As promised at our national Parenting Rights Convention held in upstate New York on April 15-17, 2011, a Report has now been completed for review by attendees, supporters and various government agencies. Issued in the form of a formal “Complaint” filed this morning with the New York Commission on Judicial Conduct, copies are being furnished to the U.S. Justice Department, United Nations, legislative leaders and various human rights organizations. We expect to complete this process on June 17, 2011 in Washington D.C. (Father’s Day weekend).

A copy of the 25 page “Complaint” is available for viewing at www.leonkoziol.com. Copies are also being sent to our followers. It incorporates the testimony and contributions of those who attended the April convention. However, names and personal details were excluded to protect the participants from retaliation in their private litigation. Instead civil rights advocate Leon Koziol, J.D. employed his own experiences with references and recommendations common to “similarly situated parents”. The Complaint easily shows why reform is not going to occur from within.

This “Complaint” has immense practical value as a free information product for those victimized by domestic relations courts around the country. We parents are experiencing an epidemic in state control practices over our private affairs and exploitation of innocent children for profit. This document should be shared everywhere as a personal defense resource. It can be used to better understand the Family Court environment and as a tool for evaluating the performance of costly legal representation. In addition, it may serve as a background piece for seminars and public assemblies given the complex nature of these court processes. If this Complaint can save a parent-child relationship from abuse or demise, it will be well worth the sacrifice made by its author and sponsor. On a related note, a 45 page opinion was handed down in federal court in a case filed by Leon Koziol on behalf of “parents similarly situated” in “Parent v State” and its consolidated member case “Koziol v Lippman”. Originally filed on February 26, 2009, this challenge to abusive custody and support laws was held up for two years on a court issued ruling which raised the Rooker-Feldman doctrine as a bar to federal court jurisdiction. Younger abstention was also raised, among other obstacles, by the many law firms defending this action.

Although the claims were dismissed, the jurisdiction obstacles were overcome. Unlike countless other challenges around the country, this court took jurisdiction over the state court issues, giving others a precedent for accessing federal court to raise constitutional questions. The adverse components of this ruling are now being appealed to the U.S. Court of Appeals in New York City. A expedited motion for exigent relief will be filed there at the Foley Square courthouse on Friday, June 17, 2011. We will keep you informed as you remain cognizant of the uphill battle we face. To put this in perspective, father’s rights cases feature a 100% failure rate in our nation’s history. Then, in the usual manner, our politicians wonder why we face so much father absence and moral decline in Father’s Day speeches.

Equal Rights Alert

This is a public call to all women who support equal treatment under the law. Civil Rights Advocate Leon Koziol, a former practicing attorney who has won gender, race and sexual harassment cases during a 23 year career, is seeking your signature to a petition for a meeting with Barack Obama. He is seeking equal treatment for fathers in childrearing decisions in our domestic relations courts. Like the women’s rights movement which could not have succeeded without men supporters, he is confident that he can rely upon women of good conscience to join him in this call for reform. President Obama’s first act signed into law was the equal pay amendment to the Civil Rights Act of 1964 and appointments of two women to the United States Supreme Court. We hope Obama is not a hypocrite and will do the same reform for the other half of America’s parenting population. Dear Mr. President:

The capture of Osama bin Laden stands among the greatest achievements of your administration. Today our nation learned of an upcoming speech in which you will seek to build upon this success. As I understand it, you will now promote democracy by revolution in Arab countries.

As a civil rights advocate who practiced law in New York for more than 23 years, I am asking you to reconsider this course of action. I invite you to focus instead upon a side of America you have evidently overlooked. It is one that our soldiers will face if and when they return home.

Good fathers are being systematically removed from their children in domestic relations courts around our country through discriminatory laws which support a multi-billion dollar government industry. It is a form of oppression where innocent children become the hard victims.

It works simply like this: declare the state to be the parent of the people, pass laws which promote controversy among families, and lawyers will take over to promote government jobs which our taxpayers cannot afford. I call it the state’s “Custodial Institution of Childrearing”.

