The Child Support Crisis: What you need to know about draconian enforcements

Just shut up and pay YOUR child support! It’s a familiar insult which presumes that only one parent has any such obligation and that both parents cannot be trusted to set up their own arrangements free of state supervision. Given the complex society of today, the better assumption is that the state is ill equipped to raise our children and that a nation founded upon a limited government will no longer tolerate its abuses of power.

The euphemistic term “child support” has been conveniently exploited to build a giant bureaucracy focused more on revenue generation and service fees than the “best interests” of our children. Just place the child on top of the state tank and you can crush the rights of the people, even convincing parents to “happily” surrender the ones applicable to their offspring. It’s a tactic used by Adolph Hitler to build one of the greatest war machines in history.

Widespread declines in moral, family and religious values can largely be traced to this surrender. The word combination “child support” has been effective in drowning out the truth about a corrupted process that invites self-serving jurists to tread increasingly upon our most basic rights. These include our fundamental liberty interest in childrearing, Troxel v Granville, 530 US 57 (2000) and guarantee of procedural due process, Turner v Rogers, 564 US 431 (2011).

An ominous dissent in the latter case by Justice Clarence Thomas should have all of us alarmed. He bucked the court’s majority by declaring that the due process safeguards required of a support contempt proceeding undermine the state’s interest in a more vigorous enforcement process. This represented a grave departure from reality when taking a deeper look at the draconian enforcement practices that have caused joblessness, homelessness and premature deaths among support debtors.

Such practices have not only “undermined” support capacities, but they have forever ended “child support” in countless cases. Three exemplary deaths over the past decade, Joe Longo, Thomas Ball and Walter Scott, are all that is needed to show the absurdities of the Thomas opinion. Taken together with other victims, it is clear that we have an epidemic underway, one that “shocks the conscience of a civilized society” in violation of substantive due process as well, Rochin v California, 342 US 165 (1953).

Government today is actually manufacturing bad parents through its “custody” and “support” mandates under Title IV-D of the Social Security Act. This is the federal funding law that rewards courts by the number and size of support orders they issue and satisfy. Apart from the inherent bias that this has created, the imbalance has yielded a crowd of silent or walking dead, victims of murder, suicides, false charges and domestic violence, others that await justice that never comes.

Police Investigator Joseph Longo was so traumatized after exiting support court that he used a common kitchen knife to commit a murder-suicide at the former marital home. It left four children without both parents and taxpayers with a $2 million lawsuit debt, Pearce v Longo, 766 F. Supp. 2d 367 (NDNY 2011). The court predators kept pounding him with protection orders, support intercepts and career damage without considering the breaking points of their targets.

Then there’s Thomas Ball, victim of an overzealous child protection agency who sat down one day on the steps of a New Hampshire courthouse to protest family court abuse. But this was no sit-in, no “occupy court” mission. He poured gas over his head and burned himself alive. We cringe at the extreme pain he must have suffered before and during this holocaust. In the end, there was no national coverage, no court reforms, they merely washed his ashes into the sewer.

Finally we bring you Walter Scott, a black father shot dead five times in the back. He was killed, unarmed, by a white cop while fleeing a child support warrant at a traffic stop. Unlike other BLM victims, this one was not involved in any criminal activity. It was a civil debt, and our government was now killing for money. This obvious fact is never mentioned in the ongoing George Floyd protests because “child support” is the holy grail for feminists and man-haters.

Even in necessary cases involving absentee parents or public charges, there is little or no accountability for tax-free, support checks used for drugs, partners or vanity excesses. Most contemptuous are the cases where child support is exploited as a tactical weapon for a custody award that inevitably leads to severe parental alienation. Here the one dutifully paying “child support” is, in reality, paying the state to take his children away. Even then, sadistic alienators are not satisfied until their children are brainwashed to hate the other parent.

This author’s ordeal is one such case that features a high school teacher, Kelly Hawse-Koziol.

The easy way to avoid this “inconvenient truth” is by detracting from it, i.e. “Just shut up and pay YOUR child support.” Support judges say this without mouthing the words by trashing procedural protections and crafting evidentiary substitutes to expedite a desired outcome. Examples are too numerous but include such fictions as “imputed income” and a substandard level of proof. This star chamber process ignores the right of a “noncustodial” parent to finance a separate home for the same children. It also ignores the horrific collateral harm.

Nowhere is an accounting made of the working parental arrangements upended by this custody and support mandate found in the funding laws.

Such collateral harm does not discriminate. It includes a white mom who drove her children into the Hudson River rather than surrender to a custody and support order. A similar derangement caused another to heinously murder her two-year old girl resulting in a conviction and jail term that will never bring back the child (see Gabriella Boyd Foundation). A black mom in Philadelphia went further. In an overnight rage, she purchased a gun and killed both her children and their dad.

The child victims are particularly heart-wrenching. There’s Kyra Franchetti and Thomas Valva whose young lives were lost to mentally disturbed fathers. An Albany (NY) Times Union story on October 13, 2020 revealed that a child protection agency suppressed 725 child death reports over a decade. This is shocking but not really when considering Governor Andrew Cuomo’s suppression of nursing home deaths currently under investigation. Such tragedies omit the live victims torn apart by court proceedings needlessly protracted by greedy lawyers.

