make this independent commission a reality.

An independent citizen commission is further justified by recent reports such as those in New York and California showing that as little as 10 % of all complaints are even investigated by the official judicial commissions. Our third branch of government cannot immunize itself from accountability in this manner. The number of judges convicted in federal court of bribes, extortion, racketeering and fixing custody cases is unprecedented. That fact alone justifies checks and balancing of their self-regulated operation. To that end, a sampling of documented cases is now in order.

New York Chief Judge Sol Wachtler was sent to federal prison for secretly harassing his mistress and her daughter for a bribe. He directed paid court staff to harm the lawyer who was helping her expose him. In his book, After the Madness, Wachtler rationalized that judges are taught to think as gods. Contrary to that status, my custody judge was banned from the bench after admitting to sexual abuse of his handicapped, five-year old niece, In re Bryan Hedges, 20 NY3d 677 (2013).  Unlike priests and other sexual predators, that judge was never prosecuted criminally.

Brooklyn divorce judge, Gerald Garson, was also sent to federal prison after FBI agents proved that he had accepted a bribe to fix a custody case in favor of a father. He was released early after numerous Garson colleagues submitted good references. Now what does that say about setting an example and any genuine concern for fairness and justice? In upstate, New York, another judge tried the same thing in favor of a mother. New York Supreme Court Judge Thomas Spargo was convicted for seeking a $10,000 bribe. He needed it for lawyer fees to defend earlier misconduct charges.

In the “Kids for Cash” scandal, two Pennsylvania judges were sent to federal prison for accepting bribes from detention center contractors. 4,000 juvenile convictions had to be overturned by the state’s Supreme Court which had its own justices mired in scandals. One juvenile victim committed suicide, and his mom chastised these judges at their sentencing. one co-defendant judge ordered evaluations to be conducted by a relative who raked in over $1 million as a result.

A married Michigan judge, Wade McCree, presided over a child support case while getting the mom pregnant and putting an unknowing dad on a support monitor. He was removed from the bench, but the dad’s lawsuit was turned down by the U.S. Supreme Court due to judge immunity. Can it be that judge adultery in chambers with an active litigant is now a protected judicial act? What other “acts” are judge-immune?

In Watertown, New York, a state court judge, James McClusky, sentenced a school employee convicted of sexually abusing a 14 year old student to probation, no jail time, while good fathers are being sentenced to six month jail terms in the same court for failing to pay child support bills. Victim supporters collected over 70,000 signatures in a petition to remove McClusky, but months later, that judge remains on the bench and the state judicial conduct commission has taken no action.

Finally, we bring you a shocker from Utica, New York. City Judge Gerald Popeo was merely censured in 2015 by the same judicial commission despite a hearing judge who found that he had made racist jokes to an African-American attorney. Asked whether the attorney knew what downstate blacks called upstate blacks, Judge Popeo got no answer. He then stated, “country niggers.” He targeted a former African-American commissioner causing a suicide attempt in the city lock-up.

Gerald Popeo was found guilty of numerous ethics violations. He threatened to come off the bench to wipe a smirk off a litigant’s face. He jailed men for contempt in violation of their rights. And because he was never removed, Popeo was assigned to my family court matters in 2018 (as a city judge), resulting in a near fatal outcome. How is such violent, racist and unethical conduct appropriate for family court where domestic violence and debtor prisons are common? Popeo was brought up on complaints of racism and bias against this judicial whistle blower but, to date, nothing has come of it. With an independent commission, we would have countered the public censure with a report publicly demanding Popeo’s removal and disbarment.

Such egregious misconduct is not limited to state judges. In United States v Cossey, 632 F.3d 82 (2nd Cir. 2011), a federal judge issued a six-year sentence for a non-violent offense with the kind of omnipotence that would make anyone cringe. Judge Gary Sharpe announced a gene to explain criminal behavior, one that would be not be discovered for another fifty years: “It is a gene you were born with. And it’s not a gene you can get rid of,” he emphasized to the defendant while condemning the psychiatric profession for its own opinions that were “all over the board.”

Reversing this decision, a federal appeals court unanimously found that Sharpe’s brand of justice “seriously affected the fairness, integrity and public reputation of judicial proceedings.” In a rare move, it referred the case to another judge on remand. Such gross misconduct conflicted with the rationale for granting life tenure to federal jurists. Recourse is limited to the illusory process of impeachment where only one judge in our history was removed for non-criminal behavior.

This sort of “Hitleresque” mindset must be rooted out for the evil that it is with congressional hearings. In countless family court cases, records are falsified and misconduct is concealed or disregarded to protect judicial reputation. Judges are widely deemed to be beyond reproach. Tragedies have therefore resulted from oversight failures and a lack of criminal prosecutions involving human rights violations under federal law such as the ones cited above. Five cases highlight the horrific consequences to parents, families and law enforcement over the past decade:

On September 28, 2009, police Investigator Joseph Longo was ordered to pay $1,800 in monthly child support. He answered the same day with a murder- suicide leaving four children without parents. Even the district attorney could not predict this. A $2 million recovery was based on a zone of danger created by city officials as opposed to family court, Pearce v Longo, 766 F. Supp. 2d 367 (2011) LaDuca, Rage built Longo to murder-suicide, Observer Dispatch, 12/30/09.

On June 15, 2011, a father and war veteran, Thomas Ball, burned himself alive on the steps of a family court to protest years of abuse and separation from his children. It stemmed from a single incident of slapping his daughter, and he left behind a manifesto on how to firebomb courts. Even after such a horrific death, the ex-wife stubbornly defended herself by complaining that her children’s dad failed to comply with court counselling. This is how demented the process has become, see Mark Arsenault, Dad leaves clues to his desperation, Boston Globe, July 10, 2011.

On April 4, 2015, Walter Scott, an unarmed father was shot dead five times in the back by a traffic cop while fleeing a support warrant. The shocking murder was videoed by a concealed bystander. Contrary to national hype focused on racism, the victim’s funeral pastor blamed it on draconian child support confinements. Many concluded that the state was now killing for money given the revolving door outcomes. In vain, two reporters warned of this trend, see Robles and Dewan, Skip child support. Go to jail. Lose job. Repeat. New York Times, 4/15/15 at pg. 1.

On July 30, 2018, a physical therapist with a practice in Manhattan fatally shot his ex-wife, their 6-year old son and current wife in his Astoria (Queens) home. It became the final edict in a protracted custody battle fueled by judicial war games. After a failed Go-Fund-Me effort to pay his lawyer fees, in a page titled “Child Kidnapping,” the abused dad, James Shield, explained, “I had the perfect life a few years ago but it has spiraled out of control,” Moore, Musemeci and Sheehy, Custody battle led dad to family murder suicide, New York Post, July 31, 2018.

