Updated Epilogue to the book, Whistleblower in Paris, exposes the worst of parental alienation and silent epidemic in divorce and family courts

The ongoing ordeal of a judicial whistleblower has necessitated an update to the epilogue (concluding summary) of my recently published book, Whistleblower in Paris. Epilogue

As a civil rights attorney, I spent over two decades litigating for victims of race, gender, religion and ethnic discrimination. This included sexual harassment cases when they were unpopular. Many successful verdicts, monetary recoveries and precedent outcomes resulted. But my crusade for justice was not limited to minorities. It also extended to white landowners wrongfully threatened with eviction in the Oneida Indian land claim. Police brutality cases were similarly prosecuted for diverse victims, and I represented a public safety commissioner, police chief and rank and file officers whenever they were falsely accused.

In short, I was motivated to correct injustices to a point where I managed to have a billion-dollar casino compact invalidated on constitutional grounds in New York Supreme Court. The Las Vegas Sun reported it as a David-Goliath battle won by “the small Utica law firm that won the case.” [66] Among the defense firms was Cravath, Swaine and Moore, one of the most powerful in the nation. These achievements earned me praise from federal and state judges. The court transcripts, headline news and published opinions bear this out.

However, when I turned my energies to correcting human rights violations in divorce and family courts, I was viciously targeted. Suddenly, my arguments were incomprehensible, rambling and frivolous after twenty-three unblemished years. Even I underestimated the wrath of a corrupt regime bent on retaliation for my exposure of corruption involving a judge-lawyer gold mine. In numerous public statements, I cited federal funding abuses and lucrative custody battles that were inciting child murders, veteran suicides and needless parental conflict.

As a consequentially victimized parent, I was then forced to assume the mantra of a judicial whistleblower devoid of legal protection. The horrific ordeal here remains unprecedented in modern times. Among the practices I condemned in chapter two and an earlier book, Satan’s Docket, was the abuse of forensic custody evaluations. Then, in January, 2022, a blue-ribbon panel appointed by New York’s governor voted to eliminate these evaluations altogether. I made a presentation at a virtual public hearing sponsored by that panel asking for this very outcome, but like the Moreland Commission on Public Corruption (where I also appeared), it is doubtful that any genuine reform will be implemented. That is how powerful this gold mine has become.

So, in the spirit of Dr. Martin Luther King, I sponsored a three-day event at our nation’s capital in May, 2019. Its goal was to elicit a Justice Department investigation and congressional hearings into the rampant human rights violations and federal funding abuses which continue to be ignored in these custody and support courts. We featured planning sessions, a lobby day among the offices of Congress, expert speakers at a hotel ballroom, a candlelight vigil in front of the U.S. Capitol, and a march down Pennsylvania Avenue under police escort from the White House to the Supreme Court.

All of this was accomplished without incident on a shoestring budget. At least four necessary permits were obtained together with regulatory compliance. Parents came from all parts of the country to register their peaceful protest against divorce and family court corruption. Yet not a single member of Congress responded. Then-president Donald Trump never materialized in front of the crowd assembled at the White House. Not even a representative was sent. The Justice Department weighed in with the same message that parental rights were not even on their radar. His successor, Joe Biden, proved oblivious to this crisis altogether.

So what is the lesson to be realized from all this? Peaceful protests to benefit parents, children and families of all races, religions and ethnic backgrounds will be ignored. They yield no respect whatsoever while the same politicians beg for our support on election day through such things as a voting rights bill. Therefore, it is time for those struggling against parental alienation, custody abuses and support debtor prisons to take matters into their own hands. Stay away from lawyers and these courts, set aside your custody and support disputes, and keep abreast of fellow victims who need your help. In this way at least, we might succeed in closing the gold mine.

Thinking back to all the craziness I endured for more than a decade under the yoke of this antiquated child custody regime, it still amazes me that not a single inquiry was made by the New York Commission on Judicial Conduct regarding the many complaints I lodged. How could so much corruption become so buried? I am also amazed at all the physical restraint I practiced. Under our form of government, when the courts break down, victims can seek recourse outside the system. Nevertheless, my restraint led to poetic justice in so many ways.

Among the Sadistic Seven, Michael Daley is no longer a judge, having failed to garner enough support for re-election to the bench. His unpopularity was borne out later when he was defeated in an election for his old job as a local prosecutor. Last I heard he was representing traffic clients in Utica city court.

Judge Martha Walsh-Hood continues to serve as a family court judge as does her colleague Michele Pirro-Bailey in Syracuse. Judge Daniel King is still on the family court bench in Lowville, New York, but is up for re-election in 2022. At a minimum, my whistleblower testimony before the Moreland Commission on Public Corruption should be raised by any opposing candidate. The judge collusion inferred by King’s sudden removal of his gag order during my mandamus action in state Supreme Court remains a part of the public record. The manner in which this was all arranged behind closed doors demands a proper investigation.

Regardless, not one of these judges was elevated to higher office. This includes Judge James Eby who no longer presides over my case in Oswego, New York. In the aftermath of his uncorrected bias, innocent third parties were irreparably harmed. During his bombastic antics directed at me, he gave no concern for extended family similarly denied all contact with my daughters. He simply pressed on with his ego-driven agenda of retaliation to maintain favor among colleagues on and off the bench.  

