Judge “Rocky” Popeo: the Most Violent, Racist Family Judge in America Today

When viewing this photo, most people see the iconic movie star, Sylvester Stallone, commemorating the blockbuster movie series. Rocky. But in upstate New York, there’s an “Acting” Family Judge who could see himself instead holding that American flag. Meet Judge Gerald “Rocky” Popeo with a build more like that of Rocky’s co-star “Paulie.” Judge Jerry may still come off his bench and wipe that grin off your face if you dare to enter his ring (courtroom)!

“You’re standing there with a grin that I would love to come off the bench and slap off your face”

“Mr. Scully (prosecutor) is playing cigar store Indian at the moment.”

“You know what black people from New York City call black people from upstate New York? Country Niggers.”

According to an ethics judge, these comments were made by Judge Gerald Popeo of the City Court of Utica, New York. In 2015, he was merely censured for those remarks instead of removed from that bench by the New York Commission on Judicial Conduct. Now Fifth District Chief Judge James “Bond” Tormey has elevated him to “Acting Family Judge.” This comes after Judge #39 and Judge #40 were disqualified from my 12 year originally uncontested divorce case.

Welcome to Trial Judge #41, a judicial record by most accounts. You have to believe that Judge Jerry “Rocky” Popeo filling the latest slot was a monumental joke. After all, with the violent threats and racist remarks he was prosecuted for, the last thing you would expect a rational court system to do is appoint him as a family judge. Isn’t that the court where domestic violence is being condemned? Isn’t that where African-American fathers are discriminated most, even shot dead five times in the back while fleeing unarmed from a child support warrant (Walter Scott)? What is Judge Jerry doing here?

Imagine if this wanna-be Rocky treated an African-American father this way? (let’s just call him Apollo Creed). He compares Apollo to a “country nigger” and threatens to come off his bench to “wipe that smirk off (his) face?” When Larry Nassar, ex-physical education director of Michigan State University was facing his sentencing for sex crimes, a father of three victims lunged for him across the trial table. He was restrained by court security but never charged with contempt by the female judge because she understood his rage.

But what happens if it’s the judge provoking violence? What if the litigant in the Popeo case accepted Judge Rocky’s challenge to come off that bench and wack him? Who would court security restrain or taser? We may soon find out as I face this pompous judge next week. Talk about domestic violence, provocation and father discrimination! What was the Commission thinking when it released this judge on his own recognizance to put law enforcement in harm’s way? They have families too. And what kind of coward hides behind them in a black dress when making such threats? (it’s a robe only when the person in it acts accordingly.

I have asked the same Commission in a formal complaint to reconsider its decision in light of the misconduct which occurred by Judge Popeo in my own court cases as a civil rights attorney over the years. There is also an effort being started by a veteran U.S. Marine to make a stand against this sort of discrimination and misconduct due to the vast number of daily suicides occurring to his brothers as a result.

Parents Seriously at Risk: Advocacy Group to Protect Families and Children

The Parenting Rights Institute (PRI) was founded in 2010 as an advocacy group for moms, dads and families victimized by abusive divorce and family courts across the country. An office was opened in New York with a Court Program to assist poorly represented or self represented parties. It featured a seminar lecture and five part reading program with court forms and transcripts to educate parents and prevent serious financial and personal harm. The work of the Institute expanded in the years since. A planning session was conducted at the Plaza Hotel at Central Park in Manhattan attended by lawyers, former judges and parental advocates. In 2011 we conducted a parenting convention at a hotel conference room attended by activists from different parts of the country. Five time Super Bowl winner Tim McKyer was a featured speaker. In April, 2012 we sponsored a lobby initiative in Congress. Two months later, a rally was held at the federal appeals court at Foley Square in Manhattan to support the parental rights case, Parent v New York, presented by Dr. Leon Koziol.

In 2013, Dr. Koziol was among the few selected to give testimony on behalf of the Parenting Rights Institute before the Moreland Commission on Public Corruption at Pace University. That testimony can be found on Leon’s personal website at http://www.leonkoziol.com and it was cited by a lawyer committee in Albany to suppress and censor his reform efforts. Corruption exposed or publicized at the Moreland hearings included Leon’s pedophile custody judge, Bryan Hedges, removed from his case for “political espionage” and from the bench one year later for admitting to sexual misconduct upon the judge’s handicapped, five year old niece. He also exposed fictitious college degrees used by his replacement Judge Daniel King to impose draconian support and custody orders in retaliation.

In 2014, Dr. Koziol participated in a video documentary produced by Dr. Joseph Sorge of Divorce Corp focused on child support abuses, marginalization of parents for profit. These abuses have remained without real accountability and causing taxpayers mounting expenses for their criminal and family court systems. A censorship process was commenced by a lawyer ethics committee against Leon citing the video as its source. That process was vigorously challenged on First Amendment grounds but it prevented him from making a formal presentation at the Divorce Corp Family Law Reform Conference in Washington D.C.

Today we have achieved a record for holding lawyers, judges and family court predators accountable where our political ethics commissions are failing us. We have traveled as far away as Hawaii, California, Nashville, Carolinas, Canada and Paris seeking recourse for parent rights violations. Children are being abused, needlessly alienated and exploited for profit in a manner never seen before in human history. The media is ignoring a growing epidemic at the root of our societal problems, moral decay and worker productivity. Bar associations and special interests anxious to preserve a trillion dollar gold mine are suppressing reform, true accountability and parent advocacy groups such as the PRI.