And so the carnage continues, this time in Philadelphia where a mother showed her dissatisfaction during a domestic dispute over child support by purchasing a gun and killing the father and their two infant children the next day. It occurred on October 15, 2019 and the mother, Damyrra Jones, survived her suicide attempt only to be arrested on multiple counts of murder.

Less transparent are the countless cases swarming beneath these five which can easily explode. Their cause is wrongfully blamed on the parents. The public is duped into believing that an adversarial process yields truth and justice in our courts. That may be true in other forms of litigation, but when children are taken hostage by untethered lawyers, the opposite is true here. Parents commit perjury on an artificial premise that they are protecting their offspring. Sparks convert to forest fires, children emulate the dysfunction, and the perpetrators profit.

HAPPY NEW YEAR! Family Judge Sued for Lewd Conduct by Court Attorney and Clerk: Reads Like Parent v New York

By Dr. Leon Koziol

Parenting Rights Institute

In August, 2017, Family Judge Richard Miller was removed from his duties on the bench and reassigned by the New York Unified Court System.  No details were released at the time to explain why. Now comes the revelation that he forced his court attorney and clerk to view pornography including nude photos of a co-worker. Among other “family friendly” duties, Judge Miller made sexual demands and even asked his clerk (Gallagher) to engage in sex acts with an elected official to curry political favors.

Yes, it’s all there in a federal court complaint filed on December 21, 2018 which reads, verbatim in some segments, like my precedent seeking action on behalf of abused family court litigants in Parent v New York, 786 F. Supp. 2d 516  (NDNY 2011). Indeed, so closely does the complaint pattern mine that one might easily conclude that it was used as a template by the law firm which filed the action last week.

Of course the difference is that the plaintiffs in my case were litigant parents whereas the current one features court employees. Judges have fashioned a special rule for themselves known as Absolute Judicial Immunity from lawsuits by litigants whereas they get no such protection from lawsuits by subordinates even if the misconduct is identical.

For example Michigan Judge Wade McCree was given immunity in a federal lawsuit brought by a father in a child support case whose opponent got pregnant by the married McCree in chambers while presiding over the case. Such immunity carries over from the King of England and finds no authority in our Constitution.

So committed was I to removing that immunity that I filed four federal lawsuits which earned a filing restriction by a federal judge, Gary “not so” Sharpe. Gary was removed by a federal appeals court from a case due to a human gene he used for decision making which he claimed would not be discovered by scientific experts for another fifty years. The appeals court found his bizarre conduct to harm public confidence in the judiciary.

Yet Judge Gary Sharpe was never impeached, he did not resign in shame as he should have, and he refused to step off my case afterward, see United States v Cossey, 632 F.3d 82 (2nd Cir. 2011). The Cossey ruling is one of the few in which the decision itself was found to be sufficient grounds for bias and disqualification.

Another case which illustrates the unjust disparity between litigant and employee in judge accountability is Morin v Tormey, 626 F.3d 40 (2nd Cir 2010). This case featured my administrative judge and ex-custody judge, Bryan Hedges. They were successfully sued by a chief family court clerk based on unlawful retaliation for her refusal to engage in “political espionage.” She recovered $600,000.00.

Hedges was removed from my case in 2011 and from the bench altogether one year later after he admitted to sexual misconduct on his handicapped, five year old niece, see In re Bryan Hedges, 20 NY3d 677 (2013). His co-defendant, Judge James “Bond” Tormey is still on the bench even after assigning 41 trial jurists to my originally uncontested divorce case. Over a 12 year period, nearly half were removed by motion due to bias or misconduct.

Like the 2017 reassignment of Family Judge Richard Miller, no reasons were given, and like Tormey, Miller is still a judge hauling in close to $200,000.00 in annual salary. The “immoral” of this story is that a lawsuit by an employee is acceptable but one against a judge containing similar claims is “rambling” and even “incomprehensible.”

This is one of the many reasons why I have asked fellow victims to join me in a march on Washington, May 3, 2019, to start in front of the White House and ending on the Supreme Court steps. Get the details on the 6-minute video here produced by an NBC production crew. A more startling one is forthcoming, ironically on the subject of judge misconduct across America. Look for it on this site, Leon Koziol.com and spread the word.

Blockbuster Case Now Playing in Family Court: It’s Rocky vs Rambo

“I would love to come off this bench and wipe that smirk off your face!” Judge Gerald Popeo to a litigant in his city courtroom. Despite such physical threats and racial comments with lawyer witnesses, i.e. “country niggers” and “cigar store Indian,” the Commission on Judicial Conduct allowed him to continue now as an “Acting Family Judge” in Koziol v Hawse-Koziol case.

By Dr. Leon Koziol

Parenting Rights Institute

Before continuing with this latest post on judge corruption in our nation’s divorce and family courts, I would like to say Hello to all the judges, lawyers, doctors, professors, investigators, commissions, national and local news reporters,  and even New York Chief Judge Janet DiFiore who may be monitoring this website, Leon Koziol.com. Confidential informants continue to report a growing number of “fans.”

Many of you are friends, others are bent on revenge, and most are seeking information or assistance. If you’re new to this site, opened in 2010, you’re in good company with more than 6,000 followers from Europe to Hawaii. This will be a “breaking news” post you will want to make viral because it is yet another shockingly true story. As we have assured time and again: “You just can’t make this stuff up.”

Judge Gerald Popeo is a racist and pompous judge who managed to keep his job in an upstate New York city court despite a battery of ethics charges brought against him by a prosecutor, public defender, an African-American lawyer and court victims before the New York Commission on Judicial Conduct. Because its proceedings are secret, we cannot tell you how many complaints he has faced during nearly two decades on the bench.

On February 12, 2015, Judge Popeo was merely censured by that Commission instead of removed, although to his credit, the Commission Chair, Thomas Klonick, dissented. He voted to sustain the findings made by a hearing judge concerning those charges of using racial slurs as a judge. They included at least two depictions of a prosecutor acting like a “cigar store Indian” and another, to an African-American attorney no less, where Popeo “joked” that New York City black people refer to upstate black people as “country niggers.”

That’s not all, the charges and findings that were accepted included temper tantrums and serial contempt citations without the requisite warnings and due process protections. In one case, evidently copying some of the movies that Gerry has watched (i.e. “My Cousin Vinny”), Judge Popeo sentenced a man to five successive thirty day periods in jail for each facial gesture or comment about the lack of justice in his courtroom. Only after getting a phone call from his chief administrative judge, James “Bond” Tormey, did he reduce the 150 day sentence.

But among the “injudicious” acts which the Commission did accept for public censure, the one which was most disturbing is a violent threat from the bench made to another litigant in his courtroom. After noting a grin on his face, Judge Gerald Popeo, evidently assuming the mantra of judicial Rocky Balboa, warned that he “would love to come off the bench and wipe that smirk off your face.” The Commission could not excuse this street thug remark because those in the same court could hear it clearly and it was recorded by a court stenographer.