This author was subjected to a sixteen year battle over “child support” which induced the “custodial” mom to brainwash his precious daughters in relentless fashion. This went unheeded by the courts despite the lack of any abuse report or unfit finding and despite father-daughter experiences that would be the envy of most children. Over 40 trial level jurists were assigned to his family proceedings with many removed for misconduct, a national record by most accounts and the price to be paid by a judicial whistleblower.

This is not just a public policy issue or a lack of judicial accountability. It is a growing crisis that has caused more deaths than the coronavirus pandemic. It was the theme of our 3-day Parent March on Washington in 2019, a peaceful protest featuring a lobby initiative, expert speakers, a march down Pennsylvania Avenue under police escort and a concluding vigil for those lives lost to this unjust system. Its goal was to obtain congressional hearings and a Justice Department investigation. But it achieved nothing, only more evidence for BLM to justify violence. Peaceful reform is no match for the gold mine which this system has viciously protected.

Justice Achieved for George Floyd but not Walter Scott, shot dead unarmed in South Carolina fleeing a child support warrant

Only hours ago from the time of this publication, a jury in the Derek Chauvin murder trial found the defendant police officer guilty on all counts for the death of George Floyd on May 25, 2020. A 9-minute video of this murder left no doubt that justice had to be done for a horrific, racially charged incident witnessed the world over.

However, while protesters and family victims applaud the outcome in Minneapolis today, a highly contrasting one must be recalled in the murder trial of Michael Slager in 2016. He was a white police officer who shot another black man, Walter Scott, dead five times in the back while fleeing, unarmed from a child support warrant discovered at a traffic stop. It occurred on April 4, 2015 in North Charleston and was caught on camera by a concealed by-stander.

That horrific video, like the George Floyd one, also went viral worldwide and touched off a wave of protests across the country. Despite all that, the murder trial resulted in a hung jury after a single white juror claimed he could not “in good conscience” join the other jurors in a unanimous guilty verdict. It was a sad outcome no doubt influencing the much wider protests and anxiety surrounding the Derek Chauvin trial five years later.

Fortunately with justice denied in a South Carolina state court, justice was ultimately achieved one year later in federal court when Michael Slager pled guilty to multiple counts resulting in a 20-year sentence. The family had previously recovered a $6.5 million civil settlement in connection with the same incident, yet these events did little to avert the carnage which followed in multiple locations.

When these racially charged murders are chronicled in various reports, Walter Scott is often omitted. Child support injustice is never addressed. Yet this victim was not chased down and killed for the commission of any crime. He was gunned down because he was unable to satisfy a money debt. But because child support is the holy grail for feminists, that crucial element is downplayed. Is our government now killing for money? It is a further sad commentary on the draconian enforcement practices that have also killed countless parent-child relationships.

Indeed, in my home town of Utica, New York, a police investigator exited child support court in September, 2009 after his guns were confiscated, protection orders were issued and his career permanently tarnished by a divorce needlessly inflamed by such practices. He promptly entered the former marital home to commit a murder-suicide through the use of a simple kitchen knife, leaving four children without a mom and dad. The family obtained a $2 million settlement against the taxpayers in the case of Pearce v Longo, 766 F. Supp.2d 367 (NDNY 2011). Yet no one blamed the family court system and, to date, no reforms have occurred.

Diverse victims and the public generally rely on qualified civil rights attorneys to expose judicial corruption. They comprise a tiny group yet to be acknowledged as judicial whistleblowers. This is because retaliation is severe and common. As one such victim, I issued reports, exposed clear misconduct, filed precedent-seeking cases, and sponsored reform efforts across the country. At the Walter Scott funeral I addressed national media, Al Sharpton and Congressman James Clyburn regarding the needless conflicts caused by federal Title IV-D funding. My efforts were rewarded by severe harm to my health, law practice, and father-daughter relationships.

Court Corruption is Promoting Lawlessness and Violence

It’s bound to happen. Some day soon, a falsely accused, financially abused or wrongfully incarcerated parent is going to unleash on some judge, law office or family member to bring overdue attention to an ever growing level of corruption in our nation’s divorce and family courts. Until the perpetrators of greed and back room deals are made to feel like the victims they create, this corruption and its suppression from public knowledge will continue unabated.

The signs of it are everywhere: a police investigator in Utica, New York committed a murder-suicide after exiting support court leaving four children without parents. In one news report, the local district attorney remarked that he had been dealing with that officer on the morning of his killing in a routine way. He even described him as unusually jovial, nothing that could offer any sign of pending disaster.

Years later, the best they could do to prevent such horrific violence is to start a fundraiser against domestic violence. Of course, that will change nothing. Indeed violence is on the rise in countless ways, most of it suppressed from public knowledge because the preventers are focused on the leaves and branches as opposed to the root of this crisis.

That root is court corruption fueled by greed, politics and lawyer-induced conflict for profit. And this corruption is rampant not only because of protected misconduct but also a giant structural flaw in the court process. We have an antiquated child custody system in the vast majority of states which causes parents to fight needlessly over their children. Shared parenting is opposed by the bar associations, drug companies and other special interests because it is not lucrative and would result in a virtual elimination of federal Title IV-D funding to the states.

And so the carnage continues in the form of violence not only among the court combatants but also among children and fatherless teens who have little or no moral fiber. They’re now shooting up our schools while outraged victims again focus on the wrong cause in the way of repealing our Second Amendment right to bear arms. We have a society degenerating to a barbaric form like we have never seen before. More than ever in modern times, we the victims must therefore protect ourselves even from our own government. That was the primary reason for this Amendment.