To be sure, as director of the Parenting Rights Institute, I continue to receive complaints about him, one from a custodial mother regarding his knack for keeping the fees coming. He makes a mockery of this self-serving rationale of acting “in the best interests” of our children whose basic needs and college funds are raided. Entire families are bankrupted in the process while inciting domestic violence. An adversarial process rationalized by truth-seeking objectives cannot withstand the ultimate injury it yields when children are placed at needless risk compelling parents to resort to uncharacteristic extremes to protect them.

Similarly, Judge Gerald Popeo in Utica is also no longer presiding. He declined re-election prospects following my crusade against him in 2018. The judge censure which he blamed partly on me no doubt played a role in his decision. Magistrate Natalie Carraway continues her routine in support courts of Herkimer County, presumably charting a course for higher judgeship. Meanwhile, I continue to receive unsolicited praise from countless parents who publicly credit me for private changes in attitude among certain well-meaning jurists.

But it may also be said that poetic justice was served beyond the Sadistic Seven. My pedophile custody judge, Bryan Hedges, was permanently banned from the bench by the high court of New York, his colleague in Syracuse, Michael Hanuszczak, was forced to step down for sexual harassment of his court clerks, and Magistrate G. Stephen Getman lost an election for family court judge. His license suspension for mishandling client money caught up to him in that race.

My ex-secretary was jailed for crimes upon later victims. Her scheme with outsiders to orchestrate ethics issues in my office together with her tampering of mail and files resulted in the removal of a $220,000 mortgage claim on my home. It is unlikely that she will ever be hired for another law-related position given her felony convictions and our creation of a pretend lawyer website that features her. She would not have contemplated such crimes unless cloaked with some concealed protection while my office supervision was derailed by the family court battles.

My ex-wife was removed from the millionaire’s home in 2016 after wasting untold resources to pursue a needless parent alienation campaign bent on greed, revenge and jealousy. She too could not have succeeded without the undisclosed backing of many of the judges assigned to our case. But this particular campaign exceeded the worst I have come across. It can only be described as something hatched out of hell itself, a new form of evil. It harmed not only her children and their father but it devastated her own world. Yet she pressed on like the proverbial energizer bunny.

You would think that this “custodial parent” learned a profound lesson when her relocation scheme to that millionaire’s home was exposed. It featured the “gmai.com” concoction which she and the child attorney tried to pass as proper notice of a new residency. At a minimum, a parent has a right to know where his or her children are residing and with whom so that they can be better safeguarded. But here, despite undeniable proof of deceit upon the father, court and schools, this scheme was accorded no accountability in contrast with money obligations (child support) which were hounded to a point of arrest warrants, jail commitments and even death.

This one-sided persecution had no effect on her commitment to forever end all father-daughter relationships developed since birth. In August, 2021, the newly married Kelly Usherwood contrived an exit from the region on the day after my youngest daughter’s eighteenth birthday. She placed her home on the market and relocated both my girls to an undisclosed residence without even an identity of colleges they were now attending. By text message, she directed that any information was to be exchanged through the maternal grandmother nearby.

As fate would have it, this grandmother deceased only three months later. Meanwhile, circumstances showed that the e-mail exchanges made between father and his daughters were actually being made by the mother. This is how devious the alienator had become to achieve her objective of a family unit completely isolated from the biological father, one who had never even been found to be an unfit parent. It proved to be spite, greed and status which motivated Kelly Usherwood to pursue the unimaginable while the band played on in these corrupt family courts. 

None of this should surprise the reader given the content of earlier chapters and the growing horrors of parental alienation throughout the country. The unilateral directives of this deranged mother comported with no court order, but with the long confirmed systemic bias among numerous assigned judges in New York’s Fifth Judicial District, and the deference repeatedly given them by federal court, all courthouse doors had been closed in terms of any civil recourse. If Daniel King could invent a “prohibited alcohol related gesture” (wedding toast) as a reason to suspend child contact, how could I expect any sanity from the judges who replaced him?

The recent concealment of my daughters raises concerns that could warrant an amber alert given the bizarre conduct of the alienator-abductor. It occurred in the aftermath of my extended hospital stay only months earlier. Despite a life-threatening condition, no direct contact was received from my daughters. By the time the realities of brainwashing caught up to them, it would be too late to revisit countless precious moments captured in home videos and photos.

In the end, it begs the question: what kind of evil lurks in the body of Kelly Usherwood? The answer may lie in some sequel of American Greed or a psycho movie. Even my girls were not spared the karma behind their immoral disregard of dad during his hospital stay, the man who made their existence possible. Both daughters were forced to suffer through a pandemic which is continuing. Graduations, proms and other once-in-a-lifetime events were either canceled or subjected to highly diluting regulations.  

As for the ethics lawyers who helped facilitate this chaos, they were forced to resign after an investigation into falsified time sheets. Would-be clients continue to be denied qualified representation. Even after eleven years of license suspension, I continue to receive calls from victims who cannot secure basic legal advice. The system justified this by support obligations that cannot be satisfied without the licenses, resources and liberties that were seized.

This so-called disciplinary process was abused to achieve censorship, thereby making its perpetrators complicit in the resulting crimes upon humanity.  Despite all this, corruption was exposed on a vast scale after unprecedented numbers of jurists were removed from my originally uncontested divorce. Those removals helped alter the divorce culture in a positive way while exposing the underbelly of a court system hell-bent on revenues and profits. 