But it gets better (or worse depending how entertained you are by Judge “Rocky” Popeo). After the litigant was excused and exiting the courtroom, a different kind of grin caught Judge Rocky’s attention. So he summoned him back for a contempt sentence because, in his delusional mindset, this poor sap “gave (Popeo another) nice big smirk …. as if to say, blank-you judge.” Seriously Sylvestor? Even the real Stallone might have you committed to a mental institution.

As a lawyer and litigant in Popeo’s kangaroo court and many others over a thirty year period, I have made all sorts of grins, objections and human expressions which could fall in the Popeo contempt playbook. And now this judge has been assigned to my custody and support cases as an “Acting Family Judge” in a court he was never elected to. How’s that for domestic violence prevention and our children’s “best interests?” You women better not grin in Gerry Balboa’s boxing court.

Yes you read that correctly. After my family court matters were assigned to remote courts at Lake Ontario and near the Canadian border, with 150 mile round trips to receive decisions already written, Judge James Bond has now assigned a judge only a few miles from our (parent) homes who threatens violence. Welcome to Trial Judge #41 assigned since my originally uncontested divorce was filed 12 years ago in 2006, a judicial record by most accounts.

It occurred after the Oswego and Herkimer judges recently stepped down. Judges #39 and #40 gave no reason, and I was given no notice of their disqualifications, but they came after my complaints to oversight authorities. Those published complaints focused on their unauthorized back room involvement in each other’s separate cases to orchestrate unlawful service of a support summons threatening as much as seven (7) years in jail. That’s more than violent felons and child molesters get. My pedophile custody judge Bryan Hedges (look him up) got no prison time!

I had been challenging service by mail on the face of that summons and petition because it leads to innocent non-appearances or fatal law enforcement for money collection purposes. A sensationalized example is an unarmed African-American shot dead five times in the back while fleeing a support warrant at a traffic stop in South Carolina  (Walter Scott).

When I became one such victim of a non-appearance, an earlier support magistrate corrected the human error over the phone in 2012. But not Gerry Balboa. He was on some kind of mission given to him by his boss Judge James “Bond” Tormey who assigned all the other 40 trial jurists to my family court cases. He did so in a manner which mirrored the retributions inflicted on a chief family court clerk which resulted in a $600,000 recovery against “Bond, James Bond” in federal court for her refusal to engage in Tormey’s “political espionage.”

Again we don’t make these things up here at Leon Koziol.com. Look it up at Morin v Tormey, 626 F.3d 40 (2nd Cir. 2010). Shameless Tormey was neither removed from his position nor did he resign from the bench. With my full page advertisements and editorials published over the past few months in Syracuse, Utica and Watertown, New York mainstream newspapers, testimony before the Moreland Commission on Public Corruption, and continued exposure of rampant judicial misconduct nationwide, the retaliation elevated to unprecedented levels in Oneida County Family Court on March 3, 2018.

On that day, I made it clear that Gerry had better not threaten me with violence and most assuredly, he had better stay put on his bench. For the reasons that follow, I knew this was beyond question a contempt by ambush and an unlawful act of attempted imprisonment which a citizen has a right to defend against in such an extraordinary case. Think of it as a Rambo One movie with the corrupt cops replaced by corrupt judges.

In my reports I compared the judicial gang assault inflicted upon me for so many years to a Rodney King beating with the fists and batons replaced by orders and edicts. If Gerry decided to confront me physically and unlawfully under the protection of our court security, it raised the real question of who they should taser. Who was the real criminal here with this focus on domestic violence in these (family) courts? What would Sylvestier Stallone  do if he was real in this environment?

While depicting my discrimination and First Amendment motion papers as “rants” without so much as a first court meeting or argument, Rocky Popeo joined his predecessors in denying me parent-child contact since my 2013 testimony before the Moreland Commission on Public Corruption. He did so without any finding of unfit parenting, criminal charge or child protection report. Meanwhile “rehabilitated” heroin addict moms and life term prisoners were being reunited or allowed contact with their children.

Not mentioned was Popeo’s conversation at a golf and country club during one of my client cases or the unsolicited “rant” he gave me in the presence of a key witness last summer at a local bar. He accused me of some involvement in that censure prosecution. I had no such involvement, no obligation to answer his “rant” anyway, but he was obviously moved by my history of litigation success on behalf of African-American victims in his court, federal court and Utica city government.

That history included former “black” Public Works Commissioner Stephen Patterson and his pastor father who I represented and recovered hundreds of thousands of dollars as a result of law enforcement targeting and wrongful discharge, i.e. Patterson v City of Utica, 370 F.3d 322 (2nd Cir. 2004). Judge Popeo was obviously making a connection between my civil rights advocacy to the racial slurs which nearly caused him his judgeship.

In another case, Mr. Patterson, who had never seen a jail cell, was imprisoned by Judge Balboa in 2010 for non-appearance on a series of nuisance and city ordinance violations. I was not able to represent him then due to the ethics witch hunt already in place, so Steve got front page news after attempting suicide upon discovering that a belt had been placed in his cell while dazed and asleep.

Ultimately he was found “not guilty” on all charges by a jury, and I won yet another ruling for him in a federal civil rights case later that year for police and city harassment. As hard as it may be to believe, I won it while suspended because the papers were prepared by me beforehand and no qualified substitute lawyer could be found.

Rocky Popeo persisted in his beliefs that I had somehow influenced his public censure. He even inquired whether I had filed a complaint against him regarding his eviction ruling upon my former law office the same year as that censure. The current judge assignment should never been offered or accepted on grounds of revenge and prejudice alone. Such persecution has now required resort to natural laws for my protection. I am no Rambo, but I finish the fights that others start without provocation or genuine lawful authority.

We Found Him! Judge James “Dweeby” Eby of Oswego Family Court

Judge James K. Eby of Oswego Family Court. You’ve got to admit, the cartoon and this guy really do look the same!

By Dr. Leon Koziol

Parenting Rights Institute

If you’re a regular follower of the parenting blog site, Leon Koziol.com, you probably recall seeing that cartoon judge we’ve posted from time to time, the one yelling down at some mom or dad, barking out orders on how we should raise our children. Some of you may have thought we were referring to my pedophile custody judge, Bryan Hedges, 20 NY3d 677.

Or maybe you thought it was federal judge, Gary “Not-So” Sharpe of New York’s Northern District who announced a gene for making judicial decisions, one that would not be discovered by scientists for “another fifty years,” United States v Cossey, 632 F.3d 82. His bizarre concoction earned him a removal order from a higher court. These characters have all been exposed in my recent full page ad series during a family judge election.

