The Legacy of Susan B. Anthony merits consideration in a Supreme Court overhaul

President Joe Biden’s new commission to study an overhaul of our Supreme Court met for the first time today, April 16, 2021. According to a New York Times story by Charlie Savage, that commission will now explore changes well beyond an increase in the number of justices proposed by a group of lawmakers yesterday. This is a positive development given the political motivations behind the expansion plan which has already crashed and burned.

That does not mean the idea of an expanded high court should be dismissed altogether. As I urged in yesterday’s post, it simply means that any such proposal should be based on merit, one that places the interests of aggrieved citizens over the categorical ideologies of the current nine-member bench. Leaders on both sides of the aisle wisely recognize that the Supreme Court must not be transformed into a political institution, however implausible that may be.

To that end, the legacy of Susan B. Anthony may be instructive. This famous leader of the women’s rights movement was arrested in Rochester, New York for the crime of voting in the 1872 elections. She asserted the newly adopted Fourteenth Amendment as her justification. Her criminal case went to trial the following year before a presiding justice of the Supreme Court named Ward Hunt. He was born in Utica, New York, my home town, during its heyday as a thriving industrial hub. After serving as its mayor, he was appointed chief judge of New York’s high court before being nominated to the Supreme Court by President Ulysses S. Grant.

At the time, justices of the Supreme Court presided in both trial and appellate capacities among various federal circuits. So bizarre was this practice that when I first learned of it in the Anthony case, I immediately believed that she was tried before a justice of the state supreme court which, unlike all other states, is the trial level court in New York. Ward Hunt deliberated in a way that might shock today’s conscience, but then again, startling parallels can be made to modern day courts when I revisit my ordeal shortly as a persecuted civil rights attorney, aggrieved parent and judicial whistleblower.

Judge Hunt essentially conducted a star chamber trial. He used Anthony’s unsworn statements at the arrest scene as testimony against her while refusing to let her take the stand, directed the jury to find against her, and even issued a guilty opinion prepared prior to opening statements. He ordered her to pay a fine of $100 which she refused and then failed to incarcerate her as a consequence so that no appeal could be taken to the full Supreme Court. Such egregious deprivations of due process were not rectified until 1895 in the case of Sparf v United States which prohibited judge verdicts in place of the jury in criminal cases.

The effective merger of trial and appellate courts did not end until the circuit courts of appeals were created by act of Congress in 1891. There are currently 13 circuits with justices ranging in number from the First Circuit in Boston with six to the Ninth Circuit in California with twenty-nine. They all operate with 3-judge panels that decide most appeals and full court, or en banc review, for high profile matters. A loser in a panel appeal can petition for full court review, but it is rarely granted (much like the petitions denied by the Supreme Court). This two-tier process of appellate review assures that all properly filed appeals will be heard.

The current proposal to expand the Supreme Court from nine to thirteen is merely an increase in number, a bureaucratic exercise bent on avenging President Donald Trump’s conservative appointments. It does not assure that more cases will be heard and may even reduce the high court’s capacity when more justices delay outcomes through complex opinions, i.e. unanimous, majority, plurality, concurrent and dissenting. To be truly beneficial for the people served, that proposal should incorporate the two-tiered circuit court structure which has proven effective for many decades. A thirteen member Supreme Court, for example, could feature four three-judge panels with a chief justice focused on administrative duties.

The Susan B. Anthony trial was known for its positive impact on women’s suffrage, but it also helped shape a better court structure for the delivery of justice. So outraged was this defendant by the miscarriage delivered to her that she openly defied the orders of a Supreme Court justice, including a fine that was never paid. We look back today with great admiration for her courageous stand. However when a similar one is taken by reformists and whistleblowers of modern times, retaliation is common with the typical reputation damage that comes with it. By killing the messenger, corruption thrives in all branches of government.

Therefore the Biden Commission must take a hard look at judicial immunity doctrines and compensation of whistleblowers for the wrongs committed against them. My ordeal is exemplary. Like the Susan B. Anthony criminal case, my family court process featured judge verdicts on child custody and support with no jury at all. I was directed to cease making objections by one judge, Daniel King, which compelled me to exit and waive my rights to testify. After his disqualification, replacement Judge James Eby, forced the litigants and their paid attorneys to make a 160 mile round trip from Utica to his Oswego courthouse to receive a decision that had already been completed.

Ironically the appellate courtroom in Rochester named after Susan B. Anthony is the same one where my law license was first suspended for the stand I took against the Ward Hunts of today. Widespread dysfunction, a pandemic and parent alienation have combined to create a perfect storm in our nation’s divorce and family courts.

In a flurry of recent posts, I document the judicial corruption and parental alienation which have remained unchecked in our nation’s divorce and family courts. The coronavirus pandemic has now combined with those dysfunctions to create a perfect storm in today’s society.

With closures, social distancing and home confinements, it has aggravated the alienation of parents from their children particularly in the divorce and separation context. There has not been, and perhaps there never can be, a study which reports on the number of suicides, drug addictions, domestic violence and health impairments caused by this perfect storm. However, a comprehensive review is clearly warranted.