But I paid a high price. Out of law school in 1987, I was able to secure a restraining order on a $30 million high school project, [67] I won my first interstate divorce appeal two years later, [68] my name appears on two dedication plagues of the Utica city courthouse as an elected councilman and corporation counsel, I was a featured speaker regarding Native American land claims across upstate New York, and I won a $300,000 civil rights recovery against my local Sheriff which may have factored into the later antics. Other high-profile cases are cited at footnotes 7-11.

Today I am unable to get a family judge to order phone contact with my own daughters.  

In raw terms, you can kill a targeted person with a gun or accomplish the same outcome with a drawn-out process that chips away at your existence. Parent alienation is such a process. It is more than a psychological syndrome or human rights violation, it is a proven killer of victimized parents. Whether it be a suicide, terminal illness or some other brutal consequence, the needless separation of a loving parent from his or her children is simply unconscionable. And when forcing the victim to pay for the child abduction through support payments under penalty of a debtor prison, it becomes utterly barbaric. 

Judges are quick to overlook this reality as they routinely find breaches of various duties in personal injury cases to achieve million-dollar verdicts. But when greater breaches of ethical duties are presented regarding their own conduct, they cloak themselves with judicial immunity on the rationale that such liability would deter qualified candidates from seeking judgeships. Utter nonsense, most lawyers crave these prestigious titles, and a judge complying with job requirements has nothing to fear. If anything, this absolute immunity encourages misconduct while politically-appointed oversight commissions fail us time and again.

This ordeal warrants a Justice Department investigation and congressional inquiry. It would benefit countless moms, dads and families similarly situated. There are tremors of unrest throughout this country which are being ignored. Hardly a day goes by without some child murder, needless suicide or unpredictable homicide traced to these dysfunctional courts. What remains of a stable society is largely made possible by the free exercise of parental liberties and self-governance. It is my fervent hope, therefore, that a powerful movement emerges from my sacrifices that forces our government to pay attention to its own parents.

This literary work is by no means an indictment of our justice system or legal profession. However, it verifies in painstaking detail how a conscientious attorney, model parent and judicial whistleblower can be so ruthlessly punished for his crusade to deliver overdue reforms to our system of family court justice. The people rely on qualified insiders to alert them to corruption in our third branch of government. It accentuates the need for attorney whistleblower protection.

Finally, this book is directed against the divorce industry and the family court predators who are dragging justice down to hell, a people’s courthouse reduced to a giant profit center. All this corruption might compel another victim to resort to violence. But I was able to forbear it and achieve some justice in more constructive ways. My old friend, Sir Walter Scott, gave me sage advice in that regard:

For he that does good, having the unlimited power to do evil, deserves praise not only for the good he performs, but the evil he forbears

The Legacy of Susan B. Anthony merits consideration in a Supreme Court overhaul

President Joe Biden’s new commission to study an overhaul of our Supreme Court met for the first time today, April 16, 2021. According to a New York Times story by Charlie Savage, that commission will now explore changes well beyond an increase in the number of justices proposed by a group of lawmakers yesterday. This is a positive development given the political motivations behind the expansion plan which has already crashed and burned.

That does not mean the idea of an expanded high court should be dismissed altogether. As I urged in yesterday’s post, it simply means that any such proposal should be based on merit, one that places the interests of aggrieved citizens over the categorical ideologies of the current nine-member bench. Leaders on both sides of the aisle wisely recognize that the Supreme Court must not be transformed into a political institution, however implausible that may be.

To that end, the legacy of Susan B. Anthony may be instructive. This famous leader of the women’s rights movement was arrested in Rochester, New York for the crime of voting in the 1872 elections. She asserted the newly adopted Fourteenth Amendment as her justification. Her criminal case went to trial the following year before a presiding justice of the Supreme Court named Ward Hunt. He was born in Utica, New York, my home town, during its heyday as a thriving industrial hub. After serving as its mayor, he was appointed chief judge of New York’s high court before being nominated to the Supreme Court by President Ulysses S. Grant.

At the time, justices of the Supreme Court presided in both trial and appellate capacities among various federal circuits. So bizarre was this practice that when I first learned of it in the Anthony case, I immediately believed that she was tried before a justice of the state supreme court which, unlike all other states, is the trial level court in New York. Ward Hunt deliberated in a way that might shock today’s conscience, but then again, startling parallels can be made to modern day courts when I revisit my ordeal shortly as a persecuted civil rights attorney, aggrieved parent and judicial whistleblower.

Judge Hunt essentially conducted a star chamber trial. He used Anthony’s unsworn statements at the arrest scene as testimony against her while refusing to let her take the stand, directed the jury to find against her, and even issued a guilty opinion prepared prior to opening statements. He ordered her to pay a fine of $100 which she refused and then failed to incarcerate her as a consequence so that no appeal could be taken to the full Supreme Court. Such egregious deprivations of due process were not rectified until 1895 in the case of Sparf v United States which prohibited judge verdicts in place of the jury in criminal cases.

The effective merger of trial and appellate courts did not end until the circuit courts of appeals were created by act of Congress in 1891. There are currently 13 circuits with justices ranging in number from the First Circuit in Boston with six to the Ninth Circuit in California with twenty-nine. They all operate with 3-judge panels that decide most appeals and full court, or en banc review, for high profile matters. A loser in a panel appeal can petition for full court review, but it is rarely granted (much like the petitions denied by the Supreme Court). This two-tier process of appellate review assures that all properly filed appeals will be heard.