No, it turns out we finally found this guy. He is a family judge in Oswego, New York named James “Dweeby” Eby. The nickname connotes his spineless nature in line with his chief judge in Syracuse, James “Bond” Tormey who was successfully sued for $600,000 by his chief family court clerk for improperly directing her to conduct “political espionage,” Morin v Tormey, 626 F.3d 40.

Yeah, hard as these cases are to believe, you learn about them here. We don’t make things up at www.leonkoziol.com. It led me to offer an early release version of my book, Satan’s Docket, a real world look at the corruption which is growing in our nation’s divorce and family courts. You can get a copy at www.parentingrightsinstitute.com along with other valuable fee saving services.

We also use the term “dweeby” because it assists in the pronunciation of the last name. Dweeby Eby is the 37th judge assigned to my 12 year originally uncontested divorce after so many predecessors were removed for bias, corruption or other reasons. He simply took up where disqualified judge “Kangaroo” King left off by continuing to harass me using my daughters in retaliation for my judicial whistleblowing activities. I have been kept out of their lives for over 1,500 days, nearly four years!

I have never been found to be unfit as a parent, no report has ever been made, let alone investigated by child protection agents, and I have never been accused of any crime or alcohol related incident. All offense petitions including King’s gag order were thrown out after I sued him in New York Supreme Court. Meanwhile heroin addicts were being reunited with their offspring.

The “dweeb” was not about to clean up the mess. He was simply going to show “who’s boss” by continuing with this judicial retaliation agenda. So evil was he, instead of conducting a teleconference like his predecessor judges, he forced the parties to make a 180 mile round trip to a family courthouse at Lake Ontario for arguments on a decision he had already completed. Pure harassment! And you taxpayers paid for the judge-appointed child attorney, William “F. Lee Billy” Koslosky.

In my book, I detail how Eby had it in his mind to finish me off once and for all. Here is the relevant closing paragraph of my last Chapter 22 titled “King Eby” in Satan’s Docket:

Although my girls live only a few miles away, I will continue to be denied interactions with them due to these sick conditions. We are entitled to genuine family relationships under our human rights laws. Recalling the way King Eby stared me down on that dreary morning in Syracuse, I could only imagine what he wanted to say regarding my crusade for justice. He reminded me of Emperor Commodus in that movie staring down the Gladiator after so many thugs were slain in defiance of tyranny at the Roman Coliseum. This petty tyrant in a robe probably wanted to say:

“What am I to do with you? You just won’t die!”

Judicial Whistleblowers Entitled to Protection and Compensation

img_0939
After being nearly run over by a black Cadillac in front of witnesses a few weeks back at a local Irish pub (Celtic Harp), you might say I need a pair of bodyguards. Pictured here is former Super Bowl winner for the Denver Broncos, Jamie Brown.  A victim of blunt head injury, I have been asked to look into the cover-ups while a major lawsuit is nearing settlement. Pictured also is Mike Paladino who joined me for the Whistleblower Summit and Civil Rights Conference in Washington.  FYI: I am standing 5 foot 11 inches and weighing in at a “mere” 200 lbs.

By Dr. Leon R. Koziol

Having just returned from a whistleblowers summit and conference in Washington D.C., I had the privilege of meeting numerous victims of government abuse. Of all that were featured, few exceeded my ordeal. Indeed, because I heard about the summit at the last minute, the sponsors could not get me on the speakers agenda which had already been formalized. However I was allowed to present my case followed by an interview with Summit sponsors for future publication.

My focus was different than most presenters who decried retributions by federal and state agencies (executive branch of government). I was determined to obtain protection for that unique category of citizens known as judicial whistleblowers. These are the ones who expose corruption in the judicial branch, the forums created by the people to bring justice for all the other whistleblowers. At present, there is no real protection for us as my ordeal has abundantly demonstrated.

From my pedophile custody judge removed from family court (Bryan Hedges) to divorce judges soliciting bribes to fix custody cases (Gerald Garson and Thomas Spargo), we have a growing crisis on our hands. These are judges taken down only because of courageous whistleblowers. One was a father-attorney in divorce. Another was a mom who lost custody of her child. How many more have never been caught? Without judicial whistleblowers, the other types may never see justice even with the federal Whistleblower Protection Act now in effect.

For this reason, Judicial whistleblowers need legal protection and monetary compensation for the risks and injuries they endure. After exposing widespread corruption among wealthy Americans dodging tax liabilities in Swiss banks, whistleblower Bradley Birkenfeld was wrongly prosecuted by the IRS and sent to prison for a thirty month term. Ultimately he recovered $102 million as part of a new IRS whistleblower protection program.

His ordeal has striking similarities to mine, wrongfully prosecuted by unethical ethics lawyers who were ultimately allowed to resign for falsifying their time sheets (Albany chief counsel Peter Torncello, Steven Zayas and Elizabeth Devane). My children, licenses and livelihood were all seized in retaliation for the widespread corruption I have been exposing to no avail before a self-regulating profession and court system. Less than 10% of all commission complaints in New York and California are even looked into.

This autumn, my book, Satan’s Docket, will be published. It exposes my shocking ordeal while serving as an instruction manual for all parents affected by our nation’s divorce and family courts. Unsure whether the title was a good one, all doubt was removed this past week in Washington with the presentation and release of Birkenfeld’s book titled, Lucifer’s Bank.

In an effort to pave the way for judicial whistleblower protection in New York, I presented a 25-page, $25 million claim before the New York Legislature. After personal visits to legislative offices, I finally got a call from legislative counsel for the Assembly Judiciary Committee (Weinstein). The uphill battle I faced was mutually detailed.

I have yet to receive replies of any kind from my former Assembly representative, Claudia Tenney, campaigning for Congress at the time, my Senate representative, Joseph Griffo, who declared me his friend time and again, or Anthony Brindisi, Assembly representative in the district where my law practice was shut down. All this occurred within the span of a few years after 23 unblemished years as a successful civil rights attorney and ten years as a model parent without even a complaint before any child protection agency.

Please share this post for the general benefit of all Americans. As U.S. Senate Judiciary Chairman Chuck Grassley stated at a recent Whistleblower Day celebration, “You can’t fix something if you don’t know it’s broken. That’s just common sense.” But it’s much more than that for judicial whistleblowers: “You can’t get justice if corruption is being concealed by those who are supposed to deliver it.

After Walter Scott and Dallas Shootings, Family Court Corruption is Reaching Another Boiling Point

image
Dr.Leon Koziol attending a family human rights conference at the United Nations in May, 2016 where he delivered a report which predicted escalating levels of suicide and violence as a result of family court corruption and state take-over of fundamental parental rights.

Dallas Police Chief David Brown may have said it best when describing the state of affairs among law enforcement in this country. After the targeting and murders of five Dallas police officers last week, he declared that we’re expecting too much from cops these days.