This institution has taken over more than half of America’s parenting population through “custody” and “support” regulations which infringe upon all manner of family privacy. Parents are influenced to fight over their offspring in public forums reminiscent of the Roman Coliseum.

It is certainly not a new concept. In Mein Kampf, Adolph Hitler observed that if the state can make the people believe it is acting in the best interests of children, they will “happily” give up their rights. Your secretary of state once declared that “it takes a village” to raise our children.

This kind of socialist philosophy has not only been proven a world failure, but it goes against everything embodied within the American Constitution. Our Supreme Court has repeatedly declared the parenting right to be “the oldest liberty interest” protected under our laws.

In that vein, your victory speech caught my attention. You stated that we were a nation committed to “equal rights” and that we could accomplish anything we set our mind to. I could not reconcile this with the severe prejudice against fathers which is so accepted here.

The Census Bureau continues to report that roughly 85% of all parents paying “child support” are men. Women obtain custody in 80-90% of contested cases. Yet men are not so incompetent to engage in “shared parenting” any more than they are to share in the defense of our country.

This all brought me back to a day in 2008. I was one of your earliest supporters. Senator Clinton had dominated the primaries in upstate New York and you declared on Father’s Day that we needed to get men to step up to the plate, all the while ignoring what our states had done to them.

It was then that I knew that the problem of fatherless children would grow exponentially and, of course, it did. Separated parents are now the mainstream in America, and fathers are remanded to a lower class of person through antiquated laws which maintain a separate but unequal doctrine.

Under Title IV-D of the Social Security Act, the states draw revenues based on the number and magnitude of “child support” orders mass produced in an institution hypocritically called Family Court. If you can get more parents to fight, you can make more money, simple as that.

It is a scheme which exploits a rule of nature. Good parents will sacrifice everything to maintain their offspring whereas bad parents generally avoid responsibilities. In the custodial system, all separated parents are lumped together and forced to prove their fitness to the state without cause.

This “winner takes all” contest enables one parent to “tax and destroy” the other for reasons unrelated to the child. Formula driven welfare checks euphemistically known as “child support” are based not upon a child’s needs but upon a victor’s highly contentious “way of life”.

This formula has communist overtones with waste, decadence and child disincentives which can lead to lawless behavior. Outcast fathers, constantly on the defensive, are paying for the process which seizes their children through diverted “child support”. Even Hitler was not this creative.

Inevitably these American citizens face a debtor’s prison when they cannot balance tax, credit and support obligations in hard times. It is far from a hero’s welcome for our returning soldiers as the courts routinely find that they can earn more than they are capable with their “war skills”.

In New York, our judiciary sued the other branches of government in its own courts for pay raises. Of course this was a violation of powers, but the obsession over money is finding its way in childrearing decisions contrary to a neutral design under our state constitutions as well.

Police, fire and emergency crews, such as those responders on 9-11, face the same treatment as our war veterans do under these abusive laws. In my small home town, a police investigator took his life and that of his ex spouse, leaving his children without parents after “child support” court.

Not long after that, a woman took a knife to her husband’s throat, a father shot his boy in front of police during a domestic standoff, and a purple heart soldier attempted suicide rather than continue a prison sentence on a support debt. That’s a lot of needless carnage for a civil society.

You might wonder how a once prominent lawyer, office holder and candidate for congress could survive a one man battle against his profession. After 23 unblemished years, a group of lawyers and judges combined to suspend my practice, a small sacrifice compared to those in mind here.

This retaliation began on the same day as arguments were being made in court similar to those found here. Last I checked, Mr. President, the judicial branch was still a part of our American form of government subject to the same First Amendment rules that you and the rest of us are.

Such rules are invaluable to a free society. This letter illustrates how government is losing the forest for the trees on issues ranging from the economy to doctors’ care. Our talents, health and productivity are being lost to a litigious system focused on the ever elusive child’s best interests.