When Thomas Ball burned himself alive in front of a Keene County, New Hampshire courthouse, he was protesting father discrimination and CPS abuses. He even left behind a manifesto on how to incite a revolution through the use of such easy-to-make weapons as a Molotov cocktail to throw into court buildings and government offices. In the case of police investigator, Joseph Longo, it was much easier. After they confiscated his weapons, issued all the usual protection orders and finished off his career reputation, Joe simply resorted to a common kitchen knife, and it cost the City of Utica $2 million in wrongful death recovery for the children.

Seriously? What else did they think the city could have done to prevent this travesty? Or is this just the latest form of child support? You might think so after another police officer killed a parent but in a more shocking way. An unarmed African-American dad fleeing a child support warrant at a traffic stop in South Carolina was shot dead in the back five times by a white cop. It was not racist as much as it was father abuse because the murderer’s black partner who came upon the scene moments later simply cuffed the dying dad without performing any CPR. It was all captured on a by-stander i-phone in 2015. The children of that victim, Walter Scott, recovered $6 million from the City of North Charleston.

Still the carnage escalates along with corruption. Our Census Bureau continues to report that nearly 85% of all parents paying child support are men. One out of every five people on countless warrant lists are child support debtors. Nearly all are fathers. Twenty-two veterans are committing suicide each day, a vast number of which are influenced by divorce and family judges. If those were employment statistics for women, they would be rioting all over America.

So why has no politician or news organization declared the blatantly obvious War on Fathers? The result of society’s inaction and father persecution is violence on an ever hideous scale. Many would call it self-defense to an oppressive government operation. Debtor prisons? Custody “wars?” Lawyer induced perjury and false accusations? In my two decades as a trial attorney and another one as a victimized dad, I have reported bribery, overlooked misconduct and caused the removal of nearly 40 trial jurists from my originally uncontested twelve year divorce, a judicial record by most accounts. Yet not one court has made mention of this in its decisions.

Perjuring mothers suffer little or no consequences despite the clear crimes being committed while “dead beat dads” are being locked up for non-criminal money debts for six months, and as much as seven years under federal non-payment laws. These are longer than countless sentences given to violent felons. How much more can a discriminated class of parents sustain before it acts out? In the case of Investigator Longo, I described his reaction as a product of a dysfunctional, senseless and abusive child control system. When he could obtain no fair ruling from our courts, he took the so-called “law” into his own hands and issued his own ruling of sorts. It was a final one with no right of appeal.

Why is the horrific murder of a loving dad for child support being ignored by the media and government?

I was born on Easter Sunday, just before dawn, and although I never bothered to  verify it until decades later, the date and time proved correct on my certificate. I was also born to be a dad, and that made my daughters possible. Although I wished them a Happy Easter today, as usual, I got no reply.

It’s been like that for years. Never found to be unfit as a parent, subject of any agency report or charged with any crime, the years spent with my girls as a “noncustodial parent” (due to my male birth status) were filled with events to make any child envious. Trips to Manhattan, the ocean, our nation’s capital, lakes, skiing, climbing and school events comprised only some of our experiences without incident. I built them a playground on my two acre property that rivaled our finest local parks.

Then their “custodial parent” decided that they should have a new father, someone she admitted to be pursuing strictly for his wealth. And the many custody judges assigned to my case, including removed pedophile family judge, Bryan Hedges, made no mention of this illicit agenda for over ten years. Instead, one who frequented a bar with his children, Daniel King of Lewis County Family Court, placed bizarre conditions upon me such as “prohibited alcohol related gestures” (a wedding toast) to make continued father-daughter relationships impossible.

They could find no reliable proof of unfit parenting so they simply made things up and any attack on my reputation to discredit the reform message and court corruption I was publicizing across the country. So intense was the legalized kidnapping that the wealthy substitute dad actually tried to run me over with his Cadillac last summer. It was witnessed by a bar manager who happened to be near the sidewalk I was crossing the street toward.

We live in a world today dominated by money. It can buy judges, lawyers and politicians. Anyone so naïve to believe otherwise should look up the many bribery and extortion cases coming out of divorce and family courts, judges like ex-New York Chief Judge Sol Wachtler, Gerald Garson and Thomas Spargo sent to federal prisons. And they are only a few of the ones who actually got caught.

But you can learn all about that in my recent book, Satan’s Docket: Corruption and Carnage in America’s Divorce Industry. Today’s holiday post is focused on a far greater crime, this epidemic sweeping across America as part of a New World Order to take control of our children. It is being accomplished through an antiquated “custody” system mandated by federal Title IV-D funding laws.

Like the drug industry, this epidemic has turned our courts into a trillion dollar industry while transforming cooperative parenting into lucrative war zones. It has also produced fatherless children like the one in Parkland, Florida, who decided one day to murder fellow classmates just for kicks. My own ex-wife lacks all moral compass when lying repeatedly under oath to the glee of corrupt judges anxious to exploit her stupidity to avenge my public criticisms.

And that brings us to Walter Scott. You may remember him as the unarmed father shot dead five times in the back by a psycho cop near Charleston, South Carolina while fleeing a child support warrant at a traffic stop. Our government is now killing for money and resurrecting debtor prisons using our children as justification. Adolph Hitler explained this agenda in his famous book, Mein Kampf, i.e. if you can get the people believing that you’re acting in their children’s “best interests,” they will “happily” give up their rights.