As examples he cited unleashed dogs, policing social injustices and preventing crime in neighborhoods where 70% of the families are raised by single mothers. He emphasized that First Amendment requires media to fairly report the underlying causes of our present crises.

Welcome to Leon Koziol.com, a component of secondary media attempting with little success to expose those same causes. In two reports to U.S. Attorney Loretta Lynch, Dr. Leon Koziol, civil rights advocate, explained how corruption was being suppressed in divorce and family courts across America to feed a trillion dollar industry. A generic reply many months later referenced only a “letter” with no indication that anything had been reviewed.

See Dr. Koziol’s blog post and most recent report to U.S. Attorney Loretta Lynch dated June 14, 2015 that was ignored by her office – (Click Here)

The June 12, 2015 report predicting an overload of the system leading to senseless attacks upon law enforcement personnel can be downloaded from Scribd (Click Here)

In those reports, Dr. Koziol also predicted that family court victims were reaching a boiling point. It was based, in part, on an unarmed father, Walter Scott, who was shot dead in the back on April 4, 2015 not simply because he was African-American but because he was fleeing a child support warrant. Both white and black traffic cops were charged. Already all is forgotten.

The whole incident with a $3 million city settlement could have been avoided if the laws were geared to equal parenting. Instead Lawyer  greed and lucrative conflict caused by an antiquated custody system remain the “law” in conflict with natural rights of parents. One parent households are the product of this one parent (custody)  system.

If you are a regular follower of this site, you know how the domestic and disciplinary courts of New York have exploited Leon’s children and law license to suppress the First Amendment. A gag order on this site was set aside recently after a mandamus show cause order was signed in New York Supreme Court against Family Judge Daniel King. The offender then disqualified himself after all the damage was done.

Enter replacement Judge James Eby, newly seated in Oswego Family Court, who merely took over where Dan King left off, continuing a shocking level of systemic bias for all of the filings and reform efforts here over a ten year period. His decision of July 12, 2016 was already written prior to argument which he mandated to occur that day in capital letters by PERSONAL APPEARANCES.

This was all good for child lawyer William Koslosky who simply billed the taxpayers for his undeserved fees. But it required the parents to make four hour round trips to attend already decided proceedings instead of teleconferences utilized by closer judges in the past. Obviously this was pure retaliation for the successful removal of fellow Judge King and his gag order. Judge Eby previously denied Fathers Day to Dr. Koziol and was visibly angered that it was procured anyway without his permission and without incident.

In his edict, Eby overlooked a prior removal of incompetent child lawyer William Koslosky and never even mentioned a disqualification motion or its compelling grounds for his own removal. This is how they avoid accountability on the record while abusing judicial office to suppress exposure of gross misconduct. Yes folks, once again you can’t make this stuff up.

Dr. Koziol has never been charged with  unfit parenting or any crime unlike others who receive unrestricted parenting time. Judge Eby simply orchestrated an outcome which will leave his public critic forever without any child contact, all because a gold digging mother, Kelly Hawse-Koziol, decided to replace the real father with an unfit, childless millionaire named Joseph Flihan. She committed perjury and fraud in the process, i.e. her testimony that e-mail notice of child relocation was successful with “gmai.com” (“l” character missing).

The corruption here is out of control and it requires elevated public response. The injustices will not be swept away but incur greater exposure and consequences instead. Such corruption has been ratified through inaction of our federal courts and state judicial commissions. When the corruption gets this bad, victims take matters into their own hands. Welcome Dallas Police Chief to our justice system on yet another neglected front.

Had Enough Corruption? Join Protest at Lincoln Memorial on 9/17

Let’s finally do something about government corruption on Constitution Day. They’re not paying any attention to your keyboards at home.

By Dr. Leon R. Koziol

Haven’t we all had enough of government corruption. Not a day goes by without another public official taking bribes, abusing office or getting a free pass to commit crimes. From the top down, across genders and all branches of government, corruption in America has gotten out of control. If we are truly a self governing nation, it’s high time we took it back with a march from Lincoln Memorial to the White House on September 17th.

If you think it’s going to correct itself or maybe you think someone else will organize and protest in your place, think again. That ain’t happening. You need to get seriously involved today. It’s your government too. Freedom is not free. We have inherited a duty from our founders for the sake of future generations.

We all know how our country was founded, but is there something from the Spirit of ’76 which tugs upon us today? Have the modern day trappings of electronic devices, moral depravity and self-love eclipsed the patriotism that defines America? Are we on a collision course with a new world order destined to erode our rights to extinction?

Look no further than divorce and family courts. The rights of parents are being tortured beyond recognition for profit. Parallels to the Revolution should send chills down the spine of any conscientious lawyer truly committed to a professional oath. In plain terms, these courts have assumed monarchial authority  over our children through “equity” powers carried over from feudal England, see i.e. Finlay v Finlay, 148 NE 624 (1925).

That power has expanded over time to a point where “constitution-free” zones have been erected among local tribunals fueled by a revenue generating scheme known as Title IV-D funding (family conflict incentivized by federal money from Social Security). It is a judge created “equity” power eroding a full range of rights protected by our Constitution. In so many respects, these tribunals have become more powerful than the NSA, IRS and CIA.

The reason, of course, is money. Make mom and dad fight over an archaic “custody” award and you can swallow up life savings and college funds to benefit a giant trough surrounded by lawyers, evaluators and family “experts.” They include my custody judge, Bryan Hedges. I had him disqualified over lawyer claims of a reputation beyond reproach until he was ousted altogether for admitting to sexual abuse upon his handicapped five year old niece.

The parenting right traces itself well beyond the birth of our nation, indeed to the beginning of civilization itself. Governments have come and gone but families and parent-child relationships are the reasons we got here. It is that “bundle of rights” so fundamental to humanity that our founders saw no reason to put it in the Constitution. The Supreme Court declared it as our “oldest (protected) liberty interest,” Troxel v Granville, 530 US 57 (2000).

This all-inclusive right is now under assault. Bureaucrats are devising all sorts of fictional “wars” to raise taxes, i.e. a war on half the human population with the VAWA Act. This is a modern day equivalent of the Stamp Act invented to pay for British troops in the colonies. A war among parents pays for a glut of lawyers, over 600,000 in New York and California alone. And if you can exploit children (like Hitler directed in Mein Kampf), the people will “happily” surrender their rights. Welcome to the war machine known as family court.

All efforts to organize parents to this reality have failed miserably. The reasons are as diverse as the conflicts inflamed by lawyers. If you’re a conscientious reformist like me, they will exploit judicial office to discredit your name and message, seizing your livelihood, home, assets, reputation and even your children to preserve this gold mine. It has left the parental rights movement devoid of qualified leaders and meaningful support.