As a civil rights attorney, victimized parent and judicial whistleblower, I have repeatedly called upon our federal government to commence this review through congressional hearings and a Justice Department investigation. It is based on thirty years of experience in these courts. Had this occurred, today’s dire consequences may have been less impactful. Instead I was subjected to severe retaliation with overdue reforms that remain elusive.

Outside observers are easily duped into believing that conflict in these courts are financially and emotionally driven by disgruntled parents. But a closer look leads to a more accurate conclusion that such conflict is typically orchestrated by unscrupulous lawyers, biased judges and a money-driven court system. Service fees and federal Title IV-D funding are key examples.

This website, http://www.leonkoziol.com chronicles more than ten years of persecution endured by me as a result of my stand against this corrupted system. I have witnessed it first hand in a number of relevant capacities and will expose certain trial level jurists who abused public office in my case to retaliate for this public stance. The abuse was pathetically obvious and supportive of my demands for accountability.

In 2009, Syracuse family judge, Martha Walsh-Hood, conducted a four day custody trial that she was unprepared for. The sheer volume of cases may have been one explanation but a predetermined outcome was more likely. For example, she directed me to cease the spontaneous presence of a pen between my fingers during objections because it was intimidating my ex-spouse. There was no complaint from her, nor a similar directive of my opposing female attorney. Coupled with other abuses, it led to a conclusion that this judge was prejudiced against men. The resulting exercise in futility caused me to exit early.

In 2011, after Judge Walsh-Hood stepped down from my ongoing family matters, Judge Michele Pirro-Bailey issued an order granting the ex-spouse my weekend parenting time to accommodate a family event. This was done despite the judge’s admission that she had not reviewed my opposition papers and without even hearing my opposing argument in court. It caused me to exit this hearing early inasmuch as my side of the case was being ignored in violation of due process. After issuing abusive forensic orders in my absence, this judge also stepped down weeks later. The orders were removed by her successor on the same record to show how arbitrary and needless they were.

On January 14, 2014, a judge who replaced the latter (without reason given) conducted yet another custody hearing during which he was caught orchestrating a record to support a second set of punitive forensic orders. Judge Daniel King resurrected them in retaliation for my testimony before the Moreland Commission on Public Corruption four months earlier. There I exposed his fabrication of college degrees to elevate my child support obligations. Specifically he directed me to cease making objections (two of five were already granted) regarding my ex-spouse’s irrelevant, defamatory and hearsay testimony under penalty of being removed from the courthouse. A transcript supports his misconduct. To avoid a “contempt by ambush” I was forced to again exit early.

In 2018, a child support violation hearing was held before more assigned jurists, Natalie Carraway and Gerald Popeo. There I exposed a scheme to double my obligation for contempt incarceration purposes. A social services attorney, free for my ex-spouse, committed malpractice by failing to offer a support summary into evidence at the conclusion of her lone witness testimony. It was admitted anyway over my objections and then reversed when I discovered a $45,500 support amount paid in 2015 which had been omitted from that summary. In this way, an attempted fraud was concealed from the record.

Both Carraway and Popeo later denied me a transcript of that hearing to show not only serious error but also a fraud in the Title IV-D funding program. It caused me to avoid a clear set-up at a confirmation (contempt) hearing conducted by Popeo. This led to an unlawful support warrant, secret bulletin and “shoot on sight” threat from a traffic cop to mirror the 2015 Walter Scott shooting in South Carolina. That transcript has yet to materialize despite recourse sought in both federal and state appellate courts.

In these and other proceedings over the years I was forced to take extreme measures to protect myself. This included an absence from my daughters’ school events with an ex-spouse threatening a contempt petition each time I attempted contact. I had never been found to be an unfit parent or even accused of any abuse, but a jail term without a jury, pretrial discovery or heightened standard of proof, was not an option. With each early exit, these and other assigned jurists were able to use the ex-spouse’s unchecked testimony to issue one-sided orders that made me to appear incompetent as a parent.

Such orchestrations were rampant over my fourteen year ordeal that led to the destruction of my wonderful father-daughter relationships and ultimate harm to my health and professional career. The joint misconduct was well hidden in a voluminous record and presumptively credited due to the high regard typically associated with any person bearing the title of “judge.” In truth, it was a pretext for punishing my First Amendment rights as a whistleblower outside the courtroom.

My daughters cannot be expected to understand the complexities of this misconduct which forced me out of their lives. We had such a wonderful relationship for more than ten years, but all that was erased by a “custodial” mother and court system hell bent on money interests over parental rights. I lost so many opportunities to experience various phases and crucial events in my girls’ lives that can never be recovered. And I was forced to pay for the kidnapping with over a quarter million dollars in tax free child support paid to date despite an income capacity destroyed by draconian support practices.