Walter Scott is solid proof of this agenda for all the unbelievers. I spoke out at his 2015 funeral before national media to emphasize that this was not so much a race crime as it was a gender crime, one targeting dads and the destruction of fatherhood in America. After discussing it with a New York Times reporter and appearing on the Charleston evening news, I got some mainstream media traction, especially when the funeral pastor preached the same conclusion I did.

Walter Scott’s murder, captured on an i-phone by an unseen by-stander, was, by far, the most horrific one in the Black Lives Matter crusade. Unlike the others, Scott was unarmed, he raised nothing resembling a weapon, and he was running from a money debt not any criminal act. Worse yet, Title IV-D state court revenue was among the objectives of the arrest warrant resulting in his murder.

Despite all this, time and again, when the national media recites these murders, Walter Scott is notoriously absent. No doubted calculated to protect the money trail, this practice resembles incidents like the Selma, Alabama anniversary march with George Bush cropped out of a New York Times photo or the television reporter, who never was, claiming to be flying in a helicopter over Iraq during a news feature. Walter Scott is purposely omitted because it raises the taboo subject of father discrimination and draconian law enforcement practices that threaten the New World Order.

In a March 31, 2018 front page story in the New York Daily News, a series of black victims are named in civil rights history ending with Trayvon Martin. Walter Scott is not among them. Again, today, in an Associated Press story by Corey Williams carried nationally, a summary of recent black murders is given. Still no mention of Walter Scott. Lawyer Benjamin Crump is featured in that story because he has been assisting victim families to get monetary compensation. The largest of these to date is the family of Walter Scott which recovered $6 million. So why was it “cropped out?”

The war on dads is very real. I may be among the most profound examples of this given the inhumane retributions I sustained as a result of my parent equality crusade across the country. As a prominent civil rights attorney who obtained jury verdicts and six figure recoveries for civil rights victims, including white landowners and sexually harassed women, these witch hunters can discredit my public message using the mother of my children as their stooge, but they can never take away my accomplishments.

As I look back on these past ten years of persecution, I often come to the conclusion that my sacrifices have been in vain. No one donates, few show up at our rallies, and keyboard warriors prefer the comfort of their private homes. Accordingly the epidemic grows, and the day is destined to arrive when some victim will explode to take horrific action at some courthouse or law office. Thomas Ball nearly did exactly that before burning himself alive in front of a family court and leaving behind a cryptic manifesto.

While I have done all I could to prevent such a holocaust, I have moved no mountains. After a record 40 trial judges were disqualified from my originally uncontested divorce, a racist judge who makes violent threats from the bench has now been assigned to finish me off as an “Acting Family Judge.” My website has been highly censored and I can recite little progress. If any, it has occurred among individual cases only. Occasionally I get inspiration from a friend, family member, stranger, caller or even a cleric, one such as Reverend James Forbes, the “Martin Luther King” of Manhattan.

However, on this Easter Sunday, a Christian celebration of resurrected life, I got some unexpected inspiration from a pastor at St. Paul’s Church in Whitesboro, New York. I cannot deliver it as eloquently as he did, but I would like to share it with you, especially all those who have stayed in the fight against the odds for so many years. You know who you are. The sermon goes something like this:

One day God directed a man to move a large stone by pressing against it each day with all his might. After months of doing so, the man grew weary. He had not moved that giant rock a single inch and began to accept the reality that he never could. Satan therefore intervened and suggested that he give it a day’s rest especially as it happened to be a Sunday. Surely a good God would accept such rest on his day and recognize all the daily commitment. But the man turned Satan down and kept on pushing against that rock however foolish he may have looked. Finally, the man asked God why he had committed him to such an impossible task. It was then that God replied that this was a test of his faith, and because he had honored the directive, God would now move that rock for him.  

 

Escalating Violence Predicted: Root Cause Suppressed by Media and Federal Courts

Hardly a day goes by without another fatal clash between police and citizens on the streets of America. Many are quick to blame it on racism, but as a civil rights attorney for over 23 years currently advocating for parental rights in our domestic courts, the root cause can be found in the destruction of fathers, families and parental authority. Escalating crime and violence is the natural outcome beyond the capacity of law enforcement to control. It is a central issue in my case currently pending before the United States Supreme Court.

Dallas Police Chief David Brown may have summed it up best when he lamented that police cannot be made the repository for all of our societal problems ranging from loose dogs to domestic disputes. Unfortunately conflict profiteers in our family courts are dumping upon society and adding to police burdens every day. It is an epidemic tackled in my case but suppressed and censored by our courts and legal profession to the point of persecution and international protection. And so, while the media squawks about a problem it cannot or will not comprehend, the “bank” plays on.

That root cause has been quietly making its way through our federal courts for the past ten years and now the Supreme Court is being asked to appoint a Special Master to hold hearings and inquiries on the state of American families in divorce and family courts. Call it “families vs fees,” the official title is Leon R. Koziol vs United States District Court for the Northern District of New York. It was necessarily filed as an extraordinary action originating with an uncontested divorce in 2006 that escalated to an unprecedented 35 trial judge disqualifications and exposure of some of the most horrific injustices ever to mar a civilized court system.