The current proposal to expand the Supreme Court from nine to thirteen is merely an increase in number, a bureaucratic exercise bent on avenging President Donald Trump’s conservative appointments. It does not assure that more cases will be heard and may even reduce the high court’s capacity when more justices delay outcomes through complex opinions, i.e. unanimous, majority, plurality, concurrent and dissenting. To be truly beneficial for the people served, that proposal should incorporate the two-tiered circuit court structure which has proven effective for many decades. A thirteen member Supreme Court, for example, could feature four three-judge panels with a chief justice focused on administrative duties.

The Susan B. Anthony trial was known for its positive impact on women’s suffrage, but it also helped shape a better court structure for the delivery of justice. So outraged was this defendant by the miscarriage delivered to her that she openly defied the orders of a Supreme Court justice, including a fine that was never paid. We look back today with great admiration for her courageous stand. However when a similar one is taken by reformists and whistleblowers of modern times, retaliation is common with the typical reputation damage that comes with it. By killing the messenger, corruption thrives in all branches of government.

Therefore the Biden Commission must take a hard look at judicial immunity doctrines and compensation of whistleblowers for the wrongs committed against them. My ordeal is exemplary. Like the Susan B. Anthony criminal case, my family court process featured judge verdicts on child custody and support with no jury at all. I was directed to cease making objections by one judge, Daniel King, which compelled me to exit and waive my rights to testify. After his disqualification, replacement Judge James Eby, forced the litigants and their paid attorneys to make a 160 mile round trip from Utica to his Oswego courthouse to receive a decision that had already been completed.

Ironically the appellate courtroom in Rochester named after Susan B. Anthony is the same one where my law license was first suspended for the stand I took against the Ward Hunts of today. Parenting Rights Institute Offers Valuable Attorney Searches in Family Matters

After Dr. Leon Koziol, the father of two young girls, filed a motion for removal of Family Judge Bryan Hedges from his child custody case, lawyers appointed for the children and retained by the mother chastised Koziol in open court for daring to challenge a judge whose reputation was “beyond reproach.” Only months later, that same judge resigned from the bench after admitting to sexual abuse of his handicapped 5-year old niece. To prevent future judge appointments, Hedges was permanently removed by the state’s high court in 2013, see In re “the Honorable” Bryan R. Hedges, 20 NY3d 677. On September 25, 2018, the administrator and counsel for the judicial commission which prosecuted this case published an editorial in the Washington Post featuring Hedges as an example of decades-old misconduct which can be used against sitting judges. It was directed to the nomination of Brett Kavanaugh. But Hedges was never prosecuted criminally unlike Roman Catholic priests. As promised, the Parent March on Washington has been memorialized on this Memorial Day Weekend with an inspiring video completed today. And it’s going viral beyond our wildest expectations.

It was produced by Philadelphia Attorney Lawrence DeMarco who dropped everything to attend our three-day event on May 1-3, 2019. An outstanding 15 minute production, there has never been anything like it in parent rights history.

That report was distributed throughout Congress on May 2nd, and is now being submitted to school district superintendents throughout my congressional district as part of my ongoing lobby campaign. You need to do the same and join us to grow regional protests across the country.

System beneficiaries will continue to upstage our efforts, and you may think that your lone contribution will mean little, but it took a single dad who violated the law by bringing his daughter to a school in Topeka, Kansas which ended school segregation forever. On the heels of a highly successful Parent March on Washington and Congressional Lobby Initiative which I was able to put together in less than three months, I promised my followers a next step which I hope will ignite similar (regional) marches and protests across the country.

I am focused on a motorcade from Fort Drum in northern New York to Utica, New York with a protest seeking a removal of four judges in addition to Judge James McCluskey of Watertown, New York. I have a sufficient local following to make this happen but welcome all from around the country who want to keep our momentum going.

The motorcade is designed to draw attention to the veterans who have committed suicides as a result of family court abuses, see i.e. Purple Heart’s Final Beat, Second Class Citizen.Org. Fort Drum is among the largest military installations in the country charged with training and mobilization of all active services. In 1959, it was the site of Agent Orange experiments which later prevented healthy births for Vietnam veterans.

Fort Drum exists in New York’s Fifth Judicial District which has become a hotbed of judge misconduct. Corruption here is being ignored or glossed over by a state judicial commission dominated by lawyers. Over a 12-year period, all of my 30-plus complaints have failed to produce a single inquiry without explanation. Such vast inaction only encourages more misconduct.

Adding to the corruption, certain judges here are being allowed to retaliate against judicial whistle blowers. It is a shameless abuse of judicial office with my ordeal as a quintessential example. If they can do this to a prominent civil rights attorney and model parent, imagine what they will do to you.

For example, one of my custody judges, Gerald Popeo, was merely given a public censure by this commission in 2015 despite being found guilty of making racial slurs to an African-American attorney. He referred to a prosecutor as a “cigar store Indian,” threatened to come off the bench to assault a litigant for giving him a “smirk,” and he jailed men for contempt in violation of their due process rights. How much more misconduct is required for removal?