You have proven that we have come a long way since the Dred Scott decision. Here we find a white civil rights advocate petitioning a black president for equal rights. Yet it is much more than that. A father is asking another father to help preserve future generations of Americans.

On Father’s Day Friday, June 17th, I plan to file a writ in the Supreme Court challenging the suppression of my liberties by New York’s court system. My ordeal may be compared to that of Chinese lawyer Gao Zhisheng, reunited with his children only after giving up his civil rights.

I hope to be joined at that time by victims and families of these oppressive laws to deliver this letter personally to you at the White House. Until then, I am asking supporters nationwide to consider publishing it in the media, internet and public venues. Thank you for your time.

A Meeting With the President

That’s the theme and goal behind a rally scheduled for June 16, 17 and 18, 2011 at the nation’s capital. Building upon momentum and ideas generated at the strategy session of this past weekend’s Parenting Rights Convention, this rally is designed to gain the attention of the president so that parenting authority can be returned to the people consistent with fundamental rights retained by them under the United States Constitution. The selected period is Father’s Day week Thursday thru Saturday for the reason that fathers comprise a discriminated class made subject to oppressive laws. Our government has managed to use our children to resurrect debtor prisons and child taking processes without due process of law.

Three years ago, candidate Obama exploited Father’s Day to focus upon absentee fathers rather than the money oriented processes which promoted their existence. The problem with our approach to this political exploitation is that we do not set our goals high enough for meaningful reform. Instead of D.C. family festivals, local protests and keyboard wars (useless computer exchanges to each other in the convenience of our homes), we need to take a meaningful stand where we can be truly heard and seen. We must sharpen our focus upon the core problem of child abuse by government, its relentless assault upon our assets and hard earnings, and its instigation of needless controversy among parents and their children.

Cooperation for the sake of the child is central to our mission. Children need both parents in their lives and it is high time that we remove the lucrative barriers to this optimal environment for childrearing in domestic relations courts. We can continue to fight in our local foxholes, frustrate ourselves with endless court battles, or we can take back our children in Washington D.C. It may be that our president will find himself too busy with new wars overseas which take more fathers away from their children, but our meeting will occur even if it means a message delivered to the front lawn of the White House. In the experience of our sponsors, a constructive message may consist of a lobby campaign in congressional office buildings and a profound presence of parents on the walkways surrounding key government centers. Even if this results only in meetings with underlings and media, it is much more than anything we have seen to date on the reform horizon.

A meeting with the president is important to change the mindset of this nation and government’s escalating intrusions upon our privacy rights in childrearing. By June 1, 2011, we hope to have a committee of delegates named for this proposed meeting. There is no set standard for selection, however, certain constituencies should be represented. Among them are veterans, law enforcement, African-American fathers and mainstream parents made subject to inferior “non-custodial” classifications. At the Parenting Rights Convention this past weekend, it was generally agreed that such a rally was timely and do-able because the issue was urgent and children should not suffer another day without their moms or dads.

As things develop, we will keep you informed on this rally. Feel free to contact us with your interest and ideas. It is expected that a single hotel will be identified for organizing, lodging and workshops and self representation seminars. You need to make plans now for this event. Profound Reform Expected From This Weekend’s Convention

As devoted parents and concerned citizens, we’ve complained for too long. Government continues to ignore us. They’re making too much money on our children. Action is therefore the only answer. The time has come to get the state out of the “child business” as one Family Court put it. We must demand reform and that time is now.

Momentum continues to build for the first ever National Parenting Convention at the Hotel Utica this weekend in upstate New York. Media coverage and exclusive interviews with celebrity speaker Tim McKyer are introducing the event to the public. Nationwide coverage will depend on the creative energies of each and every follower and advocate we’ve managed to reach since this Convention was first announced in November, 2010.

There is no room for excuses, no more apathy or laziness. These children are our children and our priority. However, to reiterate our rights to rear our own children, to participate meaningfully in their lives, and to remove oppressive barriers upon our liberties, we “must be seen before we can be heard” under an American form of government. The Supreme Court has described our parenting rights as the “oldest liberty interest protected under the Constitution”. Unless we act, we will lose that right. At least one Justice is already seeing to this.