One key aspect of my case is the murder of an unarmed African-American father in South Carolina named Walter Scott. Unlike other victims of police shootings, Walter Scott was shot in the back five times for fleeing a child support warrant at a traffic stop. There was no crime and the horrific scene was caught on a citizen video. A family lost their daddy due to a debt, nothing more. The money enforcement practices in these courts have become so “draconian” that at least one British court refused to extradict a “dead beat” to the states. As predicted here at the time, terrorism and violence will escalate due to the media and court suppression of this core cause.

Point Three: Persecution inflicted upon this public critic and judicial whistle blower meets the criteria for asylum under United Nations Convention of 1951.

 The fact pattern here is shockingly unprecedented and incredible from a human rights standpoint. It mirrors in many material respects the abuses inflicted upon Chinese lawyer Chen Guangcheng who like petitioner advocated for women’s rights, land rights and parent-child rights. He fled China in 2012 and was accorded protected status in New York with help of then secretary of state Hillary Clinton.

In this case, the mirror mistreatment of an American civil rights attorney and parent entitles petitioner to protected status under the United Nations Convention of 1951 and other human rights protocols. Such protection is accorded to persons persecuted for their political views and free speech. At least one British court denied extradition to a child support obligor due to “draconian” enforcement practices in the states. The case for protection here is detailed in the opening segment of this brief and in petitioner’s motion filed on August 9, 2016 and will not be repeated.

Since that time, petitioner was improperly served with an amended petition for enforcement of a child support order and willful contempt. It contained language in boldface capital letters on its Notice face page which is far more threatening than the original one allegedly served on petitioner prior to petition filing here. As explained in the fact segment of this brief, the original service was made fraudulently with a city marshal admitting on the witness stand at a September 1, 2016 hearing in Syracuse Family Court that he had lied under oath. Critical to the service that never occurred is a shocking criminal sentence now being threatened in the amended version yet to be served:

On April 5, 2015, an unarmed African-American father was shot dead in the back five times by a traffic cop while fleeing a child support warrant on a routine stop. Although both white and black officers were charged in the murder, the children forever lost their dad for a money debt arbitrarily inflated to maximize federal incentive revenues under Title IV-D and to feed family court beneficiaries. It is a situation well out of control and leading to increased instances of violence across America.

Respondents have successfully destroyed petitioner and his reform efforts through a seizure of his licenses, income capacities and disparagements of his reputation and public message. Petitioner’s background was omitted from the original petition for the sake of substance. However in this supplemental brief it is required to repair to the extent possible the false depictions ascribed to the judicial whistle blower here while further solidifying the conscience shocking misconduct of respondents for substantive due process purposes and extraordinary relief.

Petitioner is a civil rights lawyer still registered with the New York Bar during an indefinite suspension period which began on February 5, 2010. This is when he took a conscientious stand against father discrimination and corruption generally consistent with his professional oath. In front page news of the day, he compared his refusal to pay gender biased support orders to the refusal of Susan B. Anthony to pay her fine after being convicted of the crime of voting in the 1872 presidential elections.

It must be emphasized that petitioner never refused support of his children or compliance with agreements when honored by the “custodial parent.” Ironically the court in Rochester, New York where the arguments and suspension occurred is dedicated to Susan B. Anthony due to location of her trial.

Petitioner was known in the Northern District of New York as an attorney willing to take on cases which few others would for fear of government retribution or public condemnation. His achievements include legal precedents and six figure recoveries for victims of government abuse. All the while, he was self trained, generating a perfect record of acquittals in criminal cases. A sampling of news articles ignored in the record below is appended to the lower court record at A-91.

Petitioner’s civil rights work earned him interviews on the CBS Program 60 Minutes and introductions on the front page of New York Times, among other major media. A published book was discussed on CNN and his candidacy for United States Congress was a headline story in 2006. After years of complex litigation against high profile firms, he secured final judgment in New York Supreme Court invalidating the largest casino gaming compact in the state on constitutional grounds.

In education, a Juris Doctor was conferred by Northern Illinois University, College of Law with an award from the American Bar Association in State and Local Government. Petitioner received a Bachelor of Professional Studies from the State University of New York, College of Technology, thereafter joining the management team of a Fortune 500 manufacturer. Later he served as a corporation counsel, school board attorney and city councilman with a focus on risk management.

Petitioner’s many published cases include Patterson v City of Utica, 370 F.3d 322 (2nd Cir. 2004)($333,820.32 civil rights verdict argued before Justice Sonia Sotomayor); Oneida Indian Nation v Oneida County, 132 F. Supp. 2d 71 (NDNY 2000)(successful casino challenge in defense of landowner rights) Koziol v Hanna, 107 F. Supp. 2d 170 (NDNY 2000)(free speech challenge as city corporation counsel invalidating mayoral gag order); Currie v Kowalewski, 842 F. Supp. 57 (NDNY 1994)(successful sexual harassment case), Palaimo v Lutz, 837 F. Supp. 55 (NDNY 1993)(brutality and unlawful confinement claims allowed for 72 year old woman).

Rounding out his scholarship, community service awards and dedication plaques on a new city courthouse is his latest published novel regarding nuclear terrorism. It can be found at major bookseller sites entitled Voyage to Armageddon. Within two years of law school graduation in 1985, petitioner obtained a restraining order on a $30 million school project. Today he is unable to get a family court order to enforce a single phone call from his daughters. Much of petitioner’s unyielding quest for justice derives from his own father who shared horror stories of his five years spent in a Nazi internment camp.