Because he was not removed, he managed to get assigned to my family court matters (as a city judge!). Among so many other abuses, he failed to provide a child support hearing transcript for appeal which showed a $45,500 fraud (2015 payment never credited to me by the state’s child support collection center). Instead, he issued a support warrant with a near fatal outcome after blaming me for that public censure at a local bar.

Now comes a judge who I sued last year for a continued abuse of my reform work as a judicial whistle blower. Judge James McClusky refused to give any jail time for a 26-year old bus driver who was found guilty of raping a 14-year old girl earlier this year. Over 70,000 signatures have already been obtained seeking his removal in only a few months.

McClusky’s boss, Administrative Judge James Tormey, heads the Fifth Judicial District, but he is playing politics with accountability that litigants rightfully demand. For example, his chief family court clerk recovered $600,000 against him (and my pedophile custody judge Bryan Hedges) in a civil rights case due to retaliation against her for refusing to engage in “political espionage,” see Morin v Tormey, 626 F.3d 40 (2nd Cir. 2010).

As victims, we need to join forces to bring accountability to this judicial district. We need to make an example here so that other regions of our country will do the same. We have reports delivered and discussed with members of Congress during our May 2nd Lobby Day which seek a federal investigation of human rights abuses in these courts. We must now make follow-up calls to those members before they sweep it aside like so many others on the subject.

There will be no conference call tonight after my efforts to unveil this “next step” was upstaged by a pair of “moles and trolls.” Those interruptions have been recorded and reported. Alarming Video of Corrupt Family Judges: Outraged Parents Headed to Washington

Unfortunately delayed for nearly two months, an NBC production crew has finally released this second in a series of alarming videos which documents widespread corruption in our nation’s divorce and family courts. It is the product of research and visits to victims across the country by the Parenting Rights Institute. Because judges are being exposed in serial fashion, this delay is no doubt caused by a scrutiny of content for accuracy.

The sampling of judges illustrates just how serious corruption has become in these courts. Many victims place blind trust in their “gods of justice” only to learn too late that they are permanently victimized. These judges were once the same lawyers profiting off of lucrative controversy to cause severe parental alienation, veteran suicides and debtor prisons under the guise of acting in our children’s “best interests.”

The time for talk, keyboarding and sermonizing to the choir is over. The system has become a trillion dollar industry with psychiatrists, counselors, case workers and countless court predators swallowing whole your earnings, savings and college funds to feed an endless greed. Children who once respected and loved both parents are taught to spy, hate and disown them with little or no cause. The alienation here is worse than the ordeals of illegal aliens being protected at our borders.

Outraged parents are wasting their time with complaints to federal and state agencies. Such parents (legally here) are no one’s priority because the state is seizing our childrearing authority as part of a New World Order. Only last month, representatives of our Institute met with a high ranking delegate to the United Nations only to learn that we would get no sympathy there. If you have survived these courts or even if you have never been to one, you are harmed in countless other ways by the societal costs.

That is why we have had enough. These lawsuits, complaints and reports are a waste when our own government does not even have the courtesy of giving a reply to so many. We have to take our case to Washington on May 3, 2019. We are going there to demand a federal investigation of these courts, to support a national shared parenting bill for an end to custody and alienation tactics, and a repeal of Title IV-D funding that is being abused to fill our jails, hospitals and morgues.

Nationwide Support Growing for Federal Criminal Investigation of Family Courts

Knocked down, beat up and nearly killed, I’m still standing, now in the halls of Congress seeking to elicit a federal criminal investigation of corruption in our nation’s family courts. The persecution by judges, lawyers and county sheriff has only increased my resolve to give abused moms, dads and children justice for all their needless suffering.

Today, PRI Director, Dr. Leon Koziol, continued with his quest to elicit a federal criminal investigation of corruption in our nation’s divorce and family courts. An upgraded report was submitted to Senate Minority Leader Chuck Schumer after last week’s personal interactions with Republican members of the Senate Judiciary Committee. A copy was also submitted to a highly intrigued reporter of the Associated Press.

In only two days, highly enthusiastic support has come from across the country by phone, e-mail and our thousands of Facebook followers. Most are highly informed victims who “get” what Leon is trying to do. A special thanks to all of you from our volunteers at Parenting Rights Institute.

We need a groundswell of support behind a lobbying blitz in Congress. Pontifications from keyboards in the comfort of our homes is accomplishing nothing. The petition and record in Leon Koziol v Chief Judge Janet DiFiore, et. al. provide all the necessary support for a federal criminal investigation of the civil rights abuses found throughout a ten year whistleblower ordeal. The case exemplifies or exposes a national epidemic supporting a separate congressional inquiry into federal funding abuses in state family courts. The Supreme Court site under docket number 18-278 offers a petition, appendix, stay motion and affidavits at the end to verify the foregoing and to alert the public of a crisis in federal law violations. 

If these highly uncontested facts are insufficient to draw the interest of our federal authorities, such criminal statutes are meaningless for those who do not satisfy traditional victim status. A white male parent raised in poverty conditions whose own father spent five years in a Nazi war camp should not have to endure all the man-hating prejudice which surrounded the Brett Kavanaugh confirmation process. That process has now taken father discrimination to unprecedented levels. A back-lash of severe proportion is pending because our halls of justice continue to pretend that dads, victimized only by their birth status, are getting fair treatment.  