Out of law school, I was able to get a restraining order on a $30 million school project, later a judgment in New York Supreme Court declaring a billion dollar casino unconstitutional, and six figure recoveries for victimized women and minorities. Today I cannot get a phone call to my girls enforced by more than 35 trial judges assigned to my originally uncontested divorce case, an atrocity unprecedented in modern judicial history.

For over ten years I have studied this phenomenon, pursued proper channels to a point of incurring anti-filing orders, and assisted court victims in nearly all fifty states. I even completed a book for a mom in Hawaii who was severely alienated from her offspring and hounded as a fugitive for “child support.” Reform has been suppressed and censored as it was in colonial America because parents have been intimidated, stripped of their dignity and reduced to a pathetic state of despair, excuses and outright laziness.

I call it the “Foxhole Syndrome,” parents anxious to tell their war stories without real concern for the greater reform movement. I have been contacted from across the country and remain unable to extricate dialogue from these foxholes, sometimes over a period of hours without donations in my suppressed state. Indeed the reform terrain resembles the movie “Terminator” with “Devil’s Advocate” as its theme. Parents are underground on the comfort of their keyboards “raising awareness” to no one who cares.

Like our Revolution, this terrain is infiltrated by traitors, spies, cowards and plain idiots which distract us from the real enemy. A key example is this CAPRA class action which should stand for Con Artist Promoting Ridiculous Action. It was concocted by a non-lawyer out of jail who managed to convince thousands of victims to join “for free.” Well a brain surgery is also free with a GED volunteer from ISIS. Fancy letters, a lawsuit face page without a person or corporate identity, and a link to an on-line dollar store should have “raised awareness” to a paper Titanic with “all hands on dork.”

This is not to say that its sponsor is without utility, but if that talent could be directed to a real battlefield, we could change America as they did 200 years ago. That’s why I have proposed an anti-corruption rally at the Lincoln Memorial on Constitution Day, September 17th (a Saturday). This is where civil rights has a reform history. Due to past rallies devoid of participation, I have had to seek out prominent people and organized groups.

The Rev. Al Sharpton & Leon Koziol, J.D.

This sick system extends to school programs, it is a core reason for escalating violence, the decline of all religions and immorality, and it must be dismantled and rebuilt as our nation was. Discrimination, alienation, financial exploitation and state child abuse are all forms of corruption subject to protest. So contact your neighbors, get the signs ready, and let’s show that we’ve had enough. It’s not a problem if they don’t see it, and no one sees a foxhole.

Judicial Conduct Commission Renamed Kangaroo Corruption Commission

Administrator’s Note: Four professionals, a doctor, lawyer, dentist and engineer, from around the country converged on the steps of the Supreme Court to announce the filing of a writ against family court corruption, see Leon Koziol v United States District Court for the NDNY, Supreme Court Docket No. 15-1519 (June 17, 2016). Three days later, a New York Commission issued a letter excusing the misconduct of one of its subjects, Family Judge Daniel King. This is the same judge who fabricated and ratified a Masters Degree and PhD which Leon never received to elevate child support in retaliation for his complaints to that same Commission. No misconduct said the Commission. Seriously?

By Dr. Leon Koziol, J.D.

It’s been awhile since Supreme Court Justice Abe Fortas depicted family courts in America as “Kangaroo” operations, see In re Gault, 387 US 1, 27-28. But Abe never came across New York’s Commission on Judicial Conduct. Now that’s a kangaroo commission if there ever was one. Its members are appointed by corrupt politicians such as Sheldon Silver (now in federal prison), Dean Skelos (convicted of federal crimes) and Andy Cuomo (currently under federal investigation). Governor Andrew Cuomo  prematurely dissolved his own corruption commission when testimony (i.e. me) began implicating the politicians who created it.

Another entity, the Joint Commission on Public Ethics, was created by the same trio of politicians in 2011 as part of a “Clean-Up Albany Act.” By 2015, state legislators were decrying it as “J-Joke” for its impotence. The chair of that Commission was recently named Chief Justice of New York’s high court by the same Governor Andy Cuomo who created both commissions. That should have all people visiting or doing business here very concerned.

Yeah there are so many taxpayer financed commissions these days that the public cannot figure them all out. Hell they all sound good, but what are they accomplishing? The third one (featured here) has kicked legitimate complaints against judges to the curb faster than its kangaroo sister commission in California (reported to have rejected more than 90% filed). It’s a nationwide epidemic calling upon the citizenry to make a stand. A rally has been set for September 17, 2016 at Lincoln Memorial in Washington D.C.  Be there !

As a result, this Judicial Conduct Commission has been renamed the Kangaroo Corruption Commission (KCC) by victimized litigants to accurately  describe the entity’s true character. Okay it’s not official yet, but we commoners who pay taxes and put up with their circus show like to be graphic with what’s really going on. We’re not so easily duped into believing that a catchy title with elite law firm members verify a genuine commitment to public service. They’re the foxes watching the chicken coup. So we call it as we see it.

Today I received yet another letter from “Jean M. Savanyu” clerk of the Commission advising me once again that Lewis County Family Judge Daniel King (“Dan King” as he introduced himself to my family court opponent on the phone) is just a-okay. Now for our 6,000 followers, you all know this can’t be right. Dan King has committed so much misconduct that anyone coming into “his” court should bring along a recorder (since he caused one of my secret custody proceedings to be unrecorded so his misconduct could be concealed).

Appealing such clear misconduct is equally impotent. In my case, the “honorable” Nancy Smith of the Fourth Department denied recourse against King when he issued a support violation order impossible to comply with because it required support payments to an agency without legal authority to accept it. Dan King was simply abusing judicial office in retaliation for my (accurate) public criticisms of his incompetence (see listing below). Nancy is the only judge above trial level ever to be slapped on the wrist by the KCC for giving a glowing reference to a person she never met for personal and political gain as a judge. Does anyone seriously think she could be impartial here?

Hey, as stated time and again, we don’t make this stuff up at Leon Koziol.com. Check it all out on the internet. And while you’re at it, look up ex-New York Chief Judge Sol Wachtler, convicted of federal crimes and sent to prison without so much as a footnote from the KCC. So what are you going to do about it? Are you “a-okay” with this sort of government? Are you happy when lawyers get you fighting in family court only to grab everything you worked for in life? Is this how we reward those who put their lives on the line in the military, 9-11 and Orlando? Are you a scared American hiding behind a government monitored keyboard?

Now for the shocker in our so-called justice system: here is the list of incompetence raised before the KCC which it again found was “a-okay.” They kept open the possibility that a real oversight commission or high court might find otherwise just to protect their statures, i.e. “not enough evidence for an investigation.” If the victims of judge misconduct are supposed to do their investigations, what do we need them for, a bully group picking on all the non-lawyer town justices? (check out their so-called accomplishments).