City Marshal Admits Perjury Under Cross-Examination by Leon Koziol in Family Court

Yes you read that headline correctly. It happened in the Syracuse Onondaga County Courthouse on September 1, 2016. The proceeding was focused on a sworn document filed by a city marshal stating that a family court petition was duly served upon Leon Koziol. Under normal circumstances its receipt in the mail would have been accepted but the perjuries in these courts have become so rampant that an example had to be made.

Leon challenged an event that never occurred because he was its victim. Time and again, perjury by his adversaries has been overlooked due to his crusade against court corruption, i.e. his ex-spouse Kelly Hawse-Koziol stating under oath that she successfully e-mailed residential change of Leon’s children under “gmai.com”. In the case of Walter Scott, an unarmed father was shot dead in the back by a traffic cop for fleeing a support warrant.

Leon presented his side of the case at a traverse hearing (challenge to jurisdiction). One witness was Alan Allen, a former Chicago area police officer and retired military. He operates a successful Karaoke business, Sound Investment, and he had been conversing with Leon at the time of alleged service at a popular venue known as The Killabrew. No service of papers was observed. There was also a security camera and other evidence but by the time the service affidavit was filed and provided, they were no longer available.

After Leon rested his case, Syracuse divorce lawyer Jeffrey DeRoberts put his only witness on the stand, a city marshal, who stated he had made service contrary to other witnesses. The lawyer then put his filed affidavit into evidence. On cross examination, that affidavit was obtained from the judge and put again before the witness. Leon asked him to read a sworn statement on his service which he admitted was never made. Then the marshal was asked if he lied under oath, and he admitted that he had, a rare event in any courtroom.

But the story gets worse. Leon and Mr. Allen had to make a 120 mile round trip and the better part of a day from their income demands to attend a hearing which should never have occurred. Kelly Hawse-Koziol, who hired this city marshal and lawyer, never even appeared for her own petition and hearing. Had Leon done this, a warrant would have issued and his counter-petitions dismissed. When the one-sided treatment was raised, the hearing officer, Karen Brandt, stated that Leon could have subpoenaed the petitioner.

That explanation conflicted with the record. A teleconference was denied at an earlier appearance on July 12, 2016. Ms. Brandt emphasized that personal observation of witness demeanor enables her to test credibility, something Leon conceded as a trial attorney for over 23 years. But there were no witness notice requirements here and the ex-spouse, a routine liar in court, would have had conversations with the marshal she hired. That made her a material witness. She could be called to the stand as a party in the courtroom.

But maybe a better explanation existed in the fact that Attorney DeRoberts made a 120 mile round trip to the wrong court. Oneida County Family Court is where both parents reside and the case is venued but all judges there have been disqualified. More disturbing, if not embarrassing, this attorney’s office was located across the street from the correct courthouse. Leon and Mr. Allen had to wait an extra one hour for DeRoberts to return home.

We do not know yet whether Kelly Hawse-Koziol also went to the wrong court, but you have to believe she would be outraged if her lawyer was to blame. Ms. Brandt accepted the blame, she has judicial immunity, and that may excuse the lawyer from ethics or malpractice liability, but any such record is not in Leon’s possession. We only know that the case itself was poorly presented (i.e. the marshal was not asked key questions regarding description, noise and crowd interference to minimize Leon’s evidence while bolstering his own).

The bottom line: instead of money going to Leon’s children, it is going to process servers and lawyers, at least five already representing Hawse-Koziol. The never-served petition has boldface print on its face page which warns of arrest, contempt and confinement for any non-appearance. Thank goodness Leon did not get shot dead in the back, although Hawse-Koziol, DeRoberts and the city marshal may feel otherwise. Unlike the pleasantries of the first appearance, DeRoberts was visibly angry en route to his office across the street.

After Walter Scott and Dallas Shootings, Family Court Corruption is Reaching Another Boiling Point

Dallas Police Chief David Brown may have said it best when describing the state of affairs among law enforcement in this country. After the targeting and murders of five Dallas police officers last week, he declared that we’re expecting too much from cops these days.

As examples he cited unleashed dogs, policing social injustices and preventing crime in neighborhoods where 70% of the families are raised by single mothers. He emphasized that First Amendment requires media to fairly report the underlying causes of our present crises.

Welcome to Leon Koziol.com, a component of secondary media attempting with little success to expose those same causes. In two reports to U.S. Attorney Loretta Lynch, Dr. Leon Koziol, civil rights advocate, explained how corruption was being suppressed in divorce and family courts across America to feed a trillion dollar industry. A generic reply many months later referenced only a “letter” with no indication that anything had been reviewed.

In those reports, Dr. Koziol also predicted that family court victims were reaching a boiling point. It was based, in part, on an unarmed father, Walter Scott, who was shot dead in the back on April 4, 2015 not simply because he was African-American but because he was fleeing a child support warrant. Both white and black traffic cops were charged. Already all is forgotten.

The whole incident with a $3 million city settlement could have been avoided if the laws were geared to equal parenting. Instead Lawyer  greed and lucrative conflict caused by an antiquated custody system remain the “law” in conflict with natural rights of parents. One parent households are the product of this one parent (custody)  system.

If you are a regular follower of this site, you know how the domestic and disciplinary courts of New York have exploited Leon’s children and law license to suppress the First Amendment. A gag order on this site was set aside recently after a mandamus show cause order was signed in New York Supreme Court against Family Judge Daniel King. The offender then disqualified himself after all the damage was done.