A documentary published this month by Dr. Koziol and PRI produced immediate reactions from powerful adversaries. Entitled “Family Court Epidemic in Rural America,” it exposed shocking aspects of unmitigated corruption in divorce and family courts which is escalating all over the country. These are plain talk presentations publicized through You-Tube and viral sites everywhere that eventually work their way to the top of Google searches regarding the lawyers, judges and entities we are investigating and exposing. In this way the Parenting Rights Institute has become a citizen’s commission for judicial accountability. We are doing the vital work of those who are neglecting their paid public duties. In short we have become the Judicial Watch or NRA for abused families.

However, we cannot effectively advocate without resources. Currently we refer legal representation to trusted outside attorneys. We would like to hire in-house counsel and investigatory staff to properly assist victims in their individual cases. A professional video crew could bolster publishing efforts while employed to support formal complaints to government agencies. Our goal is to monitor court proceedings, publish books and documentaries and lobby Congress and our courts for reform and proper accountability. We have a petition for writ pending before the United States Supreme Court and are prepared to file another with co-petitioning victims (joiners) from around the country. Indeed we have done remarkable things with a fledgling volunteer staff and nominal donations which cannot keep up with expenses.

These are only some of the strategies underway and detailed in a business plan which is available to potential donors and investors. Accordingly we are appealing publicly to you for help. You may be in a position to join our efforts or invest personally. You may also know of a business, estate or philanthropist who can provide the needed financial support. An Open Letter to Sylvester Stallone and the Expendables in Support of Fathers

Dear Sylvester Stallone:

We enjoyed your movie series “The Expendables.” This open letter builds upon that theme by alerting you to a real life story involving “expendables” in our nation’s domestic relations courts. I refer of course to good fathers relegated to that lower class of citizen known as a “non-custodial parent” and made to exercise an archaic form of parenting known as “visitation.” Such an exercise is more appropriate for prisons and funerals, not children and families.

An insidious trend continues to develop across our country whereby fit and loving fathers are marginalized, alienated and even removed from their children’s lives in order to feed a trillion dollar government industry. This industry thrives on orchestrated conflict, needless litigation and federal incentive grants that reward judges, lawyers and our state governments based on the number and magnitude of child support orders manufactured in these courts. Such orders are dependent upon an unequal scheme of parenting classifications and otherwise threatened by any shared parenting law routinely suppressed by political insiders and bar associations.

It is a trend which requires heroic action of a different kind. I am very respectfully asking you to assemble a team of celebrities in support of a fathers rights cause which could awaken our nation to a serious epidemic with lasting benefits for generations to come. To that end, I have released an extensive report based on my experience as a father and trial attorney which contains an action plan for a fathers day rally in Washington D.C., a writ before the Supreme Court filed the same week and a political action committee which requires financial support. Entitled “We Are Fathers,” it is being shared among high profile figures and the public generally over the viral internet.

I am a civil rights advocate who spent more than 23 years successfully litigating David and Goliath cases on behalf of women, children, minorities and land owners, among other victims of government abuse. When I turned my energies against my profession by seeking family court reforms, an ordeal ensued which reads today like a John Grisham novel. Here is one excerpt from my report which illustrates why my public message, informative website and reform efforts are being targeted contrary to First Amendment protections:

“If you are not yet convinced of the critical need for action and financial support, consider the fact that there are   approximately 300,000 lawyers in the state of California alone with as many law school candidates as there are practicing attorneys nationwide. There is no end in sight to this glut of lawyers entering the market on an annual basis, and the least qualified ones typically end up in family court. This is where apprentices learn their trade and marginal lawyers can instigate lucrative controversy to last an entire career. It begets a host of forensic additions to the mix by request or court order, including psychologists, law guardians and social workers, all in the business of dictating how our children are to be raised on vague, conflicting or utopian standards.

Accountability is as nonexistent as the number of malpractice cases arising in these tribunals. In the medical profession, a surgeon who performs needless operations for profit is discovered through an objective review process. In family court, when a lawyer performs a needless hearing for profit, there is no similar review, no real measure for competent performance. The all-encompassing child’s “best interests” can be satisfied by any half baked participant, and parental alienation is a damage claim that is typically non-recoverable. If you are a person who has not yet been harmed by this system, you pay the price for it in taxes and social costs at the very least.”

Exactly three years ago, actor George Clooney staged a protest in front of the Sudan Embassy in Washington D.C. to bring world attention to the hunger and homeless plight in that east African nation. Here in the states, homeless fathers are being manufactured by an unjust system, and we are merely asking for your support and participation. If you could manage to assemble action hero fathers to produce three blockbuster films, you can become a more profound hero for the ages by doing the same for this vital cause. We fathers have faithfully supported your celebrities: Bruce Willis, Arnold Schwarzenegger, Chuck Norris, Jason Statham, Dolph Lundgren, Jet Li, Jean-Claude Van Damm, Terry Crews, Randy Couture and Mel Gibson and others.  Now we need your help.

I will conclude this public appeal by asking all fathers and their loving families to contact these celebrities directly or through their agents to invite greater public support. I will also reiterate a quote taken from a Bruce Willis movie, Tears of the Sun, and an excerpt from my report relating to military and public safety victims:

“The only thing necessary for the triumph of evil is for good men to do nothing.”

     “And so, while our federal government escalates its military involvement around the globe, soldiers are returning to empty homes, child alienation and felony support warrants. I was able to save the life of one such victim from attempted suicide at a parenting convention we sponsored in 2011, but the unsuccessful instances are more telling, see i.e. Purple Heart’s Final Beat, Second Class Citizen.Org (2009). Father discrimination may be the convenient scapegoat for politicians seeking to advance themselves, but as President Calvin Coolidge is quoted: “A country which forgets its defenders will itself be forgotten.” This message resonates as well with our domestic defenders. Virtually all responders on 9-11 were men entitled to equal treatment under the law. Yet an unpublicized number of fathers became eternally separated from their children and families without any changes to these laws as construed and enforced by our courts.”