This is the price paid by an attorney with the qualifications to challenge a corrupt court system. It is a price which allows the system to live on even during a pandemic, thereby harming countless parents, children and families. It is an epidemic protected by powerful interests, one that wreaking havoc upon our society as a whole. Although my sacrifices were many, they were properly directed against this system. Hopefully others will join my crusade so that those sacrifices were not in vain.

Why is Judicial Accountability so crucial to Democracy?

Why is judicial accountability so crucial to democracy? The answer is simply this: too much power vested in a single person invariably leads to corruption. We see this everywhere today. As it is said, tyranny begets anarchy, and when judges fail to honor the rule of law established by the people, the natural consequence is to take the law into one’s own hands. This is the very underpinning of American society and how our country came to be.

However when judicial power is usurped in domestic relations courts, a more serious form of corruption emerges. This is because families and parent-child relationships have long been considered sacred, private matters. Unfortunately, despite a constitution that created a form of government divorced from the mother country, a judge-made doctrine in feudal England managed to evade our Bill of Rights by finding its way into these courts.

That doctrine, known as Parens Patriae, has been relied upon to invade our privacy rights in ways never before imagined in a free society. As an accomplished civil rights attorney who became a victim of this doctrine, I set out to expose the corruption it caused to me and fellow victims. I sought to convert family court from a lawyer-friendly system to a parent-oriented one. Over time it cost me my professional career, father-daughter relationships and ultimately my very health.

When my ex-wife and mother of my children began to see the consequences of my principled stand, she took advantage of the retaliation by filing petitions that received the favor of judges seeking to suppress my First Amendment rights. Indeed in November, 2015, that ex-wife, Kelly Hawse-Koziol, filed yet another family offense petition having an ulterior goal of removing me from my daughters’ lives. Over the years, all her offense petitions were thrown out, but this one featured a gag order disguised as a protection order on this whistleblower website, http://www.leonkoziol.com.

The illicit scheme was profoundly exposed when I obtained a court order in New York Supreme Court challenging it. Despite motions denied over a six month period, the presiding family judge who issued that gag order (Daniel King), cancelled his hearing on the offense petition and vacated (removed) his own gag order. Weeks later, the same Judge King stepped off the case entirely after three years of harm to my father-daughter relationships. He never ceased his retaliation for my 2013 whistleblower testimony before the Moreland Commission on Public Corruption. There I exposed fabricated college degrees used to elevate my child support obligations for incarceration (contempt) purposes.

Throughout this crusade, my daughters and law license were used as ransom to elicit my silence. For her part, rather than honor the sacred interest in a father-daughter relationship, Kelly Hawse-Koziol exploited the clear retaliation by asserting one false accusation after another which I was forced to defend. I did so to an extreme of seeking constitutional protection in federal courts. But by then the fix was in, the record too tarnished, and any basic rights I might have once had were ignored or shamelessly violated. Hawse-Koziol was never held accountable for her perjuries and abusive petitions.

That favoritism was made possible by a judge made doctrine known as judicial immunity. Under that doctrine, judges can actually abuse public office by maliciously targeting a critic. To illustrate its absurdity, Michigan family judge, Wade McCree, was removed from the bench after his adulterous relationship with a litigant was exposed. It featured an adversary father that McCree placed on a child support monitor to appease his paramour. The father sued for civil rights violations in federal court but was denied recourse based on immunity, leading to the bizarre conclusion that sex in chambers with a litigant is now a protected judicial act.

This website, Leon Koziol.com chronicles more than ten years of efforts to reform this system and the retaliation which has yet to earn an Innocence Project outcome. Critical to my ordeal was a willingness of biased jurists, acting without a jury, to ignore perjury in the petitions and hearing testimony of Kelly Hawse-Koziol. Anything that could be used against me quickly found its way into decisions and orders that systematically destroyed proven father-daughter relationships. The judge prejudice was so extreme on one occasion that I was ordered to cease objections to such testimony under penalty of being removed from the courthouse (Family Judge Daniel King, January 14, 2014 transcript).

That willingness to ignore perjury was well demonstrated at a June, 2016 hearing where I was challenging a city marshal who claimed service of a support violation petition upon me at a local restaurant (known as a traverse hearing). After his sworn service document and testimony were introduced by Hawse-Koziol’s lawyer (one of many she retained), I cross examined him on a segment which claimed recitation of veteran status during the service of the petition. Knowing of an upcoming witness of mine in the waiting area, the marshal admitted that he never gave such a recitation. He then admitted that he had lied on the sworn document and in his testimony before the court.

Although the petition was consequently dismissed, no referral for perjury prosecution was made to the Syracuse district attorney. Such lack of accountability became potentially fatal when a scheme was hatched one year later to have an Oneida County deputy sheriff acting in the capacity of court security to serve the next violation petition upon me during a custody hearing. Unlike all other court litigants, Hawse-Koziol was not charged for this service as prescribed by law and the deputy sheriff was acting outside the scope of his security duties. So disruptive was this unlawful act that it caused yet another assigned judge to step down from my case.