Enter replacement Judge James Eby, newly seated in Oswego Family Court, who merely took over where Dan King left off, continuing a shocking level of systemic bias for all of the filings and reform efforts here over a ten year period. His decision of July 12, 2016 was already written prior to argument which he mandated to occur that day in capital letters by PERSONAL APPEARANCES.

This was all good for child lawyer William Koslosky who simply billed the taxpayers for his undeserved fees. But it required the parents to make four hour round trips to attend already decided proceedings instead of teleconferences utilized by closer judges in the past. Obviously this was pure retaliation for the successful removal of fellow Judge King and his gag order. Judge Eby previously denied Fathers Day to Dr. Koziol and was visibly angered that it was procured anyway without his permission and without incident.

In his edict, Eby overlooked a prior removal of incompetent child lawyer William Koslosky and never even mentioned a disqualification motion or its compelling grounds for his own removal. This is how they avoid accountability on the record while abusing judicial office to suppress exposure of gross misconduct. Yes folks, once again you can’t make this stuff up.

Dr. Koziol has never been charged with  unfit parenting or any crime unlike others who receive unrestricted parenting time. Judge Eby simply orchestrated an outcome which will leave his public critic forever without any child contact, all because a gold digging mother, Kelly Hawse-Koziol, decided to replace the real father with an unfit, childless millionaire named Joseph Flihan. She committed perjury and fraud in the process, i.e. her testimony that e-mail notice of child relocation was successful with “gmai.com” (“l” character missing).

The corruption here is out of control and it requires elevated public response. The injustices will not be swept away but incur greater exposure and consequences instead. Such corruption has been ratified through inaction of our federal courts and state judicial commissions. When the corruption gets this bad, victims take matters into their own hands. Welcome Dallas Police Chief to our justice system on yet another neglected front.

Seriously Doug ? A state sponsored dead beat dads (only) list? Non-criminal parents publicly vilified in social media with their children watching? Isn’t that akin to public floggings and witch hunts outlawed centuries ago? Maybe you were inebriated during this announcement in your 2016 state of the state address.

Shouldn’t you have been more concerned with drug dealers and child molesters crossing illegally from Mexico, or those who take jobs away from American fathers because they move their factories to China? There are a lot of good reasons why fathers (only) fall behind in child support.

Everyone knows that fathers are discriminated in family courts. Raked over principally for money, they are placed constantly on the defensive with lawyers bearing false promises.

The stats don’t lie. According to the U.S. Census Bureau, roughly 85% of all parents paying child support are still fathers, same as it’s been for decades. In less time, gay marriage was approved because it would allow a whole new constituency into this trillion dollar gold mine.

Come on, Doug, mother’s rights? Children’s rights? Equal rights? Nonsense! It’s always been about the money even with cheap new labor which truly underscored equality in the workplace. But here the hypocrisy is much more profound because the injustices are occurring where we least expect it. Family courts have been turned into capitalist courts.

Shocked by that statement Doug? Well let’s make a deal, you know the kind, the ones that you routinely broker to get laws passed. If I can back this up, you’ll agree to abandon this ill begotten hit list. Maybe you’ll invite me to address your fellow lawmakers in the Arizona Legislature.

It’s really not too hard to understand so bear with me because it affects at least half of your Arizona constituency. In family courts throughout the country, our Constitution is being set aside in the so-called “best interests of the child.”

Adolph Hitler did the same starting with a target group. In Mein Kampf, he declared that the people will “happily” give up their rights when the state declares an act to be in their children’s interests. Here it is a custody war machine that is being built to benefit a glut of lawyers seeking employment.

While other institutions are moving closer to equal treatment under our supreme laws, divorce and family courts are hanging on to the opposite. Discrimination between fathers and mothers is lucrative because it incites needless but lucrative controversy.

How does this work? Well you know Doug, but you don’t want to lose campaign donations by publicizing the cause of support delinquencies as much as you do its  victims.

Support magistrates are rewarded by federal Title IV-D funding incentives and support collection interest. The greater the number and size of these so-called “awards” the greater the revenue for court operations.

That gives these magistrates a financial stake in the outcome and consequently they are biased. Still with me Doug? The poor dad who thinks he’s going to get fair treatment here will get burned no matter his argument. It’s the best suppressed secret in government today because politicians have turned our children into a trillion dollar industry.

As the Commandant of the last state to recognize Martin Luther King holiday, you must also know that these draconian support collection practices and debtor prisons impact minorities most. Just take Walter Scott for example, a fit and unarmed father shot dead in the back by a traffic cop for fleeing a child support warrant? Now why would he flee a money debt in the new South?

You can answer that question and become an instant American hero for civil and human rights by conveying a sincere public apology for promoting gender, race and father discrimination all in one speech.

You can call for shared parenting and be the first state to advance true equality where it counts the most, where our children and families are concerned.

But we all know you will not MAN-UP and do this. And you know why? Because you will be targeted by feminist groups and bar associations. They will orchestrate ethics charges, exploit your family and  attack every thing you do and say as crazy until you finally lose your job, if not your mind. Then you will become a dead beat.

Such targeting has happened to others who have taken on this cause, like a civil rights lawyer gagged recently by a judge for exposing corruption in family courts in New York. Now we all know that such travesties do not occur there, and we all know that everyone making a living off the misfortunes of parents are truly looking out for the best interests of the states’ children.