Dan King’s incompetence was re-stated in a petition for writ filed with the United States Supreme Court on June 17, 2016. Social media caused our news conference on the courthouse steps to go viral the next day  (Zuckerberg and company may have taken a weekend break from their select monitoring). The KCC finding of Dan King’s “a-okay” status as a family judge was dated June 20, 2016 on a series of complaints going back years. Coincidence?  You decide:

1) A competent jurist does not issue or ratify a PhD and Masters degree for purposes of maliciously elevating his public critic’s child support for incarceration purposes;

2)  A competent jurist does not insulate the foregoing misconduct from appeal and accountability by coercing a willful support violation under threat of imprisonment;

3)  A competent jurist does not participate in the concealment of his critic’s daughters at a millionaire’s home on his own family court record through delays and rationalization.

4)  A competent jurist does not accept the clear fraud and perjury of his critic’s opposing parent who testified under oath at a January, 2016 hearing that her required notice of residential change was confirmed under electronic address “gmai.com.” This would be akin to testimony of a letter successfully mailed from a trash can outside the post office.

5)  A competent jurist does not issue defamatory forensic orders for the purpose of discrediting the public message and character of his critic without competent support of any kind, only the perjuries of a scorned litigant having no timely personal knowledge;

6)  A competent jurist does not refuse to correct his own appalling errors by motion of the court, he does not retain college degrees as the “law of the case” while imposing an arrest warrant and maximum jail term of six months on a fraudulently supported debt;

7)  A competent jurist does not threaten his critic with removal from a public courthouse at the opening of a custody hearing based on five objections (two that were granted) to narrative and unrepresented testimony of a perjuring and infinitely scorned parenting opponent to create a record that would justify his prior forensic weapons of suppression.

8)  A competent jurist would not violate a stay order by an Appellate Justice by issuing orders suspending his critic’s parenting time ten days later on Christmas Eve 2013, thereby placing that critic in a condition of arrest by ambush due to conflicting orders;

9)  A competent jurist would not sign every requested show cause order by his critic’s parenting opponent after every ex-parte protection order obtained by her was vacated since 2006 including a trial where the critic was not even required to put in a defense.

10)  A competent jurist does not ignore an ongoing extortionist scheme in every decision to date, to wit: the parenting opponent’s threat to a loving father to give up his children to a millionaire replacement for an end to child support. Her conduct remains criminal;

11)  A competent jurist would not conduct an evidentiary hearing on a first appearance without notice, resulting in orders suspending child contact on such grounds as “prohibited alcohol related gestures” when no other “unfit” evidence could be offered.

12)  A competent jurist would not fabricate such an overbroad prohibition that could not be understood, and it was directed to a toast at the wedding of his critic’s niece. When an appeal was taken, it was later learned that this hearing had allegedly not been recorded;

13)  A competent jurist does not retain an order of arrest and confinement of his public critic for inflated support obligations after proof by the critic’s lawyer showed that it was impossible to comply, to wit: certified funds at full purge amount, albeit in violation of a 2010 superior court order, to be paid to an agency without legal authority to accept it;

14)  A competent jurist does not retain forensic orders in the wake of perjured “gmai.com” proof from the only witness supporting those orders strictly to continue a sadistic campaign of punishment against his public critic.

15)  A competent jurist does not retain forensic orders on double standards. Judge King frequents a tavern in Lowville, New York with his own children while enjoying cocktails that a barmaid has committed to memory. He has exhibited all sorts of absurd behavior.

16)  A competent jurist does not ignore every plea for simple phone contact by a father to his daughters over an 833 day period with sadistic satisfaction while an unfit millionaire substitute continues to cement a bond which has them exhibiting abnormal father hatred.

17)  A competent jurist does not issue serial rulings laced with sadistic disparagements of his critic to avenge accurate disclosures even in the wake of former veteran family judge and current Appellate Division Judge John Centra who emphasized that the real father had no record to support suspended child contact when issuing his 2013 stay order.

The members of the Kangaroo Corruption Commission (KCC) a/k/a New York State Commission on Judicial Conduct are as follows:

Joseph W. Belluck, chair (appointed by Cuomo)

Paul Harding, vice chair (appointed by Assembly Minority Leader Brian M. Kolb)

Rolando T. Acosta (appointed by former chief judge, also appointed by Cuomo)

Sylvia G. Ash (appointed by current Chief Judge Janet DeFiore, also appointed by Cuomo)

Joel Cohen (appointed by ex-Assembly Leader Sheldon Silver now in federal prison)

Jodie Corngold (appointed by Cuomo)

Richard D. Emery (appointed by Senate Minority Leader Andrea Stewart Cousins)

Thomas A. Klonick (former useless Commission chair appointed by former chief judge)

Richard A. Stoloff (appointed by ex-Senate leader recently convicted of federal crimes)

David A. Weinstein (appointed by Cuomo, related to Assembly Judiciary Committee Chair?)

Vacant   (politician Cuomo will name an “independent” person to this vacancy)

As I testified before the Moreland Commission on Public Corruption, this is a “window dressing” commission which should be dissolved like the others because it does more harm than good through its impotence, political influences and ultimate protection of corrupt judges. Such impotence causes victims of severe injustices to forego the filing of useless complaints, making the actual corruption far greater than the record truly shows. Within four months of my testimony on September 17, 2013, my daughters were seized by Dan King who finally disqualified himself this month after the colossal mess he made.

RIP Morley Safer of CBS 60 Minutes: Interviewed Leon Koziol at his Law Office

image
Dr. Leon Koziol interviewed by CBS 60 Minutes co-host Morley Safer in Leon’s law office in Utica, New York. Mr. Safer passed away today.

He was an icon of American media, a whistle blower extraordinaire, a reporter and anchor for CBS 60 Minutes. He passed away today after a phenomenal career that spanned decades. When he spoke everyone listened. You easily became glued to your television sets on Sunday nights when Morley was telling a story. He did  it with conviction, class and professionalism, not with political motivation or self service.

And so it was when he interviewed Dr. Leon Koziol at his law office years ago on the subject of Indian land claims and illegal gaming compacts. When an Indian tribe sued innocent  landowners for their business and homes in violation of ancient treaties, Leon was hired when few other lawyers were willing to risk their careers. Leon counter-sued on behalf of a citizens group challenging an illegal gaming contact which federal, state and local leaders claimed could not be won.

Well persistence paid off. Despite all the attacks from media, judges and high profile law firms over a period of years, Leon ultimately won for the landowners. A billion dollar casino compact was declared unconstitutional in New York Supreme Court. Years later the land claim was also struck down. One of Leon’s successful rulings can be found at Oneida Nation v County of Oneida, 132 F. Support. 2d 71 (NDNY 2000).