More than 40 trial level jurists were assigned to my family matters over a 14 year period, a national record by most accounts. That alone warrants a federal investigation. There was no disciplinary action taken by this deputy’s superior, Oneida County Sheriff Robert Maciol, and no investigation by the state judicial conduct commission or attorney general, proving clearly that the state courts are unable to police themselves. The unlawfully served petition ultimately led to a “shoot on sight” threat from a traffic cop purporting to enforce a violation warrant issued by Utica City Judge Gerald Popeo. He was assigned to replace the one who stepped down and to avenge a public censure of that judge.

The corruption here was so rampant and unchecked that it forced me to take a bold stand against this irreparably infected process. Law enforcement would be well served by looking into such corruption because it puts them needlessly in harm’s way. One of Sheriff Maciol’s deputies was fatally shot during a stand-off with a parent trapped in a garage during a domestic incident. Had the officers who had him surrounded let time and talk take its course, that deputy might still be on duty today.

Throughout my ordeal in this corrupted family court system, I was proven justified time and again. To cite only a few examples, I filed a motion to remove one of my custody judges from my case and to prevent a private meeting with my young daughters in chambers. Opposing lawyers condemned it as an assault on a judge whose reputation was “beyond reproach.” Only months later, that judge, Bryan Hedges, was permanently removed by New York’s high court after Hedges’ public admission to sexual abuse of his handicapped five year old niece.

Judge Hedges’ replacement, Syracuse family judge Michael Hanuszczak, was forced to resign after a state judicial commission had found that he sexually harassed subordinate court staff. Judge Gerald Popeo, as stated, was publicly censured (when he should have been removed) by the same judicial commission for making racist remarks, jailing litigants for such conduct as a “smirk,” and threatening violence from the bench to remedy such indiscretions. The ethics lawyers who also targeted me were allowed to resign after falsifying their time sheets. These removals are all a matter of public record.

While this is only a partial list, it underscores the problem I set out to correct. A mother truly committed to her daughters and a co-parenting environment that was once so promising would counsel them on the righteousness of my cause. Instead she exploited the clear misconduct for selfish gain. My parenting liberties were so monitored that nothing I did was acceptable. Conditions were imposed that were not only contradictory, something I described as a “contempt by ambush,” but they forced me to avoid all contact with my precious girls.

On September 25, 2018, the administrator and counsel for the judicial commission which prosecuted this case published an editorial in the Washington Post featuring Hedges as an example of decades-old misconduct which can be used against sitting judges. It was directed to the nomination of Brett Kavanaugh. But Hedges was never prosecuted criminally unlike Roman Catholic priests. Federal Court to Hear Precedent Case Regarding Parental Alienation, Support Abuses and Whistle Blower Retaliation

On November 15, 2019, at 9 a.m., at the United States Courthouse in Albany, New York, a federal judge is scheduled to hear arguments regarding a precedent-seeking case entitled, Leon Koziol, Individually and as Natural Parent vs State of New York, Child Support Processing Center, Acting Family Judge Gerald Popeo, Support Magistrate Natalie Carraway, Chief Court Clerk Barbara Porta, Support Investigator Katie Lawrence, Custodial Parent Kelly Hawse-Koziol and Oneida County Sheriff Robert Maciol.

This case features inhumane retributions which I sustained as a model parent and attorney who blew the whistle on corruption in our divorce and family courts. That corruption is twofold: first the systemic bias among judges rewarded by the number and size of support orders they issue under a federal funding law known as Title IV-D of the Social Security Act, and second, a particular bias ranging from my pedophile custody judge removed from the bench (Bryan Hedges) to a racist, unethical and abusive judge censured by a judicial commission (Gerald Popeo, a defendant here).

It was filed on August 7, 2019 in New York Supreme Court after I was denied court transcripts and evidentiary subpoenas to show a major fraud during a support violation proceeding. My rights of due process, free speech and equal protection were violated incessantly after federal judges in upstate New York referred my complaints to state court over the years. In a shocking irony, the New York Attorney General (representing the state, judges and court clerk) then moved my case from state court back to federal court on August 29, 2019.

Nearly 40 trial level judges have been disqualified or removed from my originally uncontested divorce. Over a period of 12 years, my livelihood, reputation and parent-child relations were utterly destroyed through such concoctions as a “prohibited alcohol related gesture” (a wedding toast) and fabricated college degrees (PhD and Masters) to elevate my support obligations.

It has set new records for unmitigated corruption. For example, ethics lawyers engaged in the witch hunt against me have opposed my reinstatement to practice as long as I continue to blow the whistle. This has been ongoing for a record 10 years. The same lawyers were then allowed to resign without any criminal or ethics charges after being caught falsifying their time sheets.

As observers across the country have warned time and again, if they can do this to a model parent and unblemished attorney (for more than 23 years), imagine what they could do to the rest of us. A sort of Gestapo atmosphere is growing in our family courts to advance a trillion dollar industry. Anyone courageous or conscientious enough to stand in the way of this gold mine will be squashed, immediately or over time.