Free at Last, Free at Last, but not in Family Court!

On this Martin Luther King Day, we join fellow Americans in paying tribute to our greatest civil rights leader. It’s hard to imagine in our lifetimes that a day existed when entire neighborhoods and school districts were segregated on account of race. As a free society we have come a long way indeed.

Unfortunately in family courts throughout the same land, we’ve gone in an opposite direction. This is an enclave in which equality has no meaning, civil rights are trampled upon and African-Americans are being slaughtered or imprisoned for money debts. A prime example is Walter Scott murdered this past year by a traffic cop in South Carolina while fleeing a child support warrant.

Family court has been described as a “constitution-free zone.” The state has found a mechanism for oppression by exploiting our children to raise revenues and fees on the backs of fathers who simply find themselves unable to meet expenses after taxes and child support are deducted from their paychecks.

And it’s not just minorities being imprisoned for these debts. Our military and law enforcement represent a growing constituency of victims. In upstate New York a police investigator committed a murder-suicide upon leaving support court leaving three children without parents and the city with a $2 million liability, see Pearce v Longo.

Fathers are still 85% of all child support payors and we have become the most imprisoned population in the free world. A trillion dollar industry has forced dedicated dads to be on a constant defensive in these courts. It’s long past a time when equality and civility are achieved in the places most trusted to protect our basic human rights.

Unfortunately that’s where the violations are still occurring. Family judges like Daniel King are the civil rights violators protected by absolute immunity. That’s also why we must act on our own. In coming days you will see our proposal for a major rally in our nation’s capital to make a real difference. We must make our grievances known during a key presidential election on Fathers’ Day week.

The time for talk and keyboarding is over. When a governor in Arizona can still make speeches replete with sexist slurs, dead beat dads (only) and feel no shame, fathers must take such public servants to task. We will not go quietly into the night while everyone else preaches equal rights at our expense. Governor Rip Van Wacko Awakens From 50 Year Stupor

Did this really happen in 2016? A new governor desperate for attention actually issued a state of the state address that featured the vilification of “dead beat DADS” on social media. His name is Doug Ducey, and by all indications he has been asleep since the 19th Century, maybe longer.

Our federal government engaged in a similar sexist act in 2012 when the Justice Department issued a news release boasting of its “sting operation” on “dead beat dads.” After a protest and lobby initiative in Congress, that phrase was dropped from public pronouncements.

Will someone in the Arizona Legislature now wake this guy up to our times? Moms are working, they get behind in child support obligations too, and taking into account their proportion to all female obligors, it is a more pressing issue due to the historic favor they receive in family courts.

“Dead beat Dads” is a sexist slur for the pathetically obvious reason that it stereotypes a stigmatizing condition based strictly on gender. In Ducey-land, there are no “dead beat Broads” or jail terms for moms who file false accusations to alienate fathers from their children.

Through so-called “child support,” fathers are often paying the state to take away their offspring. In effect, it is a discriminatory court system they are protesting no different than Susan B. Anthony who refused to pay her fine for the crime of voting in the 1872 elections.

Where is Ducey’s focus on bureaucratic corruption which is rampant here? States like Arizona receive Title IV-D funds based on the number and size of support awards to pay for court operations. Interest revenue is also derived from state banks known as support collection centers.

Excessive awards result from biased judges leading to a social epidemic. Government is actually creating “dead beats.” In the Kids for Cash scandal, two Pennsylvania judges were sent to prison for taking bribes from prison contractors requiring the reversal of 4,000 juvenile convictions.

You would think that our government would learn from real life precedent like the murder of Walter Scott last year in South Carolina. An unarmed father and “repeat debt offender” was shot in the back five times by a traffic cop while fleeing a support warrant. Now why would he flee?

South Carolina has some of the toughest enforcement laws, yet it is among the worst in collection rates. Veterans and law enforcement have suicide rates suppressed by this trillion dollar industry. One is featured at Purple Heart’s Final Beat, Second Class Citizen.org.

Other examples include a police investigator who left support court and committed a murder-suicide despite protection orders by use of a common kitchen knife. It left behind three children and a $2 million civil rights liability, see Pearce v Longo, 766 F. Supp.2d 367 (NDNY 2011).

State vilification of “dads-only” raises other serious concerns. There is a thing known as our Bill of Rights. Even if it got by him in civics class, Doug Ducey should have recalled “witch” hunts and public flogging that were outlawed by our founding dads due to their barbaric nature.

Use of the pronoun “his” before the words “child support” has become as common as the illegal aliens crossing Ducey’s state border with Mexico. These criminals bearing vast burdens upon taxpaying “dads” are receiving more protection than our own citizens. Where is that focus?

The criminalization of fatherhood is very real in America today. Increasingly, proud veterans are finding their way onto these Doucey hit lists simply because they lack skills or are subjected to cheap illegal competitors. Any lawyer who stands up to such injustices can expect retaliation.

One gave testimony at a Corruption Commission in New York which was prematurely shut down by the governor who created it. A newspaper later reported that the same governor was seriously behind on his own child support. Like Doucey, he was promoting tough enforcement.

While such hypocrites find it expedient to “beat up” on dads, they are inflicting greater injury to innocent children and national security. Of the 58,000 names on the Vietnam War Memorial, all but eight are men. Is this any way to honor their sacrifices for fair treatment here in the states?