Now Leon Koziol is seeking to declare divorce and family laws which discriminate against fathers unconstitutional. He is also seeking recourse for court corruption and parental alienation. New York Supreme Court recently signed an order against a family  judge, Daniel King, to answer Leon’s mandamus and declaratory action regarding a gag order on this website, Leon Koziol.com. The lawsuit features unprecedented retaliations involving Leon’s children for his testimony before the Moreland Commission on Public Corruption.

It was set for a public hearing on June 10, 2016. However, today, at the request of defense counsel it was rescheduled for June 22 at 1:30 pm at the Supreme Court in Utica, New York. As a result the rally set for the earlier date had to be rescheduled for the later day, giving us more time to organize. Get involved, spread the word and join us. We can be reached at our office, Parenting Rights Institute, at (315) 380-3420 or Leon direct at (315) 796-4000.

If $300 could save you thousands in lawyer fees, would you spend it?

Needless divorce and family conflict are ruining America. Self-representation, education and mediation are vital options.

By Dr. Leon R. Koziol

Most people view judges as honorable office holders committed to justice, equality and all that other good stuff we read about in civics class, as it should be. But behind the robes, in the recesses of chambers and among discreet exchanges in restaurants, bars and golf courses across America, there is often quite another set of characteristics at play.

Bias, coercion, deal-making and outright crimes are taking place which violate all manner of ethics. And in our nation’s domestic relations courts, such corruption is taken to the next level under a pretext of family confidentiality, thereby concealing the misconduct and protecting a trillion dollar industry built on needless conflict.

A chaotic process has resulted, one that a Supreme Court Justice once described as a “Kangaroo” operation, In re Gault, 387 US 1, 28. The victims are left with no real remedy because judges have legislated for themselves a rule of absolute immunity unlike the rest of us when we violate the law or public trust. The people have never consented to this rule.

Accountability is thereby undermined. Judicial commissions remain political or overwhelmed so that vast numbers of legitimate complaints are simply tossed to the curb. This is the way a self-regulated branch of government retains false esteem. If a judge renders an edict, it is considered sacrosanct. The loser must have done something wrong.

But think again. New York’s ex-Chief Justice Sol Wachtler was imprisoned for federal crimes during the nineties. He was charged with stalking, extortion and other sick conduct involving the child of his mistress. He even directed court staff to harm the license of the lawyer assisting her in tracking down the perpetrator, Wachtler himself.

In his book, After the Madness, Sol Wachtler explains that judges are made to believe that they are gods. Such deep rooted convictions do not disappear. Judges have been impeached by Congress for lesser things such as an abuse of contempt powers and non-criminal behavior. But that is a rare and sometimes politically motivated event. (See Video – New York Honors High Court Criminal)

The problem becomes epidemic when such corruption finds its way into divorce and family courts. In the infamous “kids for cash” scandal, two Pennsylvania judges were convicted of bribery charges after committing minors to detention centers built by contractors for kickbacks. It resulted in 4,000 reversed convictions and wrongful incarceration of American youth.

Other examples include New York Supreme Court Judge Gerald Garson, convicted of bribery and corruption of judicial office. He was caught on camera accepting a $9,000 bribe from a divorce lawyer in chambers to fix a custody case. Had the mother not sought out the FBI, she would have lost her children for something less than most contested divorce retainers.

A concerned parent must now wonder how many such bribes are never discovered across the states. You would think a criminal conviction would lead to corrective behavior. But in shameless fashion, Judge Garson served less than minimum time due, in part, to the many references from his colleagues. How was any precedent or example made? Here’s what the New York Times had to say about it:

“It was news that confirmed every sneaking suspicion, every paranoid fantasy of anyone who had ever felt wronged in a divorce court.”

One colleague, Thomas Spargo, was convicted for soliciting a $10,000 bribe from a lawyer facing a personal divorce. The money was needed for legal fees to defend ethics charges. Does it get any sicker, bribing money from lawyers and litigants to get a judge out of an ethics prosecution?

Kathleen Kane, Pennsylvania’s Attorney General, was prosecuted for a grand jury leak and suspended from practice prior to her trial by the state’s Supreme Court. Two of its members have resigned due to a selacious scandal in the highest chambers of a state court (exposed by Ms. Kane).

Then there’s the Michigan Judge Wade McCree whose case defied all manner of ethics. He admitted to adulterous sex in chambers with a litigant mother while presiding over her case. He was removed from the bench for all sorts of misconduct only after the affair (with pregnancy) was confirmed. The father, placed on a tether for support arrears during this affair was denied recovery by a federal appeals court in 2014 on grounds of judge immunity.

While the list goes on, it begs the question: how can you trust our current system? How can you not be concerned when another custody judge was removed from the bench for admitting to sexual misconduct on his five year old handicapped niece (my own custody judge), see In re Bryan Hedges, 2013 NY Slip Op 02773. This judge held numerous child sessions in chambers without the parents allowed in.

In Morin v Tormey, 620 F. Supp.2d 353 (NDNY, 2009), the same judge and his chief judge were made liable for “political espionage” against a handicapped judge. Because the victim was a court clerk, judge immunity did not apply. Is it such a reach to conclude that the same administrative judge is conducting “political espionage” on litigants he favors or dislikes?

So why are we excluded from such a lawsuit? Ominously the incidents are growing. At its core, the public has been fed an overdose of propaganda behind a custody award for countless disputes involving children. Shared parenting is being crushed in nearly every state by bar associations which have cultivated this gold mine.

The establishment’s preferred framework is not so complicated despite chapter and verse. Custody is awarded to the parent who can best destroy the other in a barbaric contest reminiscent of the Roman Coliseum. Aligned family spectators cheer or cry, and the government band plays on while suicides become commonplace.

When you stop to think, it really is a barbaric process for a nation which styles itself as a civilized one. The collective challenges to our schools, communities and law enforcement are mind-boggling. The public has been duped into believing that custody wars are normal. And judges blame the parents in the end after all the lawyers are paid.

Politicians will condemn needless medical procedures that tax our health care systems. They attack an over-medicated population with costly programs even though government is its biggest drug supplier. Yet they turn a blind eye to these barbaric courts. Why are they being so protected despite overwhelming evidence of their devastation to the people served?

So do yourself a favor. Invest $300 in an education program offered by the Parenting Rights Institute. Comprised of a lecture by a family law expert and a six part reading program, it provides standard court forms and sample material for self representation and controlling lawyer fees. Referrals can also be obtained along with vital information with this program.

Stay out of divorce and family court whenever possible. Explore options such as mediation and cooperation. You never know if a Gerald Garson might be assigned to your divorce case or a Bryan Hedges to interview your children in family court chambers. Look up the program at www.parentingrightsinstitute.com or call the office at (315) 380-3420