The greed and corruption are so rampant that I was subjected to a “shoot on site” threat arising from an unlawful support warrant one year ago. That warrant was issued by Defendant Judge Gerald Popeo who accepted an assignment to my support case six months after complaining of my supposed participation in a “witch hunt” that led to his  public censure by a judicial commission. This is a watershed case seeking to declare excessive enforcement practices unconstitutional, to establish parental alienation as a constitutional violation, and to secure legal protection for judicial whistle blowers. Bradley Birkenfeld recovered $104 million in an IRS whistle blower case after serving a 30 month prison term in retaliation for his exposure of a Swiss Bank scandal involving billions of dollars in federal revenue losses. I am seeking to set precedent here for those parents sent to debtor prisons and punished for protecting their children. Over time, it could result in billions of dollars in federal tax savings.

Precedent cases in recent years have proven me correct in my long held positions while paving the way for justice to finally occur. These include unanimous Supreme Court decisions in Exxon Mobile v Saudi Industries, 544 US 280 (2005); Marshall v Marshall, 547 US 293 (2006), Sprint v Jacobs, 571 US 69 (2013) and Rippo v Baker, 580 US __ (2017)(per curiam). They are reversing a 50 year trend by lower federal judges of denying family court victims their rightful access to our federal courts whose paramount purpose is to preserve our most basic federal rights.

This year alone, in the case of Timbs v Indiana, 580 US ___ (2/20/19), the Supreme Court declared that excessive fines and asset confiscations violated the Eighth Amendment. Although applied in the criminal context, parallels can be made to the civil case abuses which lead to needless bankruptcies, parent-child separations and premature deaths. Throughout my highly isolated crusade, I have exposed excessive court orders which, like the seizures in Timbs, benefited the state and third parties more than they did the “best interests” of any parent, child or family.

Only weeks ago, a federal appeals court issued a “Precedential” decision in Surender Malhan v Secretary U.S. Department, et. al., 18-3373 (3rd Cir. September 18, 2019). Citing two of the cases listed above, the court reversed a lower federal ruling which had dismissed a father’s civil rights case seeking to curb excessive support enforcement practices. It rejected Rooker-Feldman and Younger Abstention practices which deferred federal claims to pending or completed proceedings in state court. The case was remanded back to the lower federal court. That means it is unlikely to reach the Supreme Court any time soon.

Court arguments will begin and conclude on my case in the morning of November 15, 2019 and are open to the public. While Violent Felons Are Excused From Jail Time, Dads are Imprisoned at Record Levels for Support Debts and Protests

If you are a regular follower of this site, Leon Koziol.com, then you know about New York Supreme Court Judge James McClusky who excused a school bus driver from any jail time despite his conviction of raping a 14 year old student earlier this year. It has resulted in a petition for his removal containing over 75,000 signatures.

Meanwhile dads are being routinely jailed for non-violent support violations without notice or concern from anyone. The discrimination is blatant as reflected by another post from our site: A woman judge, Jerri Collins, was reprimanded by Florida’s Supreme Court on August 26, 2016 for belittling a domestic violence victim and sending her to jail.

It occurred after the woman willfully failed to show up for her trial as the complainant and main witness, citing fear and anxiety among the excuses. The judge gave her a mere 3-day punishment, but after feminist protesters took aim at the “injustice” of such a harsh outcome, the woman was released.

The fact that an accused (man) is innocent until proven guilty, and despite his costly retention of counsel, witnesses and evidence in his defense, the complainant’s absence from court was a-okay if you follow Florida’s high court reasoning. They simply sacrificed law and justice for politics and self-aggrandizement.

Judge Collins was not belittling a domestic violence victim, she was upholding a man’s due process rights and preserving the integrity of our judicial system. Even the families of murder victims respect that integrity by showing up as complainants, witnesses and observers at the proceedings designed to determine guilt or innocence.

When a dad willfully, or even accidentally, fails to show up for a support violation proceeding, not just a trial but any scheduled appearance, he is immediately subject to an arrest warrant and incarceration. And the excuses don’t matter, whether it’s the fear of a biased judge, false allegations that are never held accountable or the lust for federal incentive funds.

Jail sentences are doled out at six months in New York State and as much as two years in South Carolina where Walter Scott was shot dead five times in the back unarmed by a traffic cop while fleeing a support warrant. Our government is now killing dads for money while overlooking the violence which all this is causing.

Recurring jail sentences lead to suicides, lost employment and targeting. The court reports are virtually unanimous for jail terms ordered against dads, thereby filling our prisons. This, in turn, creates jobs and construction projects which the “Kids for Cash” scandal exposed in Pennsylvania. There is an unwritten judicial policy which treats dads as preferred jail targets on the sexist presumption that they are tougher and can survive confinement more readily.

Now comes a case in which a Michigan dad lost his two year old son in 2017. A family judge transferred custody to a mother fraught with drug abuse and CPS reports leading to the death of an infant. That custody decision was made by family judge Rachel Rancilio over the objections of his attorney and the dire warnings of imminent harm. The judge merely defended her decision that such issues were in the past.