At the Convention, you will be heard, you will learn how to protect yourself, and most of all, your children will be made proud. They will one day know when mom and dad finally declared “enough is enough”. In 1848, a group of 100 men and women came together at the first National Women’s Rights Convention at nearby Seneca Falls, New York. Three Time Super Bowl Winner to Speak at Parenting Rights Conference

It’s Official!!!

Three time Super Bowl winner Tim McKyer will be speaking at the Parenting Rights Convention to be held at the Hotel Utica in upstate New York on April 15 – 17, 2011.

Tim is a former professional American football player who was selected by the San Francisco 49ers in the third round of the 1986 NFL Draft. A 6’0″, 174-lb. cornerback from the University of Texas at Arlington, McKyer played in 12 NFL seasons for 7 different teams from 1986 to 1997. McKyer prepped at Lincoln High School in Port Arthur, Texas.

His best year as a pro came during his rookie season with San Francisco, intercepting 6 passes for 33 yards and 1 touchdown. He was an All Pro Corner for 2 NFL seasons and was named to the “All Madden Team”. During the Carolina Panthers inaugural season, he intercepted a pass and scored on a ninety-six yard interception run for a touchdown to defeat the Super Bowl Champ San Francisco 49ers. A three-time Super Bowl winner with the 49ers in 1988 and 1989 and the Denver Broncos in 1997, McKyer became a journeyman throughout the 1990’s, bouncing from team to team until he ended his NFL career after the 1997 season. Though he is most likely remembered for giving up the game winning touchdown to Tony Martin in the 1994 AFC Championship Game while with the Pittsburgh Steelers. The touchdown allowed the heavy underdog San Diego Chargers reach Super Bowl XXIX in one of the biggest upsets in AFC Championship history.

Tim Mckyer is an advocate for Fathers rights. He actively speaks at engagements around the country and has been instrumental in lobbying state law makers for more Pro Father legislation.

Parenting Rights Convention Set for April 15-17, 2011 in Utica, NY

EVENT TO FEATURE THREE TIME NFL SUPER BOWL WINNER,  CONSTITUTIONAL  RIGHTS  ATTORNEY,  PURPLE  HEART  SOLDIER  AND REFORM  LEADERS.

All parenting groups and child advocates are invited to attend the first ever Parenting Rights Convention to be held at the Hotel Utica in upstate New York on April 15 – 17, 2011. Friday evening will feature a social “meet and greet” at 7 pm followed by a morning brunch and open hearing beginning at 2 pm on Saturday. At 7 pm the same day, a planning session will occur among group leaders and activists behind a rally at the nation’s capitol later this year. A strategy meeting will conclude the weekend on Sunday at 1 pm.

The Saturday hearing is the highlight of this convention. Guest speakers will be followed by an open microphone period to receive testimony from attendees, victims and group leaders. Civil Rights Attorney/Advocate Leon Koziol, J.D. is expected to consolidate presentations into a formal report to be submitted to the President, U.S. Justice Department, Secretary of Health and Human Services and select members of Congress. Copies will also be made available to attendees for distribution to state governments across the country.

The goal of this convention is to secure the fundamental right of parents to raise their own children free from undue state interference and to promote fair and meaningful parent-child relationships in separated household settings. The agenda will focus upon a full range of constitutional rights being lost to oppressive child control laws, draconian money collection practices, gender discrimination and the criminalization of mainstream “non-custodial” parents.

This Convention was first announced in November, 2010 and is being sponsored by the Parenting Rights Institute. Planning sessions were held at the Plaza Hotel in New York City on December 26-27, 2010 followed by weekly nationwide teleconferences in January, February and March, 2011. Once again, it is important to emphasize that this Convention is designed to make a profound statement and promote a united stand against divorce and family court abuses in our states. All constructive ideas and assistance are welcome. This is your opportunity to finally be heard and become a part of nationwide reform.