Related to this, judicial accountability is routinely overlooked based on an elite presumption of superiority. Yet it is easily countered by such events as a federal sting operation (Greylord) involving judicial criminality in Chicago during the 1980s. 93 people were indicted after an undercover investigation by joint effort of the FBI and state law enforcement. They included 17 judges, 48 lawyers, 10 deputy sheriffs, eight policemen, eight court officials and an elected official. Nearly all were convicted of crimes ranging from bribery to mail fraud and racketeering. Three committed suicide including a state judge. Another died in 2011 shortly after his release.

More recently, a predecessor of New York Chief Judge Janet DiFiore was sent to federal prison for extortion and false reports to FBI agents during an investigation of complaints made by the judge’s mistress. He also directed taxpayer financed court clerks to harm the law license interests of the attorney who was assisting the victim and her daughter regarding those crimes. Ex-New York Chief Judge Sol Wachtler directed a horrific campaign of crime, ultimately conceding in a subsequent book, After the Madness, that judges were trained to think of themselves as gods. 

Brooklyn judge Gerald Garson was convicted for accepting a bribe to fix a child custody case. Upstate Judge Thomas Spargo sought a bribe behind a threat to harm a lawyer in a divorce case. In the Pennsylvania “kids for cash scandal,” two judges were sent to prison for accepting bribes from detention center construction contractors. Some 4,000 juvenile convictions had to be thrown out by the state’s high court whose own justices have been the subject of misconduct in recent years. Judge Wade McCree of Detroit was removed from the bench after he impregnated a mother litigant in his chambers. The father was placed on a child support monitor. He sued for compensation but was denied relief in federal court based on judicial immunity. The list goes on.

On September 18, 2018, the New York Post featured a story about petitioner’s Congresswoman, Claudia Tenney, who sent a memo to her staff warning of “thuggish” retaliatory behavior connected to her opponent. Claudia was present in petitioner’s home in 2010 prior to her first political victory when the current reform effort was announced. Her opponent, Anthony Brindisi, is a state assemblyman, attorney, law partner and son of Louis Brindisi, a reputed mob lawyer charged with seven felonies during the 1990s for operating a drug ring out of the law firm’s offices. A lawyer there was earlier found tied to a chair and murdered in the law office basement. The underworld activity here was the target of a federal sting operation during the 1950s. It was all well depicted in a Utica, New York newspaper series by Rocco LaDuca entitled “Mob Files.” 

Attorney Louis Brindisi escaped with a misdemeanor plea after he began releasing the names of all prominent people who attended his law office parties. He never lost his law license. This is the same community where this petitioner maintained an unblemished law practice until it was destroyed by a secretary influenced by outside parties to sabotage office calendars, pilfer bank accounts and conceal client material to create ethics violations. Her crimes were discovered in 2009, but local police and prosecutors failed to act on petitioner’s criminal complaints. She was convicted of felonies upon later law office employers and sent to jail in 2016.

The victim now petitioning for a federal investigation has been accumulating evidence to show that an illegal drug operation remains alive and lucrative in the Utica, New York region. His ex-secretary was a loyal and efficient employee for years until she began boasting of parties she attended where cocaine was being abused by all. She also began a gambling addiction at Turning Stone Casino supported by a clandestine law practice finally ended with petitioner’s assistance in 2012 by her arrest in another county. After her 2009 firing by petitioner, it was learned that she had developed ties to certain lawyers for purposes of harming this whistleblower’s career.

Dr. Leon Koziol submits report to Senate Judiciary Committee seeking criminal investigation of family court corruption

Before and after this October 11, 2018 meeting of the Senate Judiciary Committee, Dr. Leon Koziol discussed his recent report regarding court corruption with several key members. Each one committed himself and senate staff to a review. Hopefully it will lead to a long needed federal investigation of our state family courts.

Parenting Rights Institute Director, Dr. Leon Koziol, has just returned from a week long trip to Washington D.C. He has been lobbying the Senate Judiciary Committee, House Oversight Committee, Justice Department and others for a federal investigation and committee hearings on the subject of judicial corruption in our nation’s family courts. He hopes other victims will join.

At the center of his effort is a report describing his Supreme Court petition docketed on September 5, 2018 entitled, Leon Koziol v Chief Judge Janet DiFiore, et. al. Case No. 18-278. That case relates the ten-year ordeal of Dr. Leon Koziol as a trial attorney and model parent with a request for judicial whistleblower protection. All documents are accessible on the Supreme Court site.

Depicted graphically throughout this website, Leon Koziol.com, his ordeal dwarfs the one related to the same Judiciary Committee by Dr. Blasey Ford during the recent confirmation hearings. Newly seated Justice Brett Kavanaugh will now review the Koziol case featuring claims of discrimination in our family courts, judge corruption and the targeting of men everywhere. 

The horrific mistreatment of this whistleblower climaxed this past year to include violations of law, procedure and government policies in a clandestine effort to literally kill a highly qualified reform messenger. Oneida County, New York  Sheriff Robert Maciol admitted that a secret police bulletin was improperly leaked to the media, one which led to a verbal “shoot on sight” order by a town patrol cop. It was compared to the police murder of Walter Scott on April 4, 2015. Unarmed and fleeing a child support warrant at a traffic stop, this dad was shot dead five times in the back leading to a $6 million settlement.

Sheriff Maciol has ignored Dr. Koziol’s complaints since January regarding the targeting of his free speech, parenting and due process rights, making him complicit in a conspiracy to violate federal law. The volatile situation which this has triggered can be compared to the needless killing of another deputy under his command, Kurt Wyman, during a domestic stand-off.