The father, Jonathan Vanderhagen, then embarked upon a social media campaign to expose this judge for both her fatal decision and callousness. The judge retaliated by claiming to be fearful of Vanderhagen’s criticisms but a sheriff department investigation concluded that no threats were made.

Nevertheless, on July 24, 2019, this dad and protester was taken to jail for alleged bond violations and malicious use of the internet. A half million dollar bond was required for his release and a jury trial is set for September 13, 2019.

In November, 2015, family judge Daniel King of Lowville, New York placed a gag order on this site, Leon Koziol.com under the guise of a protection order related to our exposure of a fraud by child attorney William Koslosky and “custodial parent” Kelly Hawse-Koziol, the mother of my two daughters.

Both the state appointed parent and attorney had submitted a purported Notice of Relocation of my children to the home of a childless millionaire named Joseph Flihan Jr. That notice contained the electronic address gmai.com (without the “l” character) as a purported satisfaction of a custody order requirement.

Daniel King was then exposed for his alcohol use with his children nearby at a bar to show an utter hypocrisy behind his finding of a “prohibited alcohol related gesture” (wedding toast) which he used to suspend my father-daughter contact. It came in a December 2, 2013 decision, three months after my testimony before the Moreland Commission on Public Corruption, and it continues to the present day no matter that it is over five years “in the past.”

King denied my dismissal motions despite the vague and abusive terms of his gag order. It required me to obtain a show cause order against him in New York Supreme Court six months later.

That led King, without explanation, to cancel a trial set on the matter. He followed with a dismissal order on his own motion and removal of the gag order. Weeks later, he stepped down altogether, also without explanation. Because judges enjoy absolute immunity, I could get no liability, accountability or compensation for the loss of contact occurring under his judicial regime (King, replacement Judge James Eby and racist Utica city judge Gerald Popeo).

The criminalization and mass incarcerations of dads in this “dads for cash scandal” (I just made that up now, what do you think?) has reached epic proportions. It is today’s most ominous and suppressed public epidemic. We are now planning a march from the Oneida County Courthouse to Gerald Popeo’s city court in Utica, New York, a distance of only a quarter mile (seven city blocks) on September 26, 2019.

This comes after our successful Parent March on Washington this past May and removal of my state court precedent seeking case to federal court by the New York Attorney General last week. We need to grow the momentum here for the sake of veterans, parent victims and whistle blower protection.

Parent March on Washington goes viral with this precedent-setting video: Moms and Dads speak out like never before !

As promised, the Parent March on Washington has been memorialized on this Memorial Day Weekend with an inspiring video completed today. And it’s going viral beyond our wildest expectations.

It was produced by Philadelphia Attorney Lawrence DeMarco who dropped everything to attend our three-day event on May 1-3, 2019. An outstanding 15 minute production, there has never been anything like it in parent rights history.

If this does not motivate you to action, nothing will, not even the fees that you spend into bankruptcy trying to protect your children. Take as much time as you can now to make this video viral, do it for the sake of your own children and families, for the sake of suicide prevention, for the sake of future generations.

Our March lives on! Already I have addressed permit requirements with the New York State Police and Department of Transportation for our first follow-up regional march in upstate New York on October 3 and 4, 2019. A motorcade from Fort Drum to Utica, New York along State Route 12 will commemorate veterans lost to suicide and premature death as a result of a dysfunctional family court system.

On that evening we will feature the next round of expert speakers at a hotel conference room in Utica, New York. On Friday, October 4, 2019, we will march from the Oneida County Family Court a distance that is less than half of the one we completed in our nation’s capital. It will end at the Utica city courthouse where we will demand the removal or resignation of the following:

Like Operation Greylord in Chicago where nearly 100 judges, lawyers, clerks and deputies were arrested and convicted, family courts have become a corrupt institution as detailed in my report entitled Federal Funded Epidemic.

That report was distributed throughout Congress on May 2nd, and is now being submitted to school district superintendents throughout my congressional district as part of my ongoing lobby campaign. You need to do the same and join us to grow regional protests across the country.

System beneficiaries will continue to upstage our efforts, and you may think that your lone contribution will mean little, but it took a single dad who violated the law by bringing his daughter to a school in Topeka, Kansas which ended school segregation forever. Parent discrimination, alienation and family court corruption are harming our schools like never before. It’s time we ended it now!

On the heels of a highly successful Parent March on Washington and Congressional Lobby Initiative which I was able to put together in less than three months, I promised my followers a next step which I hope will ignite similar (regional) marches and protests across the country.

I am focused on a motorcade from Fort Drum in northern New York to Utica, New York with a protest seeking a removal of four judges in addition to Judge James McCluskey of Watertown, New York. I have a sufficient local following to make this happen but welcome all from around the country who want to keep our momentum going.

The motorcade is designed to draw attention to the veterans who have committed suicides as a result of family court abuses, see i.e. Purple Heart’s Final Beat, Second Class Citizen.Org. Fort Drum is among the largest military installations in the country charged with training and mobilization of all active services. In 1959, it was the site of Agent Orange experiments which later prevented healthy births for Vietnam veterans.

Fort Drum exists in New York’s Fifth Judicial District which has become a hotbed of judge misconduct. Corruption here is being ignored or glossed over by a state judicial commission dominated by lawyers. Over a 12-year period, all of my 30-plus complaints have failed to produce a single inquiry without explanation. Such vast inaction only encourages more misconduct.

Adding to the corruption, certain judges here are being allowed to retaliate against judicial whistle blowers. It is a shameless abuse of judicial office with my ordeal as a quintessential example. If they can do this to a prominent civil rights attorney and model parent, imagine what they will do to you.

For example, one of my custody judges, Gerald Popeo, was merely given a public censure by this commission in 2015 despite being found guilty of making racial slurs to an African-American attorney. He referred to a prosecutor as a “cigar store Indian,” threatened to come off the bench to assault a litigant for giving him a “smirk,” and he jailed men for contempt in violation of their due process rights. How much more misconduct is required for removal?

Because he was not removed, he managed to get assigned to my family court matters (as a city judge!). Among so many other abuses, he failed to provide a child support hearing transcript for appeal which showed a $45,500 fraud (2015 payment never credited to me by the state’s child support collection center). Instead, he issued a support warrant with a near fatal outcome after blaming me for that public censure at a local bar.

Now comes a judge who I sued last year for a continued abuse of my reform work as a judicial whistle blower. Judge James McClusky refused to give any jail time for a 26-year old bus driver who was found guilty of raping a 14-year old girl earlier this year. Over 70,000 signatures have already been obtained seeking his removal in only a few months.

McClusky’s boss, Administrative Judge James Tormey, heads the Fifth Judicial District, but he is playing politics with accountability that litigants rightfully demand. For example, his chief family court clerk recovered $600,000 against him (and my pedophile custody judge Bryan Hedges) in a civil rights case due to retaliation against her for refusing to engage in “political espionage,” see Morin v Tormey, 626 F.3d 40 (2nd Cir. 2010).

As victims, we need to join forces to bring accountability to this judicial district. We need to make an example here so that other regions of our country will do the same. We have reports delivered and discussed with members of Congress during our May 2nd Lobby Day which seek a federal investigation of human rights abuses in these courts. We must now make follow-up calls to those members before they sweep it aside like so many others on the subject.

There will be no conference call tonight after my efforts to unveil this “next step” was upstaged by a pair of “moles and trolls.” Those interruptions have been recorded and reported. Alarming Video of Corrupt Family Judges: Outraged Parents Headed to Washington

Unfortunately delayed for nearly two months, an NBC production crew has finally released this second in a series of alarming videos which documents widespread corruption in our nation’s divorce and family courts. It is the product of research and visits to victims across the country by the Parenting Rights Institute. Because judges are being exposed in serial fashion, this delay is no doubt caused by a scrutiny of content for accuracy.

The sampling of judges illustrates just how serious corruption has become in these courts. Many victims place blind trust in their “gods of justice” only to learn too late that they are permanently victimized. These judges were once the same lawyers profiting off of lucrative controversy to cause severe parental alienation, veteran suicides and debtor prisons under the guise of acting in our children’s “best interests.”

The time for talk, keyboarding and sermonizing to the choir is over. The system has become a trillion dollar industry with psychiatrists, counselors, case workers and countless court predators swallowing whole your earnings, savings and college funds to feed an endless greed. Children who once respected and loved both parents are taught to spy, hate and disown them with little or no cause. The alienation here is worse than the ordeals of illegal aliens being protected at our borders.

Outraged parents are wasting their time with complaints to federal and state agencies. Such parents (legally here) are no one’s priority because the state is seizing our childrearing authority as part of a New World Order. Only last month, representatives of our Institute met with a high ranking delegate to the United Nations only to learn that we would get no sympathy there. If you have survived these courts or even if you have never been to one, you are harmed in countless other ways by the societal costs.

That is why we have had enough. These lawsuits, complaints and reports are a waste when our own government does not even have the courtesy of giving a reply to so many. We have to take our case to Washington on May 3, 2019. We are going there to demand a federal investigation of these courts, to support a national shared parenting bill for an end to custody and alienation tactics, and a repeal of Title IV-D funding that is being abused to fill our jails, hospitals and morgues.

Nationwide Support Growing for Federal Criminal Investigation of Family Courts

Knocked down, beat up and nearly killed, I’m still standing, now in the halls of Congress seeking to elicit a federal criminal investigation of corruption in our nation’s family courts. The persecution by judges, lawyers and county sheriff has only increased my resolve to give abused moms, dads and children justice for all their needless suffering.