In the Koziol case, a subordinate deputy was reported for abusing court security duties, providing free service of a support summons as a favor to a court clerk, and depriving taxpayers and sheriff civil division of the fee prescribed by law. In a comparable case successfully defended by Dr. Koziol followed by civil rights recovery of $80,000, a city employee who abused his position in a similar way was quickly charged with a felony.

Dr. Koziol’s formal request for a federal investigation was discussed personally with members of the Senate Judiciary Committee, some of the same ones featured during the Kavanaugh confirmation hearings. That process alerted the public to our third branch of government which is neither “above the law” nor immune from accountability under our Constitution.

As relevant here, and set out fully in Dr. Koziol’s report, the violations of our federal rights can elevate from civil to criminal status. A key example is “Operation Greylord,” a federal sting operation regarding judicial corruption in Chicago. Also cited in the report, it led to indictments of 93 civil rights violators that included 17 judges, 48 lawyers, 10 deputy sheriffs, 8 policemen 8 court officials and an elected politician. Nearly all were convicted. One judge committed suicide and another died in 2011, one year after his release from prison.

These are the federal criminal statutes relied upon in the Koziol report supporting a comprehensive criminal investigation of his horrific ten-year ordeal:

Title 18, section 242 of the United States Code provides as follows:

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both;

(A)nd if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Title 18 section 241 of the United States Code provides as follows:

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or if two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Free speech, due process, equal protection and the fundamental parenting right were all crucified here. Family Judge Sued in her own Courtroom: Merry Christmas !

It’s true, it happened, a story of for the ages, and spiced with court corruption on steroids. We couldn’t have tried to make this event take place. But it did in a place called the Oneida County Family Court in Utica, New York. And the gift was delivered to Judge Scrooge only days before Christmas Eve, 2017. You’ll need a little background to get your own reward from it.

For those of you who have followed my ordeal as a judicial whistleblower, you know how my daughters, livelihood and law licenses were taken from me due to my conscientious stand against my profession. Judges acting like the children they’re supposed to be protecting went ballistic in retaliation for my exposures of corruption. They did so with no regard for law and ethics. I have never even been charged with a crime or unfit behavior as a parent. 

You also know how the ethics lawyers in the witch hunt against me were allowed to resign quietly by their appeals court employers for falsifying time sheets without any criminal or ethics charges. And you know about the unprecedented 30 plus trial level judges assigned to my originally uncontested divorce of 2006 who were disqualified for various reasons.

They included my custody judge, Bryan Hedges, removed from my case just prior to his admission of sexual abuse on his handicapped, five year old niece. And just when you thought it was safe to come out, along comes today’s feature on Leon Koziol. com, a parental blog site dedicated to exposing corruption in America’s divorce industry.

My recently released book, Satan’s Docket, continues to entertain readers while educating them to the realities of divorce and family courts from a model father and civil rights attorney who spent 30 years in litigation. Today’s shocking story could never have occurred unless I so angered certain judges with my public disclosures that they went ballistic with their retributions and abuses of judicial office. You need to share this with media, organizations and fellow victims not so much for my sake, no one is seriously supporting me anyway, do it for your families and children.

As yesterday’s post reported, I filed a parental equality case in New York Supreme Court. One day after its filing, on December 15, 2017, I was summoned to appear before the 40th trial level jurist assigned to my originally uncontested divorce. That’s right, forty (40). I’m not making this up any more than my pedophile custody judge or his replacement Daniel “Kangaroo” King who allowed a fabricated PhD and Master degree into the record for purposes of imputing false income. He did so for retaliatory support incarceration in 2013 after I reported court corruption before the Moreland Commission on Public Corruption.

Now the name of our latest villain is Natalie Carraway, and I have no idea where this support magistrate came from any more than the security guy did who said she had come to our local family court just for me. How truly “honored” was I. Anyway, four days earlier on December 11th, I had appeared before Kangaroo King’s replacement judge, James “dweeby” Eby of Oswego, New York Family Court. It was a first appearance on my show cause petition for holiday parenting time filed at least one week before Thanksgiving.

Of course, the dweeb had no intention of “granting” me father access to my daughters after nearly 1,500 days removed from their lives. He was assigned by Syracuse Judge James “Bond” Tormey (Morin v Tormey family court “espionage” case) to harass me with every possible abuse of judicial office. The Jimbo twins were determined to discredit my professional reputation and public message of reform at any cost.

After telling me to pound salt, the dweeb was interrupted during proceedings by that security deputy. He came in uninvited and asked this Oswego judge if he could serve me with a support violation petition then set for a first appearance four days later before Natalie “clueless” Carraway. The dweeb replied that it was not Oswego “policy” to allow service of papers in a case not assigned to the presiding judge but because it “may be” policy in Oneida County, he ruled that I was “served.”

We were then excused from his deliberations but I refused to accept service on grounds that I was intending to challenge “service by mail” in the separate support case, a mode of service requested by the “custodial sociopath” Kelly Hawse-Koziol on the face of her sworn petition. Because such petitions feature warnings of arrest and incarceration of up to seven years, that’s right seven years, on their face, I was not expecting “corrective” service by a court deputy assigned to security.