Today, PRI Director, Dr. Leon Koziol, continued with his quest to elicit a federal criminal investigation of corruption in our nation’s divorce and family courts. An upgraded report was submitted to Senate Minority Leader Chuck Schumer after last week’s personal interactions with Republican members of the Senate Judiciary Committee. A copy was also submitted to a highly intrigued reporter of the Associated Press.

In only two days, highly enthusiastic support has come from across the country by phone, e-mail and our thousands of Facebook followers. Most are highly informed victims who “get” what Leon is trying to do. A special thanks to all of you from our volunteers at Parenting Rights Institute.

We need a groundswell of support behind a lobbying blitz in Congress. Pontifications from keyboards in the comfort of our homes is accomplishing nothing. The petition and record in Leon Koziol v Chief Judge Janet DiFiore, et. al. provide all the necessary support for a federal criminal investigation of the civil rights abuses found throughout a ten year whistleblower ordeal. The case exemplifies or exposes a national epidemic supporting a separate congressional inquiry into federal funding abuses in state family courts. The Supreme Court site under docket number 18-278 offers a petition, appendix, stay motion and affidavits at the end to verify the foregoing and to alert the public of a crisis in federal law violations. 

If these highly uncontested facts are insufficient to draw the interest of our federal authorities, such criminal statutes are meaningless for those who do not satisfy traditional victim status. A white male parent raised in poverty conditions whose own father spent five years in a Nazi war camp should not have to endure all the man-hating prejudice which surrounded the Brett Kavanaugh confirmation process. That process has now taken father discrimination to unprecedented levels. A back-lash of severe proportion is pending because our halls of justice continue to pretend that dads, victimized only by their birth status, are getting fair treatment.  

Related to this, judicial accountability is routinely overlooked based on an elite presumption of superiority. Yet it is easily countered by such events as a federal sting operation (Greylord) involving judicial criminality in Chicago during the 1980s. 93 people were indicted after an undercover investigation by joint effort of the FBI and state law enforcement. They included 17 judges, 48 lawyers, 10 deputy sheriffs, eight policemen, eight court officials and an elected official. Nearly all were convicted of crimes ranging from bribery to mail fraud and racketeering. Three committed suicide including a state judge. Another died in 2011 shortly after his release.

More recently, a predecessor of New York Chief Judge Janet DiFiore was sent to federal prison for extortion and false reports to FBI agents during an investigation of complaints made by the judge’s mistress. He also directed taxpayer financed court clerks to harm the law license interests of the attorney who was assisting the victim and her daughter regarding those crimes. Ex-New York Chief Judge Sol Wachtler directed a horrific campaign of crime, ultimately conceding in a subsequent book, After the Madness, that judges were trained to think of themselves as gods. 

Brooklyn judge Gerald Garson was convicted for accepting a bribe to fix a child custody case. Upstate Judge Thomas Spargo sought a bribe behind a threat to harm a lawyer in a divorce case. In the Pennsylvania “kids for cash scandal,” two judges were sent to prison for accepting bribes from detention center construction contractors. Some 4,000 juvenile convictions had to be thrown out by the state’s high court whose own justices have been the subject of misconduct in recent years. Judge Wade McCree of Detroit was removed from the bench after he impregnated a mother litigant in his chambers. The father was placed on a child support monitor. He sued for compensation but was denied relief in federal court based on judicial immunity. The list goes on.

On September 18, 2018, the New York Post featured a story about petitioner’s Congresswoman, Claudia Tenney, who sent a memo to her staff warning of “thuggish” retaliatory behavior connected to her opponent. Claudia was present in petitioner’s home in 2010 prior to her first political victory when the current reform effort was announced. Her opponent, Anthony Brindisi, is a state assemblyman, attorney, law partner and son of Louis Brindisi, a reputed mob lawyer charged with seven felonies during the 1990s for operating a drug ring out of the law firm’s offices. A lawyer there was earlier found tied to a chair and murdered in the law office basement. The underworld activity here was the target of a federal sting operation during the 1950s. It was all well depicted in a Utica, New York newspaper series by Rocco LaDuca entitled “Mob Files.” 

Attorney Louis Brindisi escaped with a misdemeanor plea after he began releasing the names of all prominent people who attended his law office parties. He never lost his law license. This is the same community where this petitioner maintained an unblemished law practice until it was destroyed by a secretary influenced by outside parties to sabotage office calendars, pilfer bank accounts and conceal client material to create ethics violations. Her crimes were discovered in 2009, but local police and prosecutors failed to act on petitioner’s criminal complaints. She was convicted of felonies upon later law office employers and sent to jail in 2016.

The victim now petitioning for a federal investigation has been accumulating evidence to show that an illegal drug operation remains alive and lucrative in the Utica, New York region. His ex-secretary was a loyal and efficient employee for years until she began boasting of parties she attended where cocaine was being abused by all. She also began a gambling addiction at Turning Stone Casino supported by a clandestine law practice finally ended with petitioner’s assistance in 2012 by her arrest in another county. After her 2009 firing by petitioner, it was learned that she had developed ties to certain lawyers for purposes of harming this whistleblower’s career.