More importantly, I wanted to obtain a ruling to invalidate this unchecked practice of mail service given its clear violation of due process and devastation to victims such as Walter Scott. You might recall him as the unarmed dad in South Carolina shot dead in the back five times while fleeing a child support warrant. His family recovered $6 million for civil rights violations (the latest form of “child support”).

But how could Judge “dweeby” Eby know any of this? He was not assigned to the support case. And now he unwittingly became a witness to the service issue and therefore subject to (yet another) disqualification (always blamed on me, the innocent victim). Of course my adversaries, known and unknown, will endeavor to “sweep this all under the carpet” using every lame excuse possible. Or maybe they just don’t care about “law and order” anymore. We got to get this guy, Leon Koziol, out of the way at all costs, legal or illegal.

To my surprise, the security deputy was still pursuing me outside the courthouse to serve me again with the same papers even after Eby’s ruling that I had already been served. Now how close did this pursuit come to the one which resulted in the murder of Walter Scott? The only thing which separated our fates was the mood and mentality of this sheriff deputy who managed to barge into an unrelated (custody) proceeding and take control of it. Stay tuned! It gets better!

Between the dweeby proceeding and clueless one of December 15, 2017, I had the parties named in my state Supreme Court case served properly with my complaint. I did this with a privately retained process server. We had to travel hundreds of miles over a two day period to serve New York’s top judge in Albany, and judges Eby and Tormey in Oswego (Lake Ontario) and Syracuse. It cost me hundreds of dollars to comply with “the law.”

All that was left to serve in my newly filed lawsuit at our December 15th support hearing was the “custodial sociopath” and Clueless Carraway. We got the sociopath, Kelly Hawse-Koziol, in the court lobby and then my server joined me in the back of the courtroom  before Magistrate Natalie Carraway. She progressed through the usual formalities.

That’s when I learned that my custodial adversary was now represented by her sixth attorney employed by Social Services (while she was earning nearly $100,000 annually as a tenured Frankfort-Schuyler school teacher receiving $45,500 in tax free child support only two years earlier, again under threat of incarceration to a debtor prison).

When the subject of our next appearance came up, I logically raised the mail service challenge and in-court service by a sheriff deputy assigned to court security. But my ordeal never ends when it comes to shocking events. Clueless Carraway informed me from the bench that she had taken it upon herself to investigate the service issue already (before I even raised it at our first appearance now underway).

Magistrate Carraway had secured the transcript of Judge Eby’s custody proceedings at public expense when it was my adversary’s legal obligation to do that at her expense for purposes of proving proper service. More bizarre, Judge Eby would eventually become the appeals judge in her support case and therefore tainted as a biased witness to proper service.

Hey this is New York, don’t try to figure it out. In my lawsuit, I explained why judges and experts could not understand my ten year ordeal, but stick with me anyway. It’s for your own good. You’ll just have to trust me on that. Judge Clueless announced that she was accepting her colleague Eby’s ruling on service while selectively excluding the county policy question which preceded it.

That’s when I responded with the chaos that would follow from her precedent which I was certain that no judge in my (Oneida) county would adopt. I asked Clueless to imagine what our system of justice would be like if any court security deputy could simply interrupt any court proceeding to serve papers for a private party in a separate case. An angry Carraway was unmoved as presiding judge here. And that’s when her world was rocked.

If that was her firm precedent, I asked her to accept service of my state Supreme Court summons and complaint which named her as a defending party by my process server seated in the back of her courtroom. She made me repeat that question as it was evidently beyond her comprehension that a judge could be served by a litigant while deliberating on his case.

But come on man! This is exactly what had occurred to me in Judge Eby’s courtroom four days earlier and she had just ruled that this was an acceptable mode of service. Utterly discombobulated, Clueless Carraway finally replied that she was going to conclude this first appearance and attend to matters in chambers (this was her only case and she was probably intending to consult her assigning judge, James “Bond” Tormey about it all).

But our needless wait in the court lobby for Carraway’s exit had its fateful benefits because the deputy was enticed in the meantime to respond to our casual inquiries about what had just happened. He gradually disclosed that he had been contacted by an Oneida County family court clerk (only minutes after my arrival for Eby’s hearing and Hawse-Koziol’s observed entry into that clerk’s office) to serve papers for someone. Deputy Dummy replied, “sure, why not” while abandoning his security post for this purpose.

Deputy Dummy then confirmed that he had no idea who this service was for and that he was not being paid for it. After all, that would be double dipping and likely the crime of official misconduct inasmuch as he was already being paid a wage for public safety purposes. Making matters worse for him, he also conceded that he was not a part of the Sheriff Department civil division which by law must charge a fee for such private purposes.

I could go on and on, but you probably know where I’m going with all this now. That’s right, the same state Inspector General who caught my ethics lawyers falsifying time sheets. After all, imagine the liability consequences if a violent event erupted in the court lobby while Deputy Dummy was preoccupied, uninvited, in closed proceedings where no one was in danger. Judge Tormey’s chief family court clerk recovered $600,000 just for being directed improperly to conduct “political espionage.”

This was also a nail in the coffin for my state Supreme Court case against Dweeby Eby, Clueless Carraway and James Bond Tormey. Can a better case be made for gender discrimination practiced by those who apply public dollars and special court privileges to give free process serving to a custodial mother while dad is required to pay for his? Shouldn’t we “lock her up” along with all the others who do this?”
